Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Staff reviewed the proposed lot configuration and noted that the State rules require the
IDOT to offer excess right-of-way back to the original property owner. The subject
parcel cannot be combined with adjacent property for this reason.
The Zoning Advisory Commission discussed the request, and had no objections to the
submitted plat.
Recommendation
By a vote of 7 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot area and lot frontage requirements.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Bonson and Stewart Subdivision Lot H
INTRODUCTION
The submitted plat of Bonson and Stewart Subdivision Lot H facilitates the sale of
excess right-of-way by the Iowa Department of Transportation (IDOT). The subject
parcel is located along Curtis Street near the Bryant Street overpass of U.S. Highway
20.
DISCUSSION
The submitted Bonson and Stewart Subdivision Lot H subdivides a 1,870 square foot
parcel with 34.93 feet of frontage for future sale as excess right-of-way by the Iowa
Department of Transportation. The submitted Lot H is substandard in terms of both lot
area and lot frontage. An aerial photo is attached that shows the approximate location
of the subject parcel.
The subject parcel must be offered back to the original property as part of the process
for IDOT to sell excess right-of-way. The subject parcel cannot be combined with
adjacent property to create a larger buildable lot as the adjacent property was owned by
a separate property owner.
The Zoning Advisory Commission has the option to either waive the lot area and lot
frontage and allow the lot to exist with no restrictions, or approve the plat subject to the
lot being designated as non-buildable. A third option is to approve the submitted plat of
survey subject to combining the subject parcel with adjacent property. In the future then
anyone purchasing the subject parcel will have to combine it with the adjacent property.
If the Zoning Advisory Commission labels the lot as non-buildable, then any future
property would have to come back to the Zoning Advisory Commission and City Council
to remove the designation from the platted lot.

Planning staff recommends that the Zoning Advisory Commission approve the
submitted Bonson and Steward Subdivision Lot H waiving lot area and lot frontage
requirements for Lot H.

RESOLUTION NO. 407 - 09
RESOLUTION APPROVING BONBON AND STEWART'S SUBDIVISION LOT "H" IN
THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk Bonson and Stewart's Subdivision Lot
"H" in the City of Dubuque, lowa;.and
Whereas, said Plat of Survey provides 34.93 feet of lot frontage for Lot "H" and 1,870
square feet of lot area, where 50 feet of lot frontage and 5,000 square feet of lot area are
required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, the subdivision has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said subdivision has been examined by the City Council and they find that it
conforms to the statues and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot "H" to have 34.93 feet of lot frontage and 1,870. square feet of lot area, where 50 feet of lot
frontage and 5,000 square feet of lot area are required.
Section 2. That the Bonson and Stewart's Subdivision Lot "H" is hereby approved
and the Mayor and City clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said final plat.
Passed, approved and adopted this 19 t h day of O c t o b e r 2009.
