Mayor Van Duelman stated that this
is the regular monthly meeting of the
City Council for the purpose of acting
upon such business as may properly
come before the meeting.
Communication of Board of Dock
Commissioners certifying the amount
of $32,237.00 as the amount required
for Dock Operation for the fiscal year
1942-43 presented and read. Council-
man Murphy moved that the commun-
ication be referred to the Council for
their consideration at the time the tax
levy is being considered by the Coun-
cil. Seconded by Councilman Thomp-
son. Carried by the following vote:
Yeas-Mayor Van Duelman, Council-
men Murphy, Schueller, Thompson,
Wharton. Nays-None.
Petition of Albert Fluckiger et al re-
questing the City Council to arrange
to acquire, through purchase or lease,
such off-street parking lots and to pro-
vide funds for that purchase by includ-
ing a one-mill tax when making up the
schedule for tax levy this year unless
funds for that purpose are available
from other sources presented and read.
Councilman Wharton moved that the
petition be referred to the Council for
consideration. Seconded by Council-
man Murphy, Carried by the follow-
ing vote: Yeas-Mayor Van Duelman,
Councilmen Murphy, Schueller,
Thompson, Wharton. Nays-None.
Petition of Ddith Brother requesting
the City Council to authorize the City
Treasurer to accept the amount of
$25.00 in full compromise and payment
of the special assessments and interest
which are unpaid against Lots 90, 91,
92 ar}d 93 of O'Neill's Riverview pre-
sented and read. City Manager Rhom-
berg recommending that the offer be
accepted and said assessments are no
longer collectable. Councilman Schuel-
ler moved that the recommendation of
City Manager Rhomberg be approved
and that the prayer of the petition be
granted and that the City Treasurer
be instructed accordingly, Seconded
by Councilman Thompson. Carried by
the following vote: Yeas-Mayor Van
Duelman, Councilmen Murphy, Schuel-

amending an Ordinance entitled "Oa•-
diuance No. 9-35," relating to restric-
tions upon the sale of beer and malt
liquors, providing for license fee by
permit holders and the collection of
said fee, providing for the regulation
of classes of beer permits and the re-
quirements to obtain said permits; pro-
viding for the limitation of Class B
Permits; providing for the enforcement
and administration of said Ordinance;
defining certain unlawful acts relating
to the manner of sale, and distribution
of beer and malt liquors; and to pro-
vide penalties for the violation of the
provisions of this Ordinance; repealing

been passed upon first and second read-

Section 2. Par. 495 of Ordinance
No. 9-35 is hereby amended by repeal-
ing the same, and substituting the fol-
lowing in lieu thereof:
`'No Class "C" Permit shall be is-
sued to any person except the owner
or proprietor of a grocery store or
pharmacy as those terms are herein-
after defined. except as otherwise
provided in this Ordinance a Class
"C" Permit shall be issued by the City
Council to any person who is the own-
er or proprietor of a grocery store or
pharmacy, who:
1. Submits a written application for
a permit, which application shall state
under oath:
a. The name and place of residence
of the applicant and the length of time
he has lived at such place of residence.
b. That he is a citizen of the State
of Iowa.
c. The place of birth of the ap-
plicant and if the applicant is a nat-
uralized citizen, the time and place of
such naturalization.
d. The location of the place or
building where the applicant intends
to operate.
e. The name of the owner of the
building and if such owner is not the
applicant that such applicant is the
actual lessee of the premises.
2. establishes:
a. That he is a person of good mor-
al character.
3. Furnishes a bond in the form
and conditioned as prescribed and to
be furnished by the state tax commis-
sion, with good and sufficient sureties
to he approved by the authorities to
which stich application is submitted,
cnndi±ioned upon the faithful observ-
ance of this Ordinance, in the sum of
five hundred dollars.
"Grocery store" means and includes
any retail establishment, the principal
business of which consists of the sale
of food or food products for consump-
tion off the premises.
"Pharmacy" shall mean a drug store
in which drugs and medicines are ex-
posed for sale and sold at retail, or in
which prescriptions of licensed physi-
cians and surgeons, dentists or veterin-
arians are compousded and sold by a
registered pharmacist."
Section 3. Par. 505, Subdivision (B)
of Ordinance No. 9-35, is amended as
follows
By striking the words "and in which
the floor space devoted thereto is not
less than 6000 square feet."
Subdivision (B), Par. 505, Ordinance
No. 9-35 is amended by adding there-
to the following:
(b-i) No dancing shall be permitted
in connection with the operation of a
beer business under a Class "B" li-
ccnse unless the floor space used for
clancuig purposes therein contain at
least ti~-e hundred square feet, all of
which shall be of the same general
floor level as the place where the beer
is dispensed; said space to be used for
uaucing shall be in the same room as,
or in a room adjacent to and opening
directly from, the place where beer
is dispensed and with a full view at
all times of the major portion thereof
from the place where beer is dispensed.
Said floor space shall not be obstructed
or crossed in any part or portion by
partitions or other obstructions of any
loud, except necessary structural posts,
pillars or similar supports.
(b-2) It is further provided that
the holder of a Class "B" license where
dancing shall be permitted in connec-
tion therewith as herein provided, shall,
at his own expense, provide for the at-
tendance thereat, at all times during
the hours when dancing is permitted.

