Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Staff reviewed the location of the subject parcel, that IDOT is in the process of disposing of
excess right-of-way and the parcel is of sufficient size to construct asingle-family home.
Staff noted the need to waive the lot area requirement. Staff further noted that Lot A will
accommodate a future hammerhead at the end of McEvoy Street, providing the required
street access.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the waiving of lot area
is appropriate given the location and access.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the lot area requirement for Lot E allowing 3,858
square feet, where 5,000 square feet is required.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 350-09
RESOLUTION APPROVING A PLAT OF SURVEY BONBON AND STEWART'S
SUBDIVISION LOT E IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk Bonson and Stewart's Subdivision Lot
"E" in the City of Dubuque, Iowa; and
Whereas, said subdivision provides Lot "E" with 3,858 square feet of lot area, where
5,000 square feet of lot area is required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, the subdivision has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said subdivision has been examined by the City Council and they find that it
conforms to the statues and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot "E" to have 3,858 square feet of lot area, where 5,000 square feet of lot area are required.
Section 2. That the Bonson and Stewart's Subdivision Lot "E" is hereby approved
and the Mayor and City clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said final plat.

INTRODUCTION
The submitted plat of Bonson and Stewart Subdivision Lot E subdivides existing Iowa
Department of Transportation excess right-of--way to facilitate the sale of the property.
The subject parcel is located at the north end of McEvoy Street, east of the existing
right-of-way.
DISCUSSION
The submitted plat of Bonson and Stewart Subdivision Lot E facilitates the sale of Iowa
Department of Transportation excess right-of-way. The subject parcel is located at the
north end of McEvoy Street and is 3,858 square foot in size and has 50-foot of frontage.
While the proposed Lot E does not have sufficient lot area to meet the City's Zoning
Ordinance requirements for an R-1 single-family lot, Planning staff feels the lot can be
built on with asingle-family residence. The lot area is actually larger than some of the
homes on the north end of Dubuque.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission recommend approval
of the Bonson and Stewart Subdivision Lot E subject to waiving the lot area requirement
for Lot E allowing 3,858 square foot, where 5,000 square foot is required.
