Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant was not in attendance.
Staff Member Kritz discussed the proposed changes. He detailed the original
conceptual development plan versus the two new proposals. He said that the new
proposals would have 28 to 34 units. Staff discussed elevations of the villa dwelling
units compared to condominium apartment units.
There were no public comments.
The Zoning Advisory Commission discussed the request and the PUD provisions for
Assessment of Significant Change. The Commission discussed that the new proposal
is more compatible with the adjacent land use and setbacks have not changed
significantly. The Commission asked if the Commission needs to specify which
conceptual plan. Staff Member Kritz said the developer is looking for the flexibility to
use either concept depending on what the market demands. The Commission noted
that the project proposals are not a significant change.
Recommendation
By a vote of 6 to 0 the Zoning Advisory Commission determined that the submitted
concepts did not represent a significant change from the approved conceptual plan.

As a representative of Conlon Development, I would like to request of your Board consideration
for modifications to the Links Glen Development relative to the lay-out of buildings and
variations of the types of units on the site.
Originally there was a mix of three building types on the site; single unit Chateaus (8), single
unit Villas (6), and two-story multi- unit buildings often units each (2), totaling 34 units.
Two options are now proposed based on demand for smaller single level units similar to the
Villas:
A). Concept #6 eliminates (2) Chateaus and (1) two-story ten-unit building while
adding (6) duplex Villa units which maintains the unit count of 34.
B). Concept 6A eliminates (2) Chateaus and both two-story ten-unit buildings
replacing them with (8) duplex Villa units for a total count of 28 units.
Our request for approval of these options would allow us the flexibility of changing the mix of
units as the market dictates without changing the character of the Development. We do not
request an increase in the total number of units. Current Links Glen homeowners unanimously
favor these concept proposals.

Introduction
The Links Glen Development was approved as a Planned Unit Development with a PR
Planned Residential designation at the July 18, 2005 City Council meeting. At that time,
the conceptual development plan provided for the development of villas, chateaus and
condominium apartments. The developer, Conlon Development, is requesting that the
Zoning Advisory Commission review two new concepts that alter the mix of units on the
site.
The Zoning Advisory Commission is being asked to review the requested changes and
determine whether they are significant enough to warrant the filing of a new petition.
Section 3.5.5(1)(6) of the Zoning Ordinance establishes that after the recording of the
final site plan changes consistent with the purpose or intent of this section may be
approved. Substantial changes affecting the purpose or intent of this section may
require a new application be filed.
Discussion
Tim Conlon, Conlon Development, has supplied two new concepts that illustrate
potential changes in the development of the remaining portion of Links Glen. The
proposals involve development of additional villas in lieu of condominium apartment
units. The original conceptual development plan for Links Glen proposed condominium
units fronting Wartburg Place on either side of the private roadway serving Links Glen.
Mr. Conlon has indicated that the villas have been a popular choice for people and he
would like the opportunity to provide additional flexibility in building out the remaining
portion of Links Glen Development.
The submitted concepts will change the look of the development from what was initially
proposed; however, the number of units will not be greater and could, in fact, be less.
The building setbacks will be less on the north side of the development (70 feet vs 30
feet) and greater on the south side of the development (32 feet vs 30 feet) than what
was proposed in the original plan. The proposed villa units will present less mass in

terms of their height and size than the condominium apartment buildings of the
approved conceptual plan.
Recommendation
Planning Services staff recommends that the Zoning Advisory Commission review the
submitted documents from Conlon Development and make a determination whether or
not the proposed changes are significant.
Attached to this memo is the existing approved conceptual development plan for Links
Glen as well as the minutes from the meeting where the Zoning Advisory Commission
recommended approval of the Planned Unit Development.

