City Engineer Gus Psihoyos is recommending acceptance of the construction contract
for the Town Clock Plaza Concrete Repair Project, as completed by Eastern Iowa
Excavating, in the final contract amount of $13,730.20, which is a 15.7% increase from
the original contract in the amount of $11,870.00.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Town Clock Plaza Concrete Repair Project.
BACKGROUND
In the spring of 2009, staff observed deteriorating concrete pavement at several
locations near the public plaza area on 7th Street, adjacent to the Town Clock. It was
determined that the entire middle section of the plaza area from the alley to Main Street
needed replacement due to its deteriorated condition. The use of buff-colored concrete
was chosen to complement the existing decorative pavement in the Town Clock and
Main Street areas.
The plaza area on 7th Street by the Town Clock is in the Greater Downtown Urban
Renewal District and the Town Clock Plaza Concrete Repair Project was completed in
compliance with the Secretary of the Interior's Standards for Rehabilitation and
Guidelines for Rehabilitating Historic Structures.
DISCUSSION
On May 22, 2009, five (5) competitive quotations were received for the Town Clock
Plaza Concrete Repair Project. Based on a competitive quotation process for public
improvements in accordance with Iowa Code, Section 26.14, the Town Clock Plaza
Concrete Repair Project was awarded to Eastern Iowa Excavating of Cascade, Iowa, in
the amount of $11,870.
DISCUSSION
The Town Clock Plaza Concrete Repair Project was completed by Eastern Iowa
Excavating of Cascade, Iowa, in the final contract amount of $13,730.20, which is a
15.7% increase from the original contract in the amount of $11,870.00.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the contract amount of $13,730.20 to Eastern Iowa Excavating for the Town Clock
Plaza Concrete Repair Project.

ACCEPTING THE TOWN CLOCK PLAZA CONCRETE REPAIR PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Town Clock Plaza Concrete
Repair Project (the Project) has been completed and the City Engineer has examined
the work and filed a certificate stating that the Project has been completed according to
the terms of the Public Improvement Contract and that the City Engineer recommends
that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Town Clock Plaza Repair Capital Improvement Project appropriation for the contract
amount of $13,730.20 less any retained percentage provided for therein as provided in
Iowa Code chapter 573, and to pay such retainage only in accordance with the
provisions of Iowa Code chapter 573.
