Rhomberg. Mayor Moffatt stated
that this is the regular monthly
meeting of the City Council for
the purpose of acting upon such
business as may properly come
before the meeting.
Councilman Van Duehnan moved
that the rules be suspended for
the purpose of allowing any one
present in the Council Chamber,
who wishes to do so, to address
the Council. Seconded by Council-
man Wharton. Carried by the fol-
lowing vote:

dressed the Council protesting and
objecting to the nuisances created
from the operation of the Rock
Wool Plant in the vicinity of the
old Milwaukee Shops area and
stating that the gases emanating
from this plant together with the
particles of rock wool which the
wind carried onto their properties
not only makes their homes al-
most uninhabitable but also is in-
jurious to health and vegetation
and requested that this public
nuiiance be abated.
Mr. Fisher, representative of the
Rock Wool Plant, addressed the
Council and admitted that nothing
had been done to eliminate the
wool particles and gases from em-
anating from the plant and further
stated that the company had been
experimenting with several meth-
ods but had been unsuccessful but
that further methods would be
tried to eliminate the wool par-
ticles and gases emanating from
the plant. He further stated that
the National Gypsum Company is
now the owner of this Rock Wool
Plant.
Councilman Wharton moved that
City Solicitor Kintzinger be in-
structed to start court proceedings
in order to have the flying• wool
and gases emanating froth the
plant of the National Gypsum Com-
pany declared a public nuisance
and ordered abated. Seconded by

directing the immediate attention

vailing at the North end of Ellis
Street adjoining his premises, cor-
ner of Almond Street, and suggest-
!ng that the boulders on this pro-
perty, which are a menace to life,
property and public safety, be re-
moved at once and that a perma-
nent barrier be placed at the foot
of this incline to keep the juve-
niles off and prevent further exca-
vation, woodchopping, trespassing
and nuisance, presented and read.

Gentlemen:
On January 11, 1932 the City
Council resolved to convey Lot 1
of Mineral Lot 82 to J. J. Nagle by
quit claim deed and provided that
the Mayor and City Clerk execute
the instrument. It appears that the
deed was signed by the then act-
ing City Clerk and objection has
been made to the legality of the
conveyance.
In order to remove the title flaw,
I recommend the passage of the at-
tached resolution providing for a
correction quit-claim deed to the
present owner, the Mettel Realty
and Investment Co.

The City of Dubuque is the own-
er of the abandoned river bed in
the N. E. ?!~ of Section 36 of T89N,
R2E and in the N. ~V. Y/~ of Section
31 of TS9N, R3E of the 5th P. M. in
the southerly portion of the city. In
order to provide for proper drain-
age of the Southern Avenue dis-
trict and to prepare a site for the
post-war treatment of sewage, it
is necessary to acquire the adja-
cent property described as Lot 1
of Lot 1 of Mineral Lot 3S, Lot 2 of
Mineral Lot 50A, Lot 1 of Lot 16
and Lot 2 of Lot 16 of Linheim's
Addition .These parcels form an
area of approximately 17.0 acres of
which about S.6 acres are above wa-
ter level and 8.5 acres below water.
I recommend that the City Coun-
cil authorize the purchase of the
property as outlined above by ex-
ercising an option which has been
obtained for the sum of $10,000.00.

In re: Claim of Hubert Melssen
Honorable Mayor and
City Council,
City of Dubuque, Iotiva.
Gentlemen:
With reference to the claim of
Hubert Melssen that was submit-
ted to me for investigation and re-
port, Mr. Melssen tivas driving over
Hempstead Street between Lowell
and Kaufinann Streets at the time
the damages complained of were re-
ceived and for which a claim was
filed with the City on July 19, 1944.
He states that this street was
full of holes of all kind and charac-
ter. Prom what he says, there
were holes in this street that con-
stituted a dangerous condition to
or:e driving an automobile in the
street. He filed a claim for $12.00,
but upon investigation I fhid that
the damage can he replaced for
$10.95.
i recommend that a warrant be
issued payable to him for $10.95
and delivered to him upon delivery
by him to the City of a proper re-
lease.

professions licensed by this depart-
ment.
The Rule will he effective August
1, 1944, and in accordance with Sec-
tion 2209, Code of 1939, a copy of
same is herewith enclosed.

