Council met at 7:30 P. M.
Present-Mayor Moffatt, Council-
men Murphy, Thompson, Van Duel-
man, Whartou, City Manager Rhom-
berg.
Mayor Moffatt stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may prop-
erly come before the meeting.
Councilman Thompson move d
that the rules be suspended for the
purpose of allowing any one present
in the Council Chamber, who wish-
es to do so, to address the Council.
Seconded by Councilman Van Duel-
man. Carried by the following vote:
Yeas-Mayor Moffatt, Council-
men Murphy, Thompson, Van Duel-
man, Wharton.
Nays-None.
Mr. Dallas Bush et al addressed
the Council protesting to odors of
gas and rock wool dust nuisance in
their neighborhood caused by the
operation of the Rock Wool Insula-
tion plant and requesting that Coun-
cil take action in abating this nuis-
ance. Councilman Murphy moved
that City Manager Rhomberg be in-
structed to notify the officials of
the Rock Wool Insulation Company
that protests tivere again entered at
the meeting of the City Council held
on July 3rd, 1944 relative to the
nuisance created from the operation
of their plant and that unless the
conditions complained of are reme-
died within a period of thirty clays
that the City Council will take steps
to abate the nuisances. Seconded
by Councilman Wharton. Carried
by the follotiving vote:

Communication of the hiterna-
tional Association of Chiefs of Po-
lice extending invitation to the
Chief of Police to attend the Annual
and Third War Conference of the
Association to be held in Cleveland,
Ohio, on August 14, 15 and 1G, 1944,
presented and read. Councilman
Van Duelman moved that Chief of
Police Strub be authorized to attend
the conference. Seconded by Coun-
cilman Whartou. Carried by the fol-
lowing vote:

men Murphy, Thompson, Van Duel-
man, Wharton.
Nays-None.
Communication of the Dubuque
Packing Company suggesting that
a survey be made and some plan
devised to overcome to some extent
the existing menace to their prop-
erty clue to the inadequacy of the
B-Branch Storm Sewer and stating
that they will make a substantial
financial contribution toward any
plan which may be developed and
which will be beneficial not only
to the Dubuque Packing Company
but also to the City as a whole,
presented and read. Councilman
Wharton moved that the communi-
cation be referred to the Council to
view the grounds. Seconded by
Councilman Murphy. Carried by the
following vote:
Yeas-Mayor Moffatt, Council-
men Murphy, Thompson, Vain Duel-
man, Wharton.

RESOLUTION N0.52-44
Whereas, the City of Duhuque,
Iowa, is the owner of certain vacant
real estate located on the southeast
corner of Railroad Avenue and
South Locust Street, and
Whereas, one Henry A. Robinson
has made application to the City
Council for an option to purchase
same on certain terms and condi-
tions as set forth in said applica-
tion, and
V~~hereas, the City Council has
investigated the same and deems
it advisable that the City of Du-
buque grant to said Henry A. Rob-
inson an option contract for the
purchase of said real estate, and
Whereas, a copy of the proposed
option contract has been presented
to this Council and they are fully
aware of its terms and conditions.

to attached
Now, Therefore be it resolved by
the City Council of the City of Du-
buque, Iowa, that the option con-
tract attached hereto be entered in-
to with said Henry A. Robinson for
the purchase of the city owned real
estate located at the southeast cor-
ner of Railroad Avenue and South
Locust Street, which contract pro-
vides for the amount of the pur-
chase price, the payment thereof,
the vacation of Huff Street and the
terms thereof, the right of easement
to i•un steel mains from the Missis-
sippi River to said property on Rail-
road Avenue and the terms and
conditions thereof, be and the same
are hereby approved.
Be it further resolved that the
Mayor and Clerk of the City of Du-
buque, Iowa, be and they are hereby
authorized and directed to execute
said contract for and on behalf of

