Mrs. Haupert et al., property
owners and residents in the vicin-
ity of the Rock Woal Plant, address-

action be taken to abate the nuis-
ance caused by the odors and dirt
coming from the Rock Wool Plant
and also to eliminate the odors from
the Dubuque Packing Company
plant.
Mayor Wharton entered the Coun-
cil Chamber at 8:15 P. M. and took
the Mayor's chair.
Certificate of Dubuque Park
Board Tax Levy in the amount of
$25,464.53 as the amount needed for
Park Board purposes for the fiscal
year beginning April 1, 1943, and
ending March 31, 1944, presented
and read.

Resolution and application for
authority to levy an emergency tax
for the City of Dubuque.
Whereas, the City Council of the
City of Dubuque has made a com-
pilation of the expenses which will
be incurred during the fiscal year
beginning April 1, 194,- and ending
Dlarch, 31, 194? including the pay-
ment of principal and interest up-
on outstanding indebtedness, and
tas levies for the various funds and
purposes have been determined, and
Whereas, a serious effort has been
made to keep operating costs as low
as is consistent with good govern-
ment; and
Whereas, In the past bonds have
been issued in anticipation of some
of the taxes embraced in the con-
solidated tax levy and the revenues
derived from such taxes are pledged
to the payment of such bonds, as to
principal and interest; and
~Phereas Payments of $65,000.00 ~ - .

tei•est are to be oracle during the
fiscal year beginning April 1, 194~J"'
and ending Mai•ch 31, 1944, from the
funds embraced in the consolidated
tax levy; and
Whereas, The inadequacy of the
revenues for ordinary purposes re-
maining after the payment of such
principal and interest constitutes an
emergency which requires the levy
of an emergency tax and this Coun-
cil considers the levy of an emerg-
ency tax of five-eighths (5/s) mill to
be absolutely necessary; Now,
Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque, that the
State Comptroller be and he is here-
by requested to authorize and ap-
prove the levy of an emergency tax
of five-eighths mill in the year 194
to be approximately $22,215.00, the
same to be used in supp'emeuting
the funds required for debt service
and in the manner provided by law.
The foregoing resolution was
adopted at a special meeting of the
City Council of the City of Dubuque
on the 30TH day of JUNE, 1942.

Lots 2, 3, 4, and Lot 1 of 5, of the
Subdivision of Mineral Lot 307A, in
the City of Dubuque, Dubuque
County, Iowa, for the pavement of

Gentlemen: With reference to
the report of the Board of Review
referred to the undersigned for in-
vestigation and report, I wish to
call the attention of the Council to
Chapter 343 of the 1939 Code of
Iowa and the following parts there-
of which covers the actions of the
Board of Review.
"7129 Local Board of Review ... .
The Board shall meet on the first
iVTonday of April, at the office of
the township, oily or town clerk
or recorder, and sit from day to
day until its duties are completed,
which shall be not later than the
first day of May, and shall adjust
assessments for the township,
city or town by raising or lower-
ing the assessment of any person,
partnership, corporation, or asso-
ciation as to any or all of the
items of his assessment in such
manner as to secure the assess-
ment of property at its taxable
value, attd shall also add to the
assessment rolls any taxable
property not included therein, as-
sessing the same in the name of
the owner thereof, as the assess-
or should have done;
7129.1 Revaluation and Reassess-
ment of Real Estate ...The deci-
sion of the local Board as to the
foregoing matters shall be sub-
ject to appeal to the district court
within the same time and in the
same manner as provided in sec-
tion 7133.
7130 Clerk -Assessment Corec-
tion. The clerk or recorder of the
township, city or town, as the
case may be, shall be clerk of the
board of review and keep a rec-
ord of its proceedings, and the
assessor shall be present at its
meeting and make upon the as-
sessment rolls all corrections or
additions directed by the Board.
At such meetings it shall be the
duty of the assessor to read each
and every taxpayer's name and
assessment on the assessment
rolls, and, if the assessment is
approved, pass to the next name.
After checking the same, the
Board shall then take up the un-
checked names in alphabetical
order, and raise or lower the
same as in their opinion will be
just, checking off each taxpayer
as the same is adjusted.
7131 Notice of Assessments
Raised. In case the value of any
specific property or the entire as-
sessment of any person, partner-
ship, corporation, or association
is raised, or new property is add-
ed by the Board, the clerk shall
give immediate notice thereof by
mail to each at the post-office ad-
dress shown on the assessment

