the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may pro-
perly come before the meeting.

that the rules be suspended for the
purpose of allowing any one pres-
ent in the Council Chamber, `vho
wishes to do so, to address the
Council. Seconded by Councilman

requesting retention of the present
bus service on Dodge Street front
Bryant Street to Booth Street, and
on Booth Street from Dodge Street
to South Grandview Avenue, pre-
sented and read. Mrs. Loretta Pow-
ers, Mrs. Margaret Kinsella and
Miss Kathryn Murphy addressed
the Council requesting that the
present bus service on Dodge Street
from,Bryant Street to Booth Street,
and on Booth Street from Dodge
Street to South Grandview Avenue,
be not changed. Mr. C. E. Dove,
Manager of Interstate Power Com-
pany, addressed the Council rela-
tive to the request of the Interstate
Power Company for changes in var-
ious bus routes and stating that the
Company did not wish to curtail
any of its bus service, but that war
conditions made it necessary that
mileage be reduced as much as
possible.

that the Petition of John C. Kaiser
et al. requesting retention of the
present bus service on Dodge Street
from Bryant Street to Booth Street,
and on Booth Street from Dodge
Street to South Grandview Avenue,
he received and placed on file. Sec-

Gentlemen: At the session of the
City Council held July 23, 1943, the
petition of the City of Dubuque
Bridge Commission requesting the
Council to establish uo parking
areas iu the vicinity of the new
bridge approach at Dodge and Lo-
cust Streets was referred to the
Council to view the ground.
The Council viewed the site on
August 1st and decided to grant the
request by ordering official no park-
ing signs erected on both sides of
Dodge Street from Bluff Street to
Locust Street, and on both sides of
Locust Street and South Locust
Street, for a distance of 100 feet
both north and south from the cen-
ter of the intersection of Dodge and
Locust Streets.
I recommend that the decision of
the Council be confirmed.

RESOLUTION AND APPLICA-
TION FOR PERMANENT
TRANSFER OF FUNDS.
Whereas, An emergency tax levy
was made by the City Council of
the City of Dubuque for use in sup-
plementing the funds required for
debt service during the fiscal year
beginning April 1, 1943, and ending
March 31, 1944, upon authority and
approval of the State Comptroller;
and
Whereas, As of the 31st day of
July, 1943, there was a deficit in
the Improvement Fund of $5,182.69;
and
Whereas, There is now in the
hands of the City Treasurer and
credited to the Emergency Fund
the sum of $13,981.34,. which is avail-
able for transfer to the Improve-
ment Fund for debt service; and
Whereas, On July 15, 1943, Im-
provement Bonds in the amount of
$10,000.00 matured and hnprove-
ment Bond interest in the amount
of $956.25 became due and payable;
and
Whereas, In order to provide for
the payment of the obligations due,
it is necessary to make a transfer
of $10,956.25 from the Emergency
Fund to the Improvement Fund;
and
Whereas, Before any transfer can
be made from the Emergency Fund
to any other fund, an application
must be made to the State Comp-
troller for authority to make the
transfer and his approval secured
thereon; Now Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that, sub-
ject to the approval of the State
Comptroller, there be and there is
hereby transferred from the Etner-
ency Fund to the Improvement
Fund the sum of $10,956.25 and
the State Comptroller is hereby pe•
titioned to authorize and approve
such transfer.
Be It Further Resolved, That
upon the approval of such transfer
the Auditor of the City of Dubuque
is directed to adjust his books ac-
cordingly and to notify the treasur-
er of the transfer and the notifica-
ticn shall be accompanied by a copy
of this resolution and the record of
its adoption.

April 1, 1944, and enditag March 31,
1945, anct the hearing upon said
Budget Estimate was fisecl for the
Gth clap of August, 1943, at 7:30 P.
M., at the Council Chamber in the
City Hall; and
Whereas, This being the time and
place set for said hearing, said Bud-
get Estimate vas taken up for final
consideration by the Council and all
parties in interest have been given
the opportunity to be heard for or
against said Budget Estimate.
It is Therefore Resolved by the
City Council of the City of Dtt-
buque, Iowa:
That the Budget Estimate of Ex-
penditures for the fiscal year be-
ginning April 1, 1944, and ending
March 31, 1945, heretofore prepared
and published, be and the same is
hereby finally approved and adopt-
ed and the -Zayor and Clerk are di-
rected to certify the same to the
County Auditor of Dubuque County,
Iowa, together with the verified
proof of publication and the notice
of hearing upon said Budget
Estimate.

Be It Resolved by the City Coun-
cil of the City of Dubuque that,
subject to the approval of the State
Comptroller, there be and there is
hereby transferred from the Emerg-
ency Fund to the Improvement
Fund the sum of $10,956.25 and the
State Comptroller is hereby peti-
tioned to authorize and approve
such transfer.
Be It Further Resolved, That,
upon the approval of such transfer,
the Auditor of the City of Dubuque
is directed to adjust his books ac-
cordingly and to notify the Treas-
tu•er of the transfer, and the noti-
fication shall be accompanied by a
copy of this resolution and the rec-
ord of its adoption.
The resolution was passed,
adopted and approved by unani-
mous action of the City Council on
the 2nd day of August, 1943, and
all members thereof signed their
names thereto.

days after service of the notice.
Such notice was served by the
Sheriff of Dubuque County on April
30, 1943.
The ninety days have elapsed and
to date the poles and lines have not
been changed. Therefore, I recom-
mend that court action be taken to
accomplish the removal of the poles
and lines.

Gentlemen: On December 24,
1934, the Dubuque Boys' Club, Inc.,
by warranty deed cosiveyed to the
City of Dubuque Lot No. two hun-
dred nine (209) in the Tocvu (now
city) of Dubuque, accorcliug to the
United States Commissioner's map
of the survey of the town o£ Du-
buque, Iowa, subject to certain con-
ditions and provisions. No payment
nor valuable consideration was in-
volved in the transaction. Title to
the property was warranted except
as to taxes and special assessments.
By Resolution No. 1-35, the City
Council accepted the deed ou Jan-
uary 7, 1935.
The Boys' Club is performing a
eery good work in the community.
However, the continuation of the
title to the premises iu the City is
a mere fiction of ownership which
serves no governmental purpose
nor does it assist the Boys' Club.
'Phe reconveyance of the property
back to the grantor teas contem-
plated in the deed. For the above
reasons, I recommend that the City
Council deed the property back to
the Dubuque Boys' Club, hit.

schools, the congregating of chil-
dren of sixteen years of age and
under in the public places, church-
es. Sunday schools, places of amuse-
ments, picnics and public gather-
ings of all kinds and the proper
authorities are hereby directed to
enforce this order and that regu-
larly authorised day nurseries un-
cler health supervision and approv-
ed by the Health Director may con-