(b-3) No booths shall be permitted
or used in connection with the opera-
tion of a beer business under any Class
`'B" license issued in the Citv of Du-
buque, unless the same are entirely
open at one side with an unobstructed
vic«~ therein from the rest of the room.
The total height of any booth struc-
ttu~e shall not exceed forty (40) inches,
provided, L-otaever, that any person who
is the holder of a Class "B" permit on
the date when this Ordinance shall be-
come effective, and whose place of
business is, on said date, equipped with
booths of a greater height than forty
(-101 inches, but not to exceed fifty
(50) inc?les, shall be permitted to con-
tinue the use of the same for such
period of time as said business is op-
erated by him. In no event, however,
shall any booth structure be of greater
height than fifty (50) inches and no
booths installed in the place of business
of any Class "B" permit holder on or
after the date when this Ordinance
shall become effective, shall exceed
forty (40) inches in height.

Section 4. That the number of Clas:
"B" Permits in the City of Dubuque

Section 5. No beer shall be sold or
delivered or consumed by any person
on the premises of any Class "B" Per-
mit holder between the hours of twelve
o'clock midnight on Saturday and sev-
en o'clock of the following Monday
morning.
Section 6. It shall be unlawful for
any person to sell, give or make avail-
able to any minor or to permit any
minor to purchase or consume any
beer on the premises of a Class "B"
or Class "C" Permit holder, or for
any minor to buy or attempt to buy
or to secure or attempt to secure beer
from any person, and it shall further
be unlawful for any person to offer
beer, with or without consideration to
any minor, except within a private
home and with the knowledge and con-
sent of the parent or guardian of said
minor.
Section 7. Par. 519, Ordinance No.
9-35 is amended as follows:
By striking out of said Ordinance
"except in the presence of parent or
guardian,"
Section 8. Any person, firm or cor-
poration ~vho violates any of the pro-
visions hereof, shall, upon conviction,
be punished by a fine of not to exceed
$100.00 or by imprisonment not to ex-
ceed 30 days in jail.
Section 9. That "Ordinance No. 19-
38" and "Ordinance No. 7-40," and any
and all other Ordinances or parts there-
of in conflict herewith be, and the same
are hereby repealed.
Section 10 .This Ordinance shall
be in force and effect from and after
its final passage, adoption and approval
by the City Council and publication
as provided by law.

Gentlemen:
At the session of the City Council
held June 2, 1941 the verbal request
of Ernest Staheli and others for the
extension of the water main on the
Asbury and Carter Roads for approxi-
mately 2,800 feet was referred to the
City Manager and the Water Superin-
tendent for investigation and report.
We have examined the proposed
location and find that it is the desire
of the petitioners to begin at the pres-
ent terminus of the 8" water main at
the easterly entrance of the Home of
the Good Shepherd. They propose
that the main cross the Asbury Road
at this point and then proceed on the
southerly side of the Asbury Road to
the Carter Road, crossing the Asbury
Road again and continuing thence on
the westerly _ side of the Carter Road
to a point about 20 feet north of the
main entrance to the Mt. St. Agnes