rolls, and at the conclusion of the
action of the Board therein the
clerk shall post an alphabetical
list of those whose assessments
are thus raised and added, in a
conspicuous place in the office or
place of meeting of the Board, and
enter upon the records a state-
ment that such posting has been
made, which entry shall be con-
clusive of the giving of the no-
tice required. The Board shall
hold an adjourned meeting with
at least five days intervening af-
ter the posting of said notices,
before final action with reference
to the raising of assessments or
the adding of property to the rolls
is taken, and the posted notices
shall state the time and place of
holding such adjourned meeting,
which time and place shall also
be stated in the proceedings of
the Board."
Provision is made in the statute
with reference to appeals by any
dissatisfied parties.
" 7133 Appeal. Appeals may be
taken froze the action of the
Board with reference to such
complaints to the district court of
the county in which such Board
• holds its sessions, within twenty
days after its adjournment. Ap-
peals shall be taken by a written
notice to that effect to the chair-
man or presiding officer of the re-
viewing board, and served as an
original notice.
7135 Appeal on Behalf of Public.
Any officer of a county, city, town,
township or school district inter-
ested or a taxpayer thereof may
in like manner make complaint
before said board of review in re-
spect to the assessment of any
property in the township, city or
totivn and an appeal from the ac-
tion of the board of review in fix-
ing the amount of assessment on
any property concerning tivhich
such complaint is made, may be
taken by any of such afore-
mentioned officers.
Such appeal is in addition to the
appeal allowed to the p e r s o n
whose property is assessed and
shall be taken in the name of the
county, city, town, township, or
school district interested and
tried in the same manner, except
that the notice of. appeal shall al-
so be served upon the owner of
the property concerning w h i c h
the complaint is made and af-
fected thereby or person required
to return said property for assess-
ment."
And it is further provided:
"7134 Trial on Appeal. The court
shall hear the appeal in equity
and determine anew all questions
.arising before the Board which
relate to the liability of the prop-
erty to assessment or the amount
thereof, and its decision shall be
certified by the clerk of the court
to the county auditor, who shall
correct the assessment books in
his office accordingly."
I am unable to find any provision
of the statute ,requiring the Board
of Review to file a report with the
City.

Gentlemen: At the session of the
City Council held June 30th, the
petition of the Dubuque Seed Com-
pany requesting permission to add
15 feet of length to their loading
platform in the alley in the rear of
169-171 Iowa Street was referred to
the Council to view the grounds.
The Council viewed the grounds
on July 4th and decided that the re-
quest be granted by ordinance sub-
ject to the usual regulations. I rec-
ommend that the action of the
Council be confirmed.

Gentlemen: At the session of the
City Council held June 1st, the mat-
ter of improving and draining Gan-
dolfo Street from Dodge to St. Jo-
seph, Dodge Street from South Al-
gona to Collins, St. Joseph Street
from South Algona to Gandolfo and
the matter of taking care of the
storm [eater in the alley between
Gandolfo and South Algona Streets
from Dodge to St. Joseph was re-
ferred to the Concil to vie[v the
grounds.
The Council viewed the streets
and the alley on July 4th and de-
cided that the several streets be
graded according to the established
grades and that arrangements for
the payment of constructing curb
and gutter and of surfacing be
worked out with the property own-
ers. It was decided to order the
proper grade established for the al-
ley in order to take care of the
storm water. I recommend that the
decisions of the Council be con-
firmed.

