Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer --~ DATE: September 25, 2009 SUBJECT: North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase III CI Ps 7101802, 7102178, 7201662, 7201807, 7201911, & 7202018 INTRODUCTION The enclosed resolutions authorize the public bidding procedure for the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase III (final phase). BACKGROUND In December of 2001, the City Council formally adopted the Drainage Basin Master Plan (DBMP) prepared by HDR Engineering (Omaha, Nebraska). The DBMP outlined a series of improvements in the North Fork Catfish Creek watershed to address roadway overtopping and flood damage along the North Fork Catfish Creek between the Pennsylvania Avenue/John F. Kennedy Road intersection and the Northwest Arterial. With the adoption of the FY2008-FY2012 Five-Year Capital Improvement Program Budget, $1,659,364 was established for the North Fork Catfish Creek Stormwater improvements outlined in the DBMP. In March of 2004, the City funded an evaluation of the sanitary sewer collection system referred to as the "Key Way sanitary sewer." Based on the recommendations of the study prepared by Veenstra & Kimm, Inc., the City Council established $1,904,250 to upsize the Catfish Creek interceptor sewer line from the University Avenue Extension at US20 to the Northwest Arterial. The project consists of replacing the existing 12-inch diameter clay sewer with a 24-inch diameter ductile iron sewer from University Avenue to Key Way and replacing it with an 18-inch diameter ductile iron sewer from Key Way to the Northwest Arterial. In November of 2006, the City Council authorized the City Manager to submit an application for, and subsequently approved the use of, State Revolving Loan funds for the project. In December of 2006 the State approved the City's application, placing the project on the Iowa Finance Authority State Revolving Fund (SRF) Loan Program Intended Use Plan. In October of 2007, the City Council passed Resolution 506-07 authorizing submission of an application for $1,904,250 in HMGP funds for the sanitary sewer portion of the North Fork Catfish Creek Sanitary and Stormwater Drainage Improvements Project. The grant requires fifteen percent (15%) local matching funds. In November of 2007, the City Council authorized the hiring of IIW Engineers & Surveyors, PC (IIW) to design the channel, culvert, and sanitary sewer improvements associated with the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project. In February of 2009, the City submitted an application for stimulus funding for the project through the State Revolving Loan Fund Program. In April of 2009, the Iowa Department of Natural Resources notified the City that the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project was included on the proposed Intended Use Plan to receive federal stimulus funding in the form of a forgivable loan equal to 20% of the amount borrowed for the $3.5 million project. In April of 2009, the State of Iowa Homeland Security and Emergency Management Division (IHSEM) presented City staff with a Project Grant Agreement awarding $1,914,250 for the sanitary sewer improvements associated with the project. In June of 2009, the contract for Phase I was awarded to Anstoetter Construction. Phase I involves the replacement of 3,970 feet of 12-inch diameter clay sewer with 24- inch diameter ductile iron sewer along the North Fork Catfish Creek from the University Avenue Extension to just north of Kensington. In July of 2009, the contract for Phase II was awarded to Portzen Construction. Phase II involves the replacement of 1,595 feet of 12-inch diameter clay sanitary sewer with 24- inch diameter ductile iron sewer from Kensington Place, through the Pennsylvania/John F. Kennedy intersection, north to Keystone Drive. DISCUSSION Phase III of the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project involves the replacement of just over 4,700 feet of 12-inch diameter clay sanitary sewer from Keystone Drive to the Northwest Arterial (IA32) with 600 feet of 24-inch diameter and 4,130 feet of 18-inch diameter ductile iron sanitary sewer. Phase III also includes the stormwater management improvements outlined in the Drainage Basin Master Plan: replacement of the Key Way culverts (CIP 7201662), an additional culvert at Rosemont Street (CIP 7201911) and creek improvements to improve flow and stabilize the creek banks from Key Way to the Northwest Arterial (CIP 7201807 &CIP 7202018). BUDGET IMPACT The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project - Phase III involves the reconstruction of just over 4,700 feet of 12-inch diameter clay sanitary sewer from Keystone Drive to the Northwest Arterial (IA32). This work is eligible for the FEMA Hazard Mitigation Grant Program funds. Per the award agreement, 85% of the construction and engineering services costs associated with the project are eligible for the grant funding. Project expenses prior to April 16, 2009, such as the design engineering, are ineligible. Moreover, construction contingencies are ineligible. Finally, due to the bids, the FEMA grant will not cover the entire cost of installing the sanitary sewer. Therefore, there is a portion of the project expenses that the City must fund even though these expenses are FEMA-eligible expenses. Essentially, the FEMA funds allocated for the project fall short of the actual project costs. The approximate federal, state, and City share of the project cost is $199,073.25, $26,543.10, and $1,669,255.15 respectively as outlined in Table 1. The City intends to borrow the $1,669,255.15 through the SRF program and be eligible for approximately $279,008.03 of the loan to be forgivable through the ARRA stimulus package. This is also reflected in Table 1. The City's total project cost for Phase III is estimated to be $1,390,247.12. Table 1.