REGULAR SESSION

PRESENT: Chairperson Jeff Stiles; Commissioners Ron Smith, Martha Christ, Eugene
Bird, Jr., and Dick Schiltr; Staff Members Guy Hemenway and Kyle Kritz.
ABSENT: Commissioners Stephen Hardie and Ben Roush.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying that
the meeting was being held in compliance with the Iowa Open Meetings Law.
CALL TO ORDER: The meeting was called to order at 6:30 p.m.
MINUTES: The minutes of the June 1, 2005 meeting were approved unanimously as
submitted.
ACTION ITEMIPLAT OF SURVEY - Application of Ridgeway, LLC for approval of the Plat
of Survey Lot 1-9 & 2-9 Ridgeway Park along Diesel Drive in Dubuue County.
The applicant was not in attendance.
Staff Member Kritr outlined the staff report, noting that the subject property was within two
miles of the City of Dubuque; and therefore subject to Commission review. He stated that
Lot 2 of 9 at 375 square feet has less than the 5,000 square foot minimum required. He
said that Lot 2 of 9 is used only as an access to Lot 1 of 9, and is labeled non-buildable.
He recommended the Board approval the plat subject to waiving the lot area requirement
for Lot 2 of 9 and waiving Article IV, Design Improvement Standards of the Subdivision
Regulations, except for Section 42-19, Blocks and Lots.
The Commission members discussed the request and felt it was appropriate.
Motion by Bird, seconded by Smith, to approve the Plat of Survey of Lot 1-9 and 2-9 of
Ridgeway Park subject to waiving the lot area requirement for Lot 2-9 and waiving Article
IV, Design Improvement Standards, of the Subdivision Regulations, except for Section 42-
19, Blocks and lots. Motion carved by the following vote: Aye -Smith, Christ, Bird,
Schiltz and Stiles; Nay -None.
PUBLIC HEARINGIREZONING• Application of Tim ConloNConlon Partners to rezone
property located in the 300 Block of Wartburg Place from R-1 Single-Family Residential

Steve Conlon, representing Conlon Construction, introduced Marty Johnson, project
architect. He stated that the subject property is a 10-acre site bounded by Woodward's
property, Schmitt's property, and the Dubuque Goif and Country Club. Mr. Johnson
outlined the property history. He discussed the concept plan, including the single-access,
building setbacks, landscaping, and attention areas. He stated that the intent is to place 20
units on the west side of the development adjacent to the Wartburg Place right-of-way. He
stated that the central access would lead to a courtyard bounded by eight single-family
units and six townhouse units for a total of 34 units for the project.
Mike Schmitt, 274 Wartburg Place, asked about the drive access configuration. He stated
he was concerned with multiple accesses would bg used.
W. Paul Woodward, Jr., 384 Wartburg Place, expressed concerns with screening. He
stated that additional vegetation would be necessary to screen his property from light,
sound and view.
Mr. Johnson discussed screening options for the south lot line.
Staff Member Kritz outlined the staff report. He noted that City departments have reviewed
the concept plan. He said that the property can be served by water and sewer with aid of a
lift station. He stated that the storm water de#ention basin is compliant. He reviewed the
proposed arched access. He stated that the site had overflow parking areas for visitor
parking.
Staff Member Kritz and the Commission discussed the significant versus non-significant
changes. He stated that the site would be bound to 34 units and 20 units along Wartburg
Place. The Commission discussed the request and felt that adequate measures were
undertaken to ensure appropriate development.
Motion by Schiltr, seconded by Christ, to approve the planned unit development as
submitted. Motion carried by the following vote: Aye -Smith, Christ, Bird, Schiltr and
Stiles; Nay -None.
ELECTION OF OFFICERS: The Commission unanimously elected Jeff Stiles as
Chairperson, Eugene Bird, Jr. as Vice Chairperson and Martha Christ as Secretary.
ADJOURNMENT: The meeting adjourned at 7:00 p.m.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED !N THE 300 BLOCK OF
WARTBURG PLACE FROM R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT TO
PUD PLANNED UNIT DEVELOPMENT DISTRICT WITH A PR PLANNED
RESIDENTIAL DISTRICT DESIGNATION AND AMENDING ORDINANCE -
96 AND ADOPTING A REVISED CONCEPTUAL DEVELOPMENT PLAN WITH
CONDITIONS, FOR LINKS GLEN RESIDENTIAL DEVELOPMENT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. Appendix A {the Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by amending by reclassifying the hereinafter described
property from R-1 Single=Family Residential District to PUD Planned Unit Development
District with a PR Planned Residential District designation and amending Ordinance -
96 and adopting a revised conceptual development plan, a copy of which is on file with
the City of Dubuque Planning Services Department, for property legally described to wit:
Lot 1-1-1 M.L. 139, Lot 2-1-1-1-2-1-1 M.L. 139, Lot 1-1-1-1-1-2-1-1- M.L.
139, Lot 2-1-1-2-1-1 M.L. 139, Lot 1-2-2-1-1- M.L. 139, Lot 2-2-2-1-1 M.L.
139, Lot 2-1-2-1-1 M.L. 139, and Lot 2-1-2 M.L. 139., .and to the centerline
of the adjoining public right-of--way, all in the City of Dubuque, Iowa.
Section 2. Pursuant to Iowa Code Section 414.5 (2003), and as an express
condition of the reclass~cation, the undersigned property owner agrees to the following
conditions, all of which the property owner further agrees are reasonable and imposed
to satisfy the public needs that are caused directly by the zoning reclassification:
A. Use Regulations:
The following regulations shalt apply to all uses made of land in the above-
described PUD District:
1. Principal permitted uses shall be limited to:
a. 20 condominium apartments
b. 8 condominium homes
c. 6 condominium villas