City Council held June 30th, the
petition of Dubuque Packing Coxn-
pauy requesting permission to make
iuxprovemexxts and alterations in
the alley betweeax Maple Street and
vacated Cedar Street from 16th to
lith Streets was referred to the
Council to view the grounds.
The Council viewed the premises
on July 4th and concluded that the
plan of the Dubuque Packing Com-
pany would depress the alley to
such an e3:tEnt so as to interfere
with the access to to%s on the [[=est-
erly side of the alley. It was de-
cided that a modified request of the
Dubuque Packing Company provid-
ing fora higher alley grade with
area[vays along the basement win-
dows [would be given favorable
consideration.

Gentlemen: At the session of the
Cite Council held ilIay 4th com-
plaints were received from persons
living' in the vicitxit3= of I~niest and
Elm Streets from Gax•field Avenue
to 22nd Street concerning the odors
and gases coming from the Bee
Branch Storm Se[vex°, and the City
Mauag'er was instructed to confer
~[=ith the officials of the Dubuque
Packing Company for the purpose
of arriving at a solution to the
problem.
Investigation of the complaints
indicate that the odors and gases
from the Bee Branch Sever orig-
inate from the packing house
[wastes introducecd in the sever and
emanate from the storm sewer op-
enings. This condition is aggra-
va.ted during tlxe periods of high ri[=-
e.r stages and particularly when
easterly [winds blow into the open
end of the storm sewer at East Four-
teenth Street, thus carrying the od-
ors and gases to the points when
it causes a nuisance to the petition-
ers. Several conference have been
had with the officials of the Du-
buque Packing Company with a
view to correcting the condition at
its source. It appears that a com-
plete solution of the problem re-
quires either the treatment of the
packing house waste, so that only

innocuous effiuent be admitted to
the storm sewer or that a connec-
tion with the sanitary sewer sys-
tem be provided on East 16th Street
possibly in connection with settling
basins at the packing plant.
The condition complained of by
the petitioners is of a nuisance na-
ture and every- effort should be
made to abate it.

RESOLUTION AND APPLICA-
TION FOR PERMANENT
TRANSFER OF FUNDS.
Whereas, the delinquency in tax
payments in the fiscal years 1935-
1936 and 1936-1937 caused the City
of Dubuque to issue stamped war-
rants upon which judgments were
rendered against the City and said
judgments were satisfied by issuing
general obligation bonds dated May
1. 1936, and June 1, 1937; and
Whereas, Fire Department Main-
tenance Fund Warrants in the
amounts of $12,469.72 in the year
1935-1936 and of $11,522.51 in the
year 1936-1937 were included in
these funding operations; and
Whereas, the repayment of the
delinquent tax collections credited
to the Fire Department Mainten-
ance Fund will obviate an increase
in the tax levy necessary to pay
general obligation bonds; and
Whereas, there is now in the
hands of the City Treasurer and
credited to the Fire Department
Maintetiance Fund the sum of
$64,L61.65, of which $24,022.23 is
available for transfer to the Bond-
ed Debt Fund for debt service; and
Whereas, before such transfer
can be made, an application must be
made to the State Comptroller for
authority to make the transfer and
his approval secured thereon: Now,
Therefore,
Be It Resolved by the Gity Coun-
cil of the City of Dubuque that,
subject to the approval of the State
Comptroller there be and there is
hereby transferred from the Fire
Department 1Vlaiuteuance Fund the
sum of $24,022.23 to the Bonded
Debt Fund and the State Comp-
troller is hereby petitioned to auth-
orize and approve such transfer;
and
Be It Further Resolved that up-
on the approval of such transfer the
Auditor of the City of Dubuque is
directed to adjust his records ac-
cordingly and to notify the Treas-
urer of such transfer, and such no-
tification shall be accompanied by
a copy of this resolution and the
record of its adoption.
The resolution was passed, adopt-
ed and approved by unanimous ac-
tion of the City Council on the 6th
day of July, 1942, and all members
thereof signed their names thereto.

