A request has been received from Brian Kane, representing Tschiggfrie Excavating Co.,
for the vacating of the Final Plat of West End Commercial Subdivision, which includes a
platted street, easements and detention area.
West End Commercial Subdivision was platted in 2001 and included the dedication of a
street and detention area to the City of Dubuque. However, no street or final detention
improvements have been made in the platted area proposed to be vacated. The entire
property to be vacated, except the street and detention basin, which was dedicated to
the City, is owned by Tschiggfrie Excavating Co.
City Engineer Gus Psihoyos states that the City has no plans for the utilization of the
street or detention area on the plat proposed to be vacated. City Engineer Gus
Psihoyos recommends approval of the request to vacate for a fee of $400 for previous
engineering reviews, publication and filing fees, and recommends that a public hearing
be set for September 21, 2009, on the disposal of this property.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
A request has been received from Brian Kane, representing Tschiggfrie Excavating Co.,
for the vacating of the Final Plat of West End Commercial Subdivision, in the City of
Dubuque, Dubuque County, Iowa, which includes a platted street, easements and
detention area.
DISCUSSION
West End Commercial Subdivision was platted in 2001 and included the dedication of a
street and a detention area to the City of Dubuque. However, no street or final
detention improvements have been made in the platted area proposed to be vacated.
The entire property to be vacated, except the street and detention basin which was
dedicated to the City, is owned by Tschiggfrie Excavating Co. The area has been
surveyed and re-platted into West End Commercial Subdivision No. 2 as required for
the County Auditor for taxation purposes.
The City has no plans for the utilization of the street (Lot A) or detention area (Lot B) on
the plat proposed to be vacated. Tschiggfrie Excavating Co. has agreed to pay $400.00
for previous engineering reviews, publication, and filing fees.
RECOMMENDATION
I would recommend that the Final Plat of West End Commercial Subdivision in the City
of Dubuque, Iowa, and that the fee be established at $400.00 to cover the cost of
engineering review, publication, and filing fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the vacating of the Final Plat of West End Commercial
Subdivision and disposal of Lot A and Lot B of West End Commercial Subdivision to
Tschiggfrie Excavating Co. through the adoption of the enclosed resolution.

RESOLUTION OF INTENT TO VACATE THE FINAL PLAT OF WEST END
COMMERCIAL SUBDIVISION AND DISPOSE OF CITY INTEREST IN LOT A
AND LOT B IN WEST END COMMERCIAL SUBDIVISION IN THE CITY OF
DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, Tschiggfrie Excavating Co. has requested the vacating of the
Final Plat of West End Commercial Subdivision; and
Whereas, IIW Engineers & Surveyors, PC has prepared and submitted to
the City Council a plat showing the vacated Final Plat of West End Commercial
Subdivision, which hereinafter shall be known and described as the Final Plat of
West End Commercial Subdivision No. 2 in the City of Dubuque, Dubuque
County, Iowa should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque, Iowa, intends to vacate and
dispose of its interest the Final Plat of West End Commercial Subdivision in the
City of Dubuque, Dubuque County, Iowa.
Section 2. That the conveyance of Lot A and Lot B of West End
Commercial Subdivision in the City of Dubuque, Dubuque County, Iowa, be
contingent upon the payment of $300.00, plus platting, publication, and filing
fees.
Section 3. That the City Clerk be and is hereby authorized and directed
to cause a notice of intent to vacate the Final Plat of West End Commercial
Subdivision and dispose of Lot A and Lot B of West End Commercial Subdivision
said real estate to be published in the manner as prescribed by law.
Passed, approved and adopted this Sth da~ of September ,

Dear Mr. Mayor and Members of the Council:
We are counsel for Tschiggfrie Excavating Co , and have met with Mr. Edward D. Tschiggfrie
concerning the final plat of West End Commercial Subdivision which was recorded June 21, 2001
as Instrument No. 9433-01 of the records of the Dubuque County Recorder (see attached copy) (the
"Recorded Plat").
Resolution No. 218-01 (the "Resolution"), passed, approved and adopted June 21,2001 by
the City Council, required in section 10 thereof that our client furnish the guarantees (i.e., bond)
within 180 days after acceptance of the Resolution. While our client accepted the Resolution, our
client at that time had not decided whether to record the plat because it had not decided whether to
pursue the bond and/or improvements required by the Resolution. Somehow the plat was recorded.
The parties (including the City representatives) believe that such recording was inadvertent. Mr.
Tschiggfrie indicates that he did not have the plat recorded.
In any event, our client has been working on a new plat with your planning staff to subdivide
its entire parcel into two lots (the "New Plat"). Under the New Plat, copy enclosed, the entire parcel
becomes two lots instead of 13.
We respectfully request:
The City Council, after receiving a recommendation from staff and/or the Zoning
Advisory Commission, vacate the Recorded Plat;

2. This requested vacation needs to include the City relinquishing or terminating the
dedication of Menard Court (Lot A) shown on the Recorded Plat, as well as
relinquishing or terminating Lot B for detention basin purposes;
During this process of vacating the Recorded Plat, the utilities benefitting from the
utility easements noted on the plat will need to terminate those easements as well.
We understand that this should not be an issue since no nnprovements to the property
underlying the Recorded Plat have been made pursuant to the Resolution.
Our client intends to proceed with the New Plat and is in the process of finalizing it with the
appropriate City officials.
We appreciate your consideration ofthis request and respectfully seek your approval thereof.
