Van Milligen, City Man FROM: Gus Psihoyos, City Engineer DATE: August 31, 2009 SUBJECT: National Mississippi River Museum and Aquarium Rivers Center Phase I -Roof Replacement Project (Iowa DOT No. EDP-2100 (638)--7Y-31) CIP 1001856 INTRODUCTION The enclosed resolution provides for the acceptance of the construction contract for the National Mississippi River Museum and Aquarium Rivers Center, Phase I -Roof Replacement Project (Iowa DOT No. EDP-2100 (638)--7Y-31). BACKGROUND The National Mississippi River Museum and Aquarium Rivers Center, Phase I -Roof Replacement Project involved the adaptive use of the former Iowa Welcome Center and the Diamond Jo Portside building at the Port of Dubuque by the National Mississippi River Museum and Aquarium as part of the Phase II museum expansion and the creation of the Great Rivers Center and Rivers to the Sea Exhibit facility. The project consisted of the removal of existing fully-adhered, single-ply roof membrane as well as all associated sheet metal flashings. Anew recovery board was installed over the existing roof insulation and a new fully-adhered, single-ply membrane was installed over the recovery board. New sheet metal flashings and thru-wall scuppers and downspouts were also installed. DISCUSSION On October 20, 2009, three (3) competitive quotations were received for the National Mississippi River Museum and Aquarium Rivers Center, Phase I -Roof Replacement Project. Based on a competitive quotation process for public improvements in accordance with Iowa Code, Section 26.14, the project was awarded to Geisler Brothers Company of Dubuque, Iowa, in the amount of $39,840. DISCUSSION The National Mississippi River Museum and Aquarium Rivers Center, Phase I -Roof Replacement Project was completed by Geisler Brothers Company of Dubuque, Iowa, in the final contract amount of $41,765.00, which is a 4.8% increase from the original contract in the amount of $39,840.00. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the payment of the contract amount of $41,765.00 to Geisler Brothers Company for the National Mississippi River Museum and Aquarium Rivers Center, Phase I -Roof Replacement Project. BUDGET IMPACT The project funding summary is as follows: CIP No. Fund Description Fund Amount 1001856 Rivers to the Sea Exhibit Grant (EDP-2100 (638)--7Y-31) $33,412.00 Dubuque County Historical Society Reimbursement (20%) 8,353.00 Total Project Funding $41,765.00 The Dubuque County Historical Society (DCHS) and the City, as the local sponsor, secured a Federal Appropriation through SAFETEA-LU legislation in the amount of $5 million for the Museum -Rivers to the Sea Exhibit project. After federal obligation limitations are applied, the grant total is approximately $4,530,695. The project will be funded with 20% Dubuque County Historical Society funds and 80% federal funds up to the maximum grant amount. The City is the sponsor of the grant but will not contribute any funds to the project. To date, $33,412 of these grant funds have been expended to complete the Phase I -Roof Replacement Project (638) improvements. The balance of the grant funding, $4,497,283, will be used to complete the Museum Rivers Center Project (652) -Phase II. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution to accept the improvements and to authorize the payment of the contract amount of $41,765.00 to Geisler Brothers Company for the National Mississippi River Museum and Aquarium Rivers Center, Phase I -Roof Replacement Project. EDP-2100 (638)--7Y-31) AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRACTOR Whereas, the Public Improvement Contract for the National Mississippi River Museum and Aquarium Rivers Center Project, Phase I -Roof Replacement Project (Iowa DOT No. EDP-2100 (638)--7Y-31) (the Project) has been completed and the City Engineer has examined the work and filed a certificate stating that the Project has been completed according to the terms of the Public Improvement Contract and that the City Engineer recommends that the Project be accepted; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. The recommendation of the City Engineer is approved and the Project is hereby accepted. Section 2. The Finance Director is hereby directed to pay to the Contractor from the Rivers to the See Exhibit_ Grant (EDP-2100 (638)--7Y-31) ($33,412, 80%), and the City shall be reimbursed in the amount of $8,353 (20%) from the Dubuque County Historical Society ($8,353.00) for the contract amount of $41,765.00 less any retained percentage provided for therein as provided in Iowa Code chapter 573, and to pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
