The council of the city shall pro,4de for the man- nor in which the re~lations and resw/ctinns and the boundaries of the distrlc:s shall be determined, tablished, and enforced, and from time to time amended, supplemented, or changed. However, the regulation, restriction, or boundary shall not become efi'ective unsil after a public hearing at which par~ias in interest and citizens shall have an opportunity to be heard. The regulations, restrictions, and bounder/es may, from time to time, be amended, supplemented, changed, modified, or repealed. Notwithstanding section 414.2, as a par~ of an ordinance changing land from one zoning district to another zoning dis- trict or an ordinance approving a site development plan, a council may impose conditions on a proper~z owner which are in addition to exlating regulations if the additional conditions have been agreed to in writing by the property owner before the public hear- lng required under this section or any adjournment of the hearing. The conditions must be reasonable and imposed to satisfy public needs which are direct- ly caused by the requested change. In case, however, of a wtit~ten protest against a change or repeal which is filed with the city clerk and signed by :he owners of twenty percent or more of the area of the lots in- cluded in the proposed change or repeal, or by the o~rners of twenty percent or more of the property which is located within two hundred feet of the exts- riot boundaries of the property for which the change or repeal is proposed, the change or repeal shall not become effective except by the favorable vote of at least thrse- fourths of all the members of the council. The protest, if filed, must be filed before or at the public hearing. The provisions of section 414.4 rela- tive to public hearings and official notice apply equally to all changes or amendments. In order to avail itself of the powers conferred by this chapter, the council shall appoint a commission, to be known as the zoning commission, to recom- mend the boundaries of the various original dhtricts, and appropriate re~utarians and restrictions to be enforced therein. The council shall provide for the appointment of a board of adjustment and in the regulations ~nd re- strictions adopted pursuant to the authority of this chapter shall provide that the said hoard of adjust- ment may in appropriate cases and subject to appro- priate conditions and safeguards make special ex- ceptions to the terms of the ordinances in harmony with its general purpose and intent and in accor- dance with general or specific rules therein con- rained and provide that any property owner grieved by the action of the council in the adoption of such regnlations and restrictions may petition the said board of adjustment direct to modify regula- tions and restrictions as applied to such proper~y The council may provide for its review of vari- ances granted by the board of adjustment before their elective date. The council may remand a deci- sion to grant s variance to the hoard of adjustment for further study. The effective date of the variance is delayed for thirty days from the date of the re- mand. The board shall adopt tales in accordance with the pro~sions of any ordinance adopted pursuant to this chapter. Such appeal shall be taken within a reasonable time as provided by the rules of the board by filing with the officer from whom the appeal/s taken and with the board of adjustment a notice of appeal specifying the grounds thereof. The officer from whom the ap- peal is taken shall forthwith transmit to the board all the papers constituting the record upon which the action appealed from was taken. In such case proceedings shall not be stayed other- wise than by a cestr~i~g order which may be 3280 granted by the board of adjustment or by a court of record on application on notice to the officer from whom the appeal is taken and on due cause shown. To hear and decide appeals where it is al- leged there is error in any order, requirement, deci- sion, or determination made by an administrative official in the enforcement of this chapter or of any ordinance adopted pursuant thereto. 2. To hear and decide spec/al exceptions to the terms of the ordinance upon which such board is required to pass u~der such ordinance. ' 3.
