Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion Marty McNamer, 1749 Creek Wood Drive, reviewed his request noting the existing zoning and surrounding land use. He said he intends to build asingle-family home at this location. Staff Member Hemenway reviewed the request noting the aerial photo provided in the packet. He discussed the size and topography of the parcel and noted that a large portion of the parcel is located in the flood plain. He reviewed the existing AG zoning, noting that it generally serves as a holding zone for future development, and recent zoning changes in the area. There were no public comments. Commissioners discussed the request and felt it was appropriate. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The subject property was part of a farm until recently and now serves as a single-family home. Physical Characteristics: The property is approximately 7 acres in area with 600 feet of frontage along Catfish Creek on the property's northeast side and 500 feet of frontage along Manson Road. The property slopes from its high point on the south side of the lot, where the residence is located, down to the creek with approximately 45 feet of grade change. Approximately two-thirds of the northern portion of the lot is located in the flood plain. The property is accessed by a driveway that enters from the adjacent lot to the west. Concurrence with Comprehensive Plan: The Comprehensive Plan calls for this area to be a mix of low-density residential, open space and flood plain. The Comprehensive Plan encourages infill development to promote more efficient use of land and provision of services. Impact of Request on: Utilities: Existing utilities are adequate to serve the site. Sanitary sewer is available on the property and water is available along Manson Road in front of the property. Rezoning Staff Report -1800 Manson Road Page 2 Traffic Patterns/Counts: There are no traffic counts available for this location; however, because of the layout of the property and its flood plain status, it would be difficult to construct more than one or two single-family homes here. Therefore, the rezoning should have very little impact on the overall traffic in this neighborhood. Public Services: The existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control and storm water control is provided during all phases of development and that development in the flood plain is limited. Adjacent Properties: Because the proposal is for single-family zoning at this location, it should have very limited impact on the adjacent residential, vacant, and agricultural property. CIP Investments: None proposed. Staff Analysis: The applicant is proposing to rezone an approximately 7 acre parcel of property at the intersection of Manson Road and Creek Wood Drive from AG Agricultural District to R-1 Single-Family Residential District. Currently, there is a former farmstead at the property's southwest corner that is accessed by a driveway located on an adjacent parcel. About two-thirds of the north portion of the property is located in the flood plain and the property slopes from its high point on the south end where the farmstead is, to the creek, dropping approximately 45 feet. The property is no longer an active farm. AG zoning is generally deemed a holding zone within the corporate limits of the City until redeveloped for other purposes. The applicant has expressed interest in either maintaining the existing farmstead and subdividing the property to add one additional single-family residence, or demolishing the farmstead and creating asingle-family residence. The property has adequate access to Manson Road and can be served by utilities. Staff recommends that the Zoning Advisory Commission review the criteria established in Section 6-1.1 regarding reclassification of property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by reclassifying the hereinafter-described property from AG Agricultural District to R-1 Single-Family Residential District. Balance of Lot 1 of 1 of 4 Mineral Lot 501, and to the centerline of the adjoining public right-of-way, all in the City of Dubuque, Iowa. Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3.