GENERAL RULE
Adopted by the Iowa State Depart-
ment of Health July 7, 1944.
(Effective August 1, 1944)
The Iowa State Department of
Health does hereby adopt the fol-
lowing rule, affecting the profes-
sions licensed by said Department
of Health,
If, prior to the renewal of any
license to practice any of the pro-
fessions licensed by the Department
of Health, the Ioava State Depart-
ment of Health is infornxed upon
o2,th or affirmation lawfully admin-
istered that any such applicant has
violated any of the rules and regu-
lations of the Iowa State Depart-
ment of Health or rules and regula-
lations of the Iowa State Board of
E:ianxiners for the concerned pro-
fession, including any of the laws
of Iowa governing said profession,
the department shall then notify
sttclx applicant by registered letter,
>vith postage prepaid, mailed to his
or her address as shown by the rec-
ords of said department, that such
information or certification has
come to the attention of the de-
partment, and that he or she will
be afforded a hearing to show cause
Zvhy said license should be renew-
ed. In such event the renetival of
license shall not be made prior to
tlxe hearing. The licensee will be
given ten (10) days notice of the
time and place of hearing, and a
brief statement of the charges. If
the licensee thus named fails to ap-
pear, either iu person or by counsel
at the time and place of hearing,
designated in the notice, the Com-
missioner of Public Health may, af-
ter receiving satisfactory evidence
of the truth of the charges, and the
proper issuance of the notice, enter
au order refusing renewal of li-
cense. If the licensee appears, eith-
er in person or by counsel, the Com-
missioner will proceed with the
hearing. The Commissioner will re-
ceive and consider affidavits and or-
al statements, and cause a steno-
graphic report of the oral testimony
to be taken, which, together with all
other papers pertaining thereto,
shall be preserved for one year, if
the Commissioner of Public Health
at the hearing is satisfied that the
licensee is guilty of any or all of
the charges referred to in the no-
tice, the Commissioner may refuse
to renew the license.

BUDGET PREPARED BY THE CITY MANAGER OF
THE CITY OF DUBUQUE, IOWA, FOR THE FISCAL
YEAR 1945-46,
Notice is hereby given that the City Manager of
the City of Dubuque has prepared a budget on the
basis of estimates of the expenses of the various de-
partments of said City for the fiscal year beginning
April 1, 1945 and ending March 31, 1916, Such depart-
mental estimates show expenses of each department
for the Preceding year, and the purpose for tvltich the
consolidated tax lev3', authorized by Section 6217 of
the Code of Iowa 1989, as amended, is to be used, and
in addition thereto, the purpose for which all other
tax levies are to be used, including the revenues from
miscellaneous sources. The levy of a consolidated tax
has heretofore been determined by said Council and
incorporated in a resolution for sttch purpose. The
budget 'will be considered for final adoption by the
City Council at a special meeting to be held in the
Council Chamber at the City Hall on the 10th day of
August, 1944, at 7:30 o'clock P. NI. any interested party
objecting thereto or protesting to the same, or to any
item thereof or any omission therefrom, shall present
his objections to said Council on or before that date.
This notice is given pursuant to the direction of
the Code of Iowa.