OPTION CONTRACT
This agreement by and between
the City of Dubuque, Iowa, a Mu-
nicipal Corporation, party of the
first part, and Henry A. Robinson,
of Dubuque, Iowa, Party of the sec-
ond part, Witnesseth:
For and in consideration of the
sum of One Hundred Dollars, re-
ceipt of which is hereby acknowl-
edged by First Party from Second
Party, First party does hereby grant
to Second Party an exclusive op-
tion to purchase a certain parcel of
real estate now owned by First
party, said real estate being
"All of that piece of real estate
lying southeasterly of the Inter-
section of Railroad Avenue and
South Locust Street, bounded on
the westerly side by Locust
Street, on the northerly side by
Railroad Avenue, on the Easter-
ly side by Block 30, Dubuque Har-
bor Co. Addition, and on the
southerly side by the edge of an
existing sand fill being located a
distance of about 390 feet south-
erly of the south line of Railroad
Avenue, in the City of Dubuque,
Iowa, containing approximately
100,000 square feet. (the accur-
ate and legal description to be
given when this option is exer-
cised and a contract entered in-
to). The City of Dubuque is to re-
tain sufficient of said real estate
to have a 64 foot street all along
the west side of the same."
for the consideration of l0c per
square foot, to be paid as herein
provided; said option to continue
for a period of six months from
the date of the signing of this op-
tion contract.
This option is to be exercised by
Second Party paying to the city of
Dubuque within six months froth
the elate hereof the sum of $1900.00,
which sum of $1900.00 together
Svith the $100.00 paid for this option
is to be considered as $2,000.00
down payment on the purchase price
of the real estate herein referred
to, at which time First Party and
Second Pary are to enter into a
«rritten Contract for the Purchase
and Sale of said Real Estate, which
contract is to be in the regular form
used in this community, and which
is to provide, among other things:
the purchase price of the said real
estate is 10c per square foot, the
area to be ascertained and determ-
ined by actual survey and measure-
ments; said contract is to show the
clown payment of $2000 has been
paid, aucl that the balance of the
purchase price is to be paid for at
the rate of not less than $2000.00
yearly thereafter until the full
amount is paid, that the balance re-
maining unpaid is to bear interest
at the rate of four per cent per
amtum, payable annually; said con-
tract shall further provide the city
of Dubuque shall reserve to itself
any and all easements it has in said
real estate for sewers, water mains,
etc.
It is understood that in the event
said option is exercised and con-
tract entered into as hereinabove
mentioned, the First Party will va-
cate Huff Street as it is now lo-
cated, and convey the real estate
upon Huff Street is now located to
Second Party, upon condition that
Second Party will cause to be con-
veyed to the First Party a strip of
real estate 44 feet wide next ad-
joining the alley on the west, im-
mediately east of the Conlon prop-
erty, from Railroad Avenue south
to the southerly end of the property
now owned by the LaCrosse Dredge
Co.
It is further understood and
agreed that in the event said option
is exercised and contract entered
into as hereinabove mentioned, the
First Party will grant to Second
Party an easement for two eight
inch welded steel mains to run un-
derground from the Mississippi
River to the property which Second
Party is purchasing from the City
of Dubuque hereinbefore referred
to. The said steel mains to be laid
in the street antler the direction of
the City Manager.

authorized by Resolution of the City

Councilmen Murphy and Thompson.
Mayor Moffatt read the call and
stated that service thereof had Ueen
duly made and that this meeting is
called for the purpose of approving
the Uudget estimate of expenditures
for the fiscal year beginning April
1, 1945, and ending March 31, 1946,
as a Uasis for the tax levy for the
year 1944, the same to Ue collected
in the year 1945, and directing the
City Clerk to publish a notice of
the date of public hearing upon the
same and acting on any other busi-
ness as,may properly come before a
regular meeting of the City Council.

Gentlemen:
In accordance with the provisions
of law, as City Manager, I have pre-
pared au annual budget for the fis-
cal year begiuniug April 1, 1945 and
ending March 31, 1946 based upon
the estimated income and expenses
of the various departments of the
City of Dubuque. These department-
al estimates show the appropria-
tions for each department for the
preceding year (1944-1945) and also
the increases or decreases for the
ensuing year (1945-46).
The Uudget has been filed with
the City Clerk and will Ue puUlish-
ed as required by law in order that
objections thereto may be made Ue-
fore final action is taken on this
budget.

