Whereas, in 1999 and again in 2002 and 2004, heavy rains produced flood damage spurring a Presidential Disaster Declarations for Dubuque County, and Whereas, the Lower Bee Branch Creek Restoration Project has been identified as one of a series of projects to provide relief from property damage due to flooding to 1,150 residents in the City of Dubuque, and Whereas, the City of Dubuque has expended $5,100,000 constructing the Carter Road detention Basin and the W. 32"d Street Detention Basin to mitigate flood damage, and Whereas, the Lower Bee Branch Creek Restoration Project is required to provide further protection from property damage due to flooding, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: That the City Manager or his designee is hereby authorized to submit an application for I-JOBS grant funding for the Lower Bee Branch Creek Restoration Project. BACKGROUND Governor Culver's signature initiative, I-JOBS is intended to strengthen Iowa's economy, help Iowa recover from the natural disasters of 2008, and preserve or create thousands of jobs. The $830 million three-year program includes several parts but focuses on the several key areas, including a Local Infrastructure Program. When I-JOBS was signed into law on May 14, 2009, Governor Culver also created an 11-member I-JOBS Board of Directors that to develop rules, review applications, and make grant decisions for the I-JOBS Local Infrastructure Program related to Disaster Recovery & Prevention. The I-Jobs Program included $118.5 million in revenue bonds for the I-JOBS Board of Directors to distribute, in the form of grants, for disaster rebuilding, reconstruction of local public buildings (FEMA PLUS), flood control, and flood prevention projects. Applicants can receive up to 75% for replacing or rebuilding existing disaster-related damaged property, and up to 50% for all other projects. An applicant cannot receive more than $50 million from this grant program. DISCUSSION Because the Bee Branch Creek Restoration Project is a flood prevention project, it seemed to qualify for consideration under the program. Therefore, in June of 2009, a Notice of Intent to Apply for the I-JOBS Local Infrastructure Program funds was submitted for the first phase of the project, the Lower Bee Branch Creek Restoration project. The Lower Bee Branch Creek Restoration Project is the section of the project from the 16th Street Detention Basin to the railroad tracks just north of the former pack site. On July 7, 2009 the City received notice from the Iowa Finance Authority that the City was eligible to apply for funds from the program. As a next step, the City was invited to complete an online application. The Engineering Department completed the application with help from the City Manager's Office, the Planning Department, and the Economic Development Department. Limited to 50% of the total project cost, the City's application requested $7,000,000 for the $15,541,000 Lower Bee Branch Creek Restoration Project. One of the requirements of the application is an "official resolution from the applicant authorizing the submission of (the I-JOBS) application." A draft resolution was submitted with the application with a note stating that the resolution would be presented to the City Council at the August 17, 2009 City Council meeting. Attached is that resolution. RECOMMENDATION I recommend that the City Council adopt the attached resolution authorizing the City Manager to submit an application for I-JOBS funding in the amount of $7,000,000 for the Lower Bee Branch Creek Restoration Project.