Wereas, a budget of proposed ex-
penditures for the fiscal year Be-
ginning April 1, 1945 and ending
March 31, 1946 has been duly pre-
pared by the City Manager, pub-
lished as required by law and sub-
mitted to this Council for approval,
and
Whereas, This Council has exam-
ined this budget, wherein estimates
of the expenses of the various de-
partments and purposes are shown,
including the estimates for which
the consolidated tax levy and all
other levies, receipts from moneys
and credits, and miscellaneous
sources are to be used and said
budget shows all of the proposed
expenditures for the ensuing fiscal
year ,and the same was published
as provided by law, and an oppor-
tunity was given all who might wish
to file objections or protest to the
same, and the time for action there-
on having been fixed as the 10th
clay of August, 1944 at 7:30 o'clock
P, M.; and
Whereas, No objections have been
filed or made to said Budget; Now,

Be It Resolved by the City Coun-

NIr. F. A. Manske of Buffalo, N. Y.,
Engineer for the National Gypsum
Company, aclclressed the Council
and outlined in detail the history of
the company -since it opened its
plant here aucl then went into some
-phases cf the difficulties experi-
enced by the plant in eliminating the
fluff from the rock wool out of the
air in the vicinity of the plant. He
stated that the company had rather
neglected the local situation as he
and other engineers were Busily en-
gaged in `var work elsewhere. He
admitted that the efforts of the lo-
cal plant to eliminate what has Been
described as a nuisance had failed.
He further stated that something
entirely nets was Being undertaken
now and that the plant had been
shut down in order to permit the
installation of this machinery to
rid the community of the flying fluff.
He stated that this type of machin-
ery has Been successfully used in
one of their eastern plants. He
declared that the company would
fight court action to the end. Also,

the Council in support of the plant's
position.

Meeting called by order of Coun-
cilman Van Duelman and Murphy.
Mayor Moffatt read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of discussing
the National Gypsum Company
Rock Wool plant matter and acting
on any other business as may pro-
perly come before a regular meet-
ing of the City Council.
The informal session was turned
over by Mayor W. W. Moffatt to
City Solicitor John J. Kintzinger,
and after a lengthy discussion of the
rock wool matter Councilman Whar-
ton moved that the Taxpayers Com-
mittee of three meet with the City
Manager, City Solicitor and Mr. E.
E. Frock of Buffalo, N. Y., General
Counsel for the National Gypsum
Company, on Sunday, August 20th,
1944, to discuss and if possible pre-
pare and execute an agreement and
stipulation which will adjust the al-
leged rock wool nuisance and in
the event that such agreement and
stipulation is mutually arrived at
and executed by the Taxpayers
Committee above referred to, the
City Manager, the City Solicitor and

then and in that event the City So-
licitor shall by this motion be au-
thorized to request the Court to pass
the trial of the case until such time
that it may become necessary to
again bring the matter to the at-

I reconuuencl that the City Coun-
cil direct the City Clerk to adver-
tise for bids for a new contract in-
cluding the following provisions:
1. Duration of contract to be five
years, reserving to the City the
right to cancel the contract at any
time after three years have elapsed.
2. Payments by the City to be
treacle twice each month, each pay-
ment to be 1-24 of the annual con-
tract price.
3. Collections of garbage and de-
cayed matter to be made as at pres-
ent in ttvo districts as follows:
District No. 1.-This district in-
cludes all the territory circum-
scribed by tiVest 17th Street on the
North, Jones Street on the South,
Bluff Street on the West, and Ceu-
teal Avenue on the East, both sides

of these streets included. In this
district, colections shall be made
three times a week from June 1st
to November 1st and twice a week

week at other times.
4. The contractor to be required,
at his bid price, to collect all gar-
bage and decayed matter and to re-
move dead animals daily, Sundays
and holidays included, within en-
tire limits of the City and to dis-
pose of the same in a proper
manner.
5. Non-leakable and covered ve-
hicles to be required for all collec-
tions.
6. The successful bidder to fur-
nish the City a surety bond at his
e~Pense in the sum of $5,000.00 con-
ditioned upon the faithful perform-
ance, for the five-year period, of all
conditions of the contract and in
order to protect the City against all
damages; this surety bond to be
made a part of the contract.
7. Bids be advertised and re-
ceived up to Monday, September 25,
1944, at 11:00 A. M., and referred
to the City Council at 7:30 P. M. ou
the same day.
