The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that the submitted Plat of Survey will
subdivide an existing parcel into two lots and facilitate the sale of two existing buildings on
the property.
Staff reviewed the Plat of Survey, noting that currently two buildings are located on a single
parcel. This situation is grandfathered but to allow the sale of the individual buildings, the
lot must be subdivided. Staff also explained that Lot 1 and Lot 2 do not meet the lot area
requirement, and Lot 1 would not meet the lot frontage requirement.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the applicant is
requesting the waiving of the lot area requirement for both Lot 1 and Lot 2, and the lot
frontage requirement for Lot 1. The Commission found that the waiving of lot area and lot
frontage would not adversely impact adjacent property.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of Lots I and 2 of Winner Place
INTRODUCTION
The submitted Plat of Survey subdivides an existing parcel of land in two lots to facilitate
the sale of the building located at 25/27 W. 15th Street.
DISCUSSION
The submitted Plat of Survey of Lot 1 and 2 of Winner Place subdivides an existing
5,130 square foot lot into two substandard lots. Lot 1 has 1,875 square feet of area and
36.5 feet of frontage, when 5,000 square feet of lot area and 50 feet of lot frontage are
required. Lot 2 has 3,256 square feet of area, where 5,000 square feet of lot area is
required.
Currently, there is a three-story commercial storefront with apartments above on the
east side of the lot and a two-story duplex on the west side of the lot. Both structures
are physically separated by approximately five feet. The duplex is a solely residential
structure that is oriented toward 15th Street with the side of the structure facing the alley.
The three-story office/apartment building occupies a corner space at the intersection of
15th Street and Central Avenue with its primary entrance oriented toward Central
Avenue. Placing the structures on separate lots will enable the applicant to sell each
building individually but should not affect the well-being or character of the
neighborhood.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission approve the Plat of
Survey of Lots 1 and 2 of Winner Place, as it is in substantial compliance with the City
of Dubuque Subdivision Regulations subject to waiving lot area requirements for Lot 1
and 2 and the lot frontage requirement for Lot 1.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOTS 1 & 2 OF WINNER
PLACE
Whereas, there has been filed with the City Clerk a Plat of Survey of Lots 1 & 2 of
Winner Place; and
Whereas, Lot I provides 1,875 square feet of area, and Lot 2 provides 3,256 square
feet of area, where 5,000 square feet is required for each lot by Section 42-19(b) of the
Subdivision Regulations; and
Whereas, Lot 1 provides 36.5 feet of frontage, where 50 feet minimum is required by
Section 42-19(b) of the Subdivision Regulations; and
Whereas, said survey plat has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 1 with 1,875 square feet and Lot 2 with 3,256 square feet, where 5,000 square feet
is required for each lot, and to allow Lot 1 to have 36.5 feet of frontage, where 50 feet
minimum is required.
Section 2. That the Plat of Survey of Lots I & 2 of Winner Place is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said final plat