BUDGET PREPARED BY THE CITY MANAGER OF
THE CITY OF DUBUQUE, IOWA, FOR THE FISCAL
YEAR 1945-4&.
Notice is hereby given that the City 1\ianag'er of
the City of Dubuque has Prepared a budget on the
basis of estimates of the espenses of the various de-
partments of said City for the fiscal year beginning'
April 1, 1915 and ending 1\Iarch 31, 19-46. Such clePart-
utental estimates show espenses of each department
for the preceding Sear, and the Purpose for which the
consolidated tas levy, authorized by Section 6217 of
the Codo of Iowa 1939, as anlendeiL, is to be used, and
in addition thereto, the Purpose for which all other
tas levies are to be used, incltuliug the revenues from
miscellaneous sources. The levy of a consolidated tas
has heretofore been determined by said Counci] tuicl
incorporated in a resolution for such Purpose. The
budget will be considered for final adoption b>• the
City Council at a special me cling to be held in the
Council Chamber at the City Hall on the 10th day of

Honorable Mayor and City Council,
City of Dubuque, Iowa.
Gentlemen:
With reference to the claim of
Frank R. Lacy, filed on June 23,
1944, for X300.00 referred to me for
investigation and report, I find that
the clainage complained of was clone
on or about June 12, 1944, by a city
truck which the same was being en-
gaged in governmental duty; that
is, removing trees, branches of
trees, and other debris obstructing
streets in the City as a result of a
storm. The city is duty bound to
1=_eep its streets in a reasonably safe
cozuliticn. The law is that if the
action resulting in injury was done
in the exercise of a governmental
function, no liability attaches. I
am of the opinion that the operator
of the truck in question was engag-
ed in a duty of a public nature, for
which there is no liability.
I recommend that the claim be de-
nied. I am returning the claim here-
with.

Gentlemen:
The uuclersigned apPointecl to in-
vestigate the operations of one of
the plants of the Virginia-Carolina
Chemical Corporation visited this
company's Plant at Ft. Wayne, ll-
diana, Friday, July 7, 19.14. This
plant is located in a factory district
about 31,z miles from tl?e retail busi-
ness section. At the time of our visit
they were employing from 37 to 40
men, a large percentage of whom
were Mexicans. This plant operates
oll a ten-hour daily schedule, and
the rate of pay to laborers is 70
cents per hour, at peak time or dur-
ing the busy season, this plant oper-
ates with a man power of SO to 90
men. Very few homes are located
in this district.
We found the plan in operation
mixing chemical fertilizer composed
of pulverized phosphate rock, dolo-
mite, limestone, potash, and tobacco
stems, Liquid sulphuric acid is used
in the initial process of preparing
the phosphate rock, but at the time
of our visit this Phase of the proces-
sing was not iu operation. This
plant does not crush its rock but
the pulverized rock is shipped in in
carload lots.
No odor was noticeable outside of
the plant and in the plant proper.
The only odor that could he detect-
ed was that emanating from the
pulverized tobacco stems.
Soule rock dust was visible on the
outside near the cupola housing the
Special Session, ,July 20th, 194=1- 127
elevator which carried the various
ingredients into the mixing hopper.
Rock. dust was also visible on the
outside platform, this condition aris-
ing' tvheu cars of pulverized mater-
ials are being' unloaded and shovel-
ed from the cars into a chute and
onto a conveyor. It was evident that
this rock dust is heavy and is car-
ried only a short distance. No dust
was visible on the roofs of adjacent
building's. The company's office is
less than a block away from the
mixer plant, and no sign of dust or
odors were visible or detected by
us.
The plant manager had not been
notified of onr visit, and consequent-
ly normal operations were in pro-
gress.
ZVe were treated with the utmost
courtesy by the tnauager and
were told that the only tithe
any, obnoxious odors were ob-
served teas on such occasions when
something went wrong with the
machinery or other equipment when
the phosphate rock ryas being
treated with sulphuric acid, but
that such difficulties were immedi-
ately corrected.
We called at the office of the
City Health Department and the
statements of the plant manager
were verified. tiVe were informed
that over a considerable period of
years a fete complaints from resi-
dents in the immediate vicinity of
the Virginia-Carolina C h e m i c a l
plants had been registered. hn-
mediate personal investigation hacl
in every instance been made, in-
vestigators remaining in the vicin-
ity of the plant all day. By the time
the inspector reached the plant, the
difficulties had already been cor-
rected, and the operators apparent-
ly knew just what to do and did it
without being urged or compelled
to.
Briefly, we were unable to discov-
er any features that tvoulci justify
discrimination ag'aiust the operation
of this plant both as to being a
health menace or a public nuisance.
