A request has been received from 40 Main, LLC to vacate a portion of Jones Street and
adjacent alley north of Jones behind 42, 44 and 48 Main Street. This additional land is
needed to accommodate the anticipated parking needs of this rehabilitation project.
The proposed project requires that the adjoining right-of-way be re-platted.
Economic Development Director Dave Heiar recommends City Council approval of
resolutions authorizing the Mayor to sign the four plats.

This is in response to a request from 40 Main, LLC for the vacating of a portion of Jones
Street and adjacent alley north of Jones behind 42, 44, and 48 Main Street. This
additional land is needed to accommodate the anticipated parking needs of this
rehabilitation project.
DISCUSSION
This proposed project requires that the adjoining right-of-way be re-platted.
The attached plats show the areas proposed to be vacated. The abutting properties are
owned by 40 Main, LLC, Flat Iron Development, LLC and Arcon, Inc.
The area to be vacated is divided into four (4) lots. Perpetual easement rights will be
reserved on the lots for maintenance of the existing sanitary sewer, watermain utilities,
force main, and other utilities.
The property has been valued based on previous appraisals.
RECOMMENDATION
The City has no plans for the utilization of the areas to be vacated, except for reserving
the utility easements as noted.
I would recommend that the attached plats be approved. By separate communication, I
am requesting that a public hearing be set for the disposition of the City's interest in the
subject area on September 21, 2009.
ACTION TO BE TAKEN
The action step is for the City Council to approve the attached resolutions authorizing
the Mayor to sign the four plats.

BLOCK 10 IN DUBUQUE HARBOR COMPANY'S ADDITION
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, a plat dated the 25t" day of August, 2009, prepared by Buesing
& Associates describing the proposed vacated portion of the Jones Sfreet cul-de-
sac to be known as Lot 1 of 1A of the West Half of Block 10 in Dubuque Harbor
Company's Addition in the City of Dubuque, Dubuque County, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated the 25t" day of August, 2009 prepared by
Buesing & Associates relative to the real estate hereinabove described be and
the same is hereby approved, and the Mayor and City Clerk be and they are
hereby authorized and directed to execute said plat for and on behalf of the City
of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a perpetual
easement including the right of ingress and egress thereto, for the purpose of
erecting, installing, constructing, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, television cable, fiber optics,
and electric lines as may be authorized by the City of Dubuque, Dubuque
County, Iowa, as shown on said Plat of Lot 1 of 1A of the West Half of Block 10
in Dubuque Harbor Company's Addition.
Section 3. That the City Clerk be and is hereby authorized and directed
to file said plat and certified copy of this resolution in the office of the Recorder in
and for Dubuque County, Iowa.

& Associates describing the proposed vacated portion of the Jones Street cul-de-
sac to be known as Lot 1 of 17A of the West Half of Block 1 in Dubuque Harbor
Company's Addition in the City of Dubuque, Dubuque County, Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the plat dated the 25th day of August, 2009 prepared by
Buesing ~ Associates relative to the real estate hereinabove described be and
the same is hereby approved, and the Mayor and City Clerk be and they are
hereby authorized and directed to execute said plat for and on behalf of the City
of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a perpetual
easement including the right of ingress and egress thereto, for the purpose of
erecting, installing, constructing, reconstructing, repairing, owning, operating, and
maintaining water, sewer, drainage, gas, telephone, television cable, fiber optics,
and electric lines as may be authorized by the City of Dubuque, Dubuque
County, Iowa, as shown on said Plat of Lot 1 of 17A of the West Half of Block 1
in Dubuque Harbor Company's Addition.
Section 3. That the City Clerk be and is hereby authorized and directed
to file said plat and certified copy of this resolution in the office of the Recorder in
and for Dubuque County, Iowa.