Mayor Wharton read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of approving
the budget estimate of expenditures
for the fiscal year beginning April
1, 1943, and ending March 31, 1944,
as a basis for the tax levy for the
year 1942, the same to be collected
in the Year 1943, and directing the
City Clerk to publish a notice of
the date of public hearing upon the
same and acting on any other busi-
ness as may properly come before
a regular meeting of the City
Council.

Whereas, The Council of the City
of Dubuque has duly considered and
caused to be prepared the budget
estimate of expenditures for the fis-
cal year beginning April 1, 1943, and
ending March 31, 1944, as a basis
for the tax levy for the year 1942,
the same to be collected the year
1943, and said budget having been
duly approved by it; Now, There-
fore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that said
budget estimate be and the same
is hereby ordered filed in the office
of the Clerk of Dubuque and the
date of public hearing thereon is
hereby fixed as the 3rd day of Au-
gust, 1942, at 7:30 o'clock P. M., in
the Council Chamber in the City
Hall.
Be It Further Resolved, That said
Clerk be and he is hereby directed
to cause said budget estimate of ex-
penditures and proposed tax levy to
be published in the official news-
papers of the City of Dubuque and
an official notice to be given of the
time and place, when and where
said budget estimate will be consid-
ered by said Council for final adop-
tion, at which time and place tax-
payers will be heard for and against
said estimate, said publication to be
not less than ten (10) days before
said date of hearing.
Be It Further Resolved, That in
lieu of all of the separate annual
levies for the General Fund, the
Grading Fund, the Improvement
Fund, the Sewel• Fuud and the
Electric Light aiicl Power Fund,
there shall be levied one (1) tax

To the Honorable City Council of
the City of Dubuque, Iowa, and to
the Honorable Members thereof,
and to the Honorable City Man-
ager of the City of Dubuque,
Iowa:
Gentlemen: At the present time,
I understand that a move is afoot
to have the City of Dubuque put in
a curbing on Eleanor Street which
runs Perpendicular to South Grand-
view Avenue near the 1100 block.
This matter came before the City
Council a little over a yeal' ago and
at that time it was decided that no
improvements would be made on
Eleanor Street at the expense of the
city.
I objected at that time to any im-
provements on this street on which
only one home is loca,etd; and again
I firmly object to the curbing of
this street since two-thirds of the
preperty surrounding this street is
pasture land. It would be au injury
to the holders of this land, as well
as to other City taxpayers, to fur-
ther burden them with this expense
of curbing this street since the pas-
ture land adjoining this property
cannot stand this additional ex-
pease.
If said curbing is to be laid, I feel
that this improvement should be
made by the owners who will be di-
rectly benefitted and not by the
City, thereby throwing the bulk of
the expense onto those who in no
way will profit by it.

Manager Rhomberg submitted a
verbal recommendation that ar-
rangements be made with the State
Highway Commission to replace the
pavement disturbed by the rail re-
moval on Dcdge Street and the In-
terstate Power Company notified to
salvage the rails.

Witnesseth:
In consideration of the perform•
ante by the Party of the First Part,
of maintenance work specified be-
low during the period July 1, 1942,
to June 30, 1943, Second Party
agrees to pay First Party, the
amounts stipulated herein.
Party of the First Part agrees to

Part, all routine maintenance opera-
tions in the City of Dubuque ou ex-
tensions of primary roads specific-
ally described as follows: All ex-
tensions of Primary Roads in the
City of Dubuque except the west
0.65 miies of U. S. No. 20 and the
south 0.49 miles of U. S. IVo. 61.
Total Miles 8.35 at $300.00 per
mile Total Routine Maintenance--
$2,505.00.
It is understood that "routine
maintenance operations" shall in-
clude surface maintenance, road
bed repairs, repairs to bridges, cul-
verts and guard rail, weed cutting,
snow plowing, and other mainten-
ance usually performed on primary
roads outside of cities and towns.
Routine maintenance of paved
streets shall extend from curb to
curb. Snow plowing included in
routine maintenance will apply to a
width of approximately 30 feet. The
hauling and disposal of the suo`v
plowed from the 30-foot section is
not included in this contract.
Party of the First Part further
agrees to perform special mainten-
ance work for the Party of the Sec-
ond Part on the above designated
extensions. This special mainten-
ance work is specifically described
as follows: Snow removal and sand-
ing of hills and curves will be per-
formed as routine maintenance.
Special maintenance will be cai-
tracted by the Highway Commis-
sion either with private contracts
or with supplemental contracts
with the City.
Total Contract Amount, $2,505.00.