2. Accessory uses shall include any use customarily incidental and
subordinate to the principal use it serves.
B. Lot and Bulk Re, uq lations.
Development of land in the PUD District shall be regulated as follows:
The proposed residential development shall be constructed in
substantial compliance with the attached conceptual development plan.
2. Maximum building height shall be limited to 40 feet.
C. Performance Standards.
The development and maintenance of uses in this PUD District shall be
established in conformance with Section 3-5.5 of the Zoning Ordinance and
the following standards:
1. Adequate erosion control shall be provided during all phases of
construction.
2. Off-street parking shall be provided as shown on the approved
conceptual plan.
3. Storm water control facilities will be installed as per City Engineering
requirements.
4. Final site development plans shah be submitted in accordance with
Section 4-4 of the Zoning Ordinance prior to construction of any
buildings.
D. Open Space and Recreational Areas
Open space and landscaping in the PUD District shall be regulated as
follows:
Those areas not designated on the conceptual development plan shall be
maintained as open space, as defined by Section 8 of the Zoning Ordinance
by the property owner and/or association.
E. Sign Regulations.
Signs in the PUD District shall be regufa#ed in accordance with the R-1
Single-Family Residential District sign regulations of the Zoning Ordinance.
F. Transfer of Ownership.
Transfer of ownership or lease of property in this PUD District shall include
in the transferor lease agreement a provision that the purchaser or lessee
acknowledges awareness of the conditions authorizing the establishment of
the district.

G. Reclassification of Subiect Proaerty.
The City of Dubuque, Iowa, may initiate zoning reclassification proceedings
to the R-1 Single-Family Residential District in accordance with Section 6 of
the Zoning Ordinance if the property owner fails to complete or maintain any
of the conditions of this ordinance.
H. Modifications.
Any mod cations of this Ordinance must be approved by the City Council in
accordance with zoning reclassification proceedings of Section 6 of the
Zoning Ordinance.
I. Recording.
A copy of this ordinance shall be recorded at the expense of the property
owner(s) with the Dubuque County Recorder as a permanent record of the
conditions accepted as part of this reclassification approval. This ordinance
shall be binding upon the undersigned and his/her heirs, successors and
assigns.
Section 3. The foregoing amendment has heretofore been reviewed by the
Zoning Commission of the City of Dubuque, Iowa.
Section 4. The foregoing amendment shall take effect upon publication, as
provided by faw.
