Mayor Wharton stated that this is the regular monthly meeting of the City Council for the purpose of acting upon such business as may properly come before the meeting. Notice of Claim of H. Mitchell in the amount of $55.00 for damages to his car, which was parked on East 17th Street, caused by the failure of the City drainage to take care of the flood waters, presented and read. Councilman Vau Duelman moved that the Claim be referred to the City Solicitor for investigation and report. Seconded by Councilman Murphy. Petition of Gust Billis requesting a refund on his beer license which expires September 1st, 1942, as he has sold his Place of business, pre- sented and read. Councilman Van Duelman moved that the request be granted and that the City Auditor be instructed to draw a warrant in the amount of X50.00 in favor of Gust Billis to co- ver the amount of refuucl granted on the unexpired portion of his beer license, said license expiring September 1st, 1942. Lee addressed the Council stating that this menace as complained of has been existing for t~veuty years and clemaudiug that this condition be taken care of im- mediately. Councilman Murphy moved that the communication be referred to the City Manager with instructions to make a thorough investigation of the complaints and to submit a re- port back to the City Council at their next meeting. Communication of the Iowa Chil- dren's Rome Society requesting the City Council to kindly defer giving the Volunteers of America permis- sion to sell their "red heart tags" until after the Iotiva Society has had an opportunity to present its local work to the citizens of Dubuque, preseutecl and read. Mr. William Leik et al., residents and property owners in the vicinity of I~niest and Elm Streets, address- ed the Council complaining' of the odors and gases coming front the Bee Branch Storm Sewer in the vi- cinity of Kniest and Elm Streets and requesting that something be cloate iuunediately to eliminate the odors and gases as complained of and coming from this sewer. Councilman Thompson move d that the City Manager be instruct- ed to confer with the officials of the Dubuque Packing Company for the purpose of arriving at some imme- diate method for the elimination of the odors and gases coming from the Bee Branch Storm Server as complained of by the persons living in the vicinity of I~niest and Elm Streets and to submit a report back to the City Cauncil. Iierper, Secretary of the Chamber of Conuuerce, for the pur- pose of discussing ways and means of obtaining year work for Du- buque's industrial plants and their workers and for the possibility of securing neyv year industries, and as a result of these meetings that he felt there should be held a general meeting of all concerned, and after a discussion with the Council menr hers and those present it was cle- cicled to hold an informal meeting on Wednesday evening, May 6tla, 1942, at 7:30 P. An Ordin- ance amending and changing the Zoning Map of the City of Dubuque as proviclecl by Ordinance No. 3-34 designated "Zoning Ordinance of the City of Dubuque" so as to change to "Two Family Residence District" certain defined territory now delimited as "Single Family Residence District." said ordinance having been passed upon first and second readings on April 21st, 1942, and ordered placed on file with the City Clerk for public inspection for at least one week before its final adoption, presented and read a third time. Gentlemen: At the session of the City Council held March 31st, the petition of A. G. Reuschel et al., re- questing the installation of a street light near 1900 Hale Street, was re- ferred to the Council to view the gx•ouuds. The Council viewed the site on May 1st and decided to install an aclclitional light on Hale Street, and to adjust the present spacing of the existing street lights on the street. In re: Claim of Leanore Schroeder Honorable Mayor and City Council City of Dubuque, Iowa. Gentlemen: I have investigates this matter, anct have been to the glace of the accident and saw the defective conditions and am of the opinion that there is a liability ox the part of the City, but that the langerous condition was contrib- tted to by the property owners. After consultation with the repre- ~entatives of the property owner, :hey have agreed to pay one-half of ,his claim and I recommend that a warrant be issued to Leanore Schroeder for $8.60, one-half of the amount she claims of the City, and that the same be delivered to her upon execution and delivery of a proper release. I have iuvestigatecl the same anti find that she fell at 13th and Main Streets on the cross walk near the west curb line of NIaiu Street on January 14, 1942, sustaining serious and perma- nent injuries, suffering a fi•acture anti dislocation of the bone in her right arm anti wrist. That at this time her wrist seems to be perman- ently crippled. She claims that she is not able to use her right baud because of this injury. She further claims that she has sustained actual damages in the sum of $255.25 - a doctor's bill of $55.00, hospital bill of $25.75, loss of wages $131.50 and $73.00 for help and care. After consultation with her and her attorney, she has agx•eed to ac- cept $250.00 in full settlement of her claim. I recommeuct that the claim be settled for $250.00 and that a war- rant be issued payable to her order for that amount and the same be delivered to her upon delivery to the City of a release.