RESOLUTION AND APPLICA-
TION FOR PERMANENT
TRAI~TSFER OF FUNDS.
Whereas, the delinquency in tax
payments in the fiscal year 1935-
1936 and 1936-1937 caused the City
of Dubuque to issue stamped war-
rants upon which judgments were
rendered against the City, and said
judgments were satisfied by issu-
ing general obligation bonds dated
1\Iay 1, 1936, and June 1, 1937; and
Whereas, Fire Department Main-
tenance Funcl Warrants in the
amounts of $12,469.72 in the year
1935-1936 and of $11,552.51 in the
year 1936-1937 were included in
these funding operations; and
Whereas, the repayment of the
delinquent tax collections credited
to the Fire Department Mainten-
ance Fund will obviate an increase
in the tax levy necessary to pay
gene"ral obligation bonds; and
Whereas, there is now in the
hands of the City Treasurer and
credited to the Fire Department
NIainteuance Funcl the sum of
$64,261.65 of which $24,022.23 is
available for transfer to the Bond-
ed Debt Funcl for debt services; and
Whereas, before such transfers
can be made, an application must
be made to the State Comptroller
for authority to malte the transfer
and his approval secured thereon:
Now, Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that,
subject to the approval of the State
Comptroller there be and there is
hereby transferred from the Fire
Department Maintenance Fund the
sum of $24,022.23 to the Bonded
Debt Fund and the State Comptroll-
er is hereby petitioned to author-
ize and approve such transfer.
Be It Further Resolved that upon
the approval of such transfer the
Auditor of the City of Dubuque is
directed to adjust his records ac-
cordingly and to notify the Treas-
urer of such transfer, and such no-
tification shall be accompanied by a
copy of this resolution and the rec-
ord of its adoption.
The resolution was passed, adopt-
ed and approved by unanimous ac-
tion of the City Council on the 6th
day of July, 1842, and all members
thereof signed their names thereto.

Whereas, the Iowa State High-
way Commission proposes to im-
prove by paving the extension cf
Primary Road No. 20 within the
City of Dubuque in accordance with
plans heretofore filed in the office
of the Clerk of said City of Du-
buque, as follows:
West end of new bridge approach
(Sta. 102-{-48.5) westerly on Dodge
Street 286.3 feet (Sta. 99-}-62.2) and,
Whereas, the City has informed
itself as to said improvement and

has examined said plans therefor,
Now, Therefore,
Be It Resolved by the City of Du-
buque:
1. That the said City of Dubuque
hereby consents to the. proposed im-
provement of the extension of Prim-
ary Road ?~To. 20 within the City of
Dubuque, and
2. That the plans for said pro-
posed improvement as now on file
in the office of the Clerk of said
City are hereby approved, and
3. That said City will take such
legal steps and prosecute to a con-
clusion such legal action and/or
proceedings as are now or may
hereafter be required:
(a) To legally establish grade
lines of said Dodge Street in ac-
cordance with and as shown by the
pious of said contemplated improve-
ment hereinbefore approved.
(b) To prevent encroachment up-
on streets, highways and public
grounds of said city upon which
said primary road extension is now
or may hereafter be located.
(c) To prevent erection of ob-
structions in said street, highways
and public places.
(d) To remove or cause to be re-
moved obstructions erected therein.

ty, Iowa, desires to sell the above
described real estate to Ruby June
Crane for $35.00, and
Whereas, The seal of said prop-
erty by Dubuque County, Iowa, to
Ruby June Crane for a sum less
than the total amount stated in the
Tax Certificate including all en-
dorsements of subsequent general
taxes, interests and costs requires
the written approval of a majority
