Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant was not in attendance.
Staff reviewed the surrounding zoning and land use.
There were several public comments in opposition to the request noting the proposed
rezoning is inconsistent with the surrounding zoning.
The Zoning Advisory Commission discussed the request, noting that this item was tabled
last month because the applicant failed to attend the meeting. The Commission felt that a
single lot zoned R-2 surrounded by R-1 zoned lots is inconsistent.
Recommendation
By a vote of 4 to 0, with one abstention, the Zoning Advisory Commission recommends that
the City Council deny the request.
A simple majority vote is needed for the City Council concurs with the denial.
A super-majority vote is necessary for the City Council to approve the request.

Properly History: The property was platted in the late 1800s as part of the Finley
Waples and Burton's Addition. The subject single-family home was built at this location
circa 1900.
Physical Characteristics: The property is an approximately 8,600 square foot corner lot
located at the intersection of Pearl and Gilliam Streets. The lot has 60 feet of frontage
along Pearl Street and 146 feet of frontage on Gilliam Street. The property slopes from
its high point on Pearl Street to the rear yard.
Concurrence with Comprehensive Plan: The Comprehensive Plan recommends
providing a range of housing options in mixed neighborhoods and also recommends
that incompatible uses be buffered from each other.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: There are no traffic/pattern counts available for this
street, although the addition of one residential unit would not significantly impact
traffic patterns or volume.

Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.
Adjacent Properties: The addition of one unit (replacing asingle-family home with
a duplex) on an 8,600 square foot lot should have limited impact on the adjacent
residential properties.
CIP Investments: None proposed.
StafF Analysis: The applicant is proposing to rezone an approximately 8,600 square
foot corner lot located at the intersection of Pearl and Gilliam Streets from R-1 Single-
Family Residential District to R-2 Two Family Residential District. Currently, there is a
small two-story home located on the lot that the applicant intends to demolish and
replace with a duplex.
This neighborhood is characterized primarily by one and two story frame single-family
residences built on standard lots. The addition of a duplex in this neighborhood should
have limited impact on density and demand for parking, and generate little additional
traffic, noise and activity.
Staff recommends that the Zoning Advisory Commission review the criteria established
in Zoning Ordinance Section 6-1.1 regarding reclassification of property.

ORDINANCE NO. 09
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 2494 PEARL STREET FROM R-1 SINGLE-
FAMILY DISTRICT TO R-2 TWO-FAMILY DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from R-1 Single-Family Residential District to R-2 Two-Family Residential
District.
Lot 100 Finley Waples & Burton's Addition, and to the centerline of the
adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

a Single family Residential neighborhood forever. People take pride in their
properties, and want to be able to sell if they desire. They want a safe place
to raise their children.Property value is very important to the neighbors.
This change in zoning could also cause the other bigger older homes in this
neighborhood that, could very easily be turned into duplexes to do so. And
then the value of the other Single Family homes would drop to the bottom.
Also traffic is very heavy on Gilliam Street and the R2 zoning would add to
this problem. Parking would add another problem. The lot really isn't big
enough to put a 2 family dwelling with two garages. If this was done there
would not be enough green space for this type of a neighborhood.. It could
also obstruct the view for drivers coming down Pearl Street and turning on
to Gilliam Street. There have been several Accidents there in the winter as
the water run off freezes in that spot. A nice single family home with a
garage could be built there.