Novitiate. The dastance is as stated
by the petitioners. At least one fire
hydrant would be needed at the dead
end for flushing purposes.
We recommend that the petitioners
be granted permission to extend an 8"
water main as outlined above, the en-
tire expense of the project to be han-
dled by them, the work to be done ac-
cording to Water Department specifi-
cations and that on the completion of
the work an agreement be entered into
placing the main under the control of
the City Water Department with the
right to make further extensions there-
to and the right to permit connections
therewith to abutting property along
the line thereof, subject to the rules
and regulations of the said Water De-
partment.

held June 24, 1941 the petition of D, I:.
Cupps and others objecting to Alfred
Polsean staking cows and calves in the
neighborhood of Riker and Valley
Streets causing a public nuisance be-
cause of the bellowing and bawling of
the animals was referred to the City
Manager and Solicitor for investiga-
tion and report.
We have investigated this complaint
and interviewed Mr. Polsean. It ap-
pears that during the weaning period
he tied the animals which caused the
bellowing. Mr. Polsean has assured
us that the nuisance will be abated.

Gentlemen:
At the session of the City Council
held May 21, 1941 the petition of Otto
J. Schmid and others calling attention
to the condition of the Madison Street
steps and banisters was refererd to the
City Manager and Building Commis-
sioner for investigation and report.
bVe find that the concrete steps from
Madison Street to North Main Street
were constructed in 1918 and 1919 at
a cost of about $8,000.00. The orna-
rnental railings were in large part des-
troyed by vandals and replaced through
the years by pipe rails. The precast
stair treads have been broken repeated-
ly and replaced tivith others. It appears
that the steel reinforcing was originally
placed so near the concrete surfaces
that it was attacked by the elements
causing it to rust and in turn disinte-
grate the surface of the concrete beams
and columns.
The present condition of the steps
is as follows:
40% of the stair treads are defective.
50% of the concrete stringers are
defective.
30% of the columns are defective.
60% of the railings are defective.
The ratio of the rise to the run of
the stairs is poor, being 6" to 10/"
instead of the more conventional 7"
to 11" or 6T/z" to 12".
The stairs are not in good condition
and are in part dangerous. After ex-
amination of the original plans and of
the existing stairs, we estimate that
to replace the defective parts and to
put the steps in good safe condition
will require an expenditure of about
$1,000.00.

Gentlemen:
At the session of the City Council
held June 30, 1941 the petition of A.
~. Loetscher requesting permission to
connect L,ot 2 of 1 of 1 of Fremont
Avenue Subdivision with the sewer on
the opposite side of Fremont Avenue
was referred to the City Manager for
investigation and report.
I have investigated and find that the
above lot was assessed in the West
Dubuque district for the pumping sta-
tion, but not for abutting sanitary sew-
er. In Decetnber, 1940 an 8" sanitary
sewer tvas completed on the westerly
side of Fremont Avenue, which was
laid at a depth of 10 feet so that it
could be extended to the easterly side
of the street and thence southerly about
950 feet on Wartburg Place.
It appears that at least another home
is in prospect in this vicinity and 1,
therefore, recommend that a plat and
schedule be prepared showing the cost
of a sanitary sewer crossing to the
eastery= side of Fremont Avenue and
thence southerly in the space between
the curbing and sidewalk on Wartburg
Place approfimately 950 feet.

Be It Resolved by the City Council
of the City of Dubuque that the fol-

Mr. Allan Conrad addressed the
Council stating that he has filed an
application for a Class "C" Beer Per-
mit in conjunction with his grocery
store at 1600 Lincoln Avenue and re-
questing that said application be grant-
ed.
Councilman Schueller stated that Mr.
Conrad was entitled to know whether
or not he is to he given a permit and
that the Council should vote Yes or No
on his application. Councilman Schuel-
ler moved that the application of Allan
Conrad fora Class "C" Beer Permit
be granted. No second to the motion.
Councilman Murphy moved that the
application of Allan Conrad for a Class
"C" Beer Permit be referred to the
Council until such time as the City So-
licitor returns to the city. No second
to the motion.
Councilman Wharton moved that the
City Council adopt a policy of limiting
the number of Class "C" Beer Per-
mits to the present number now in
effect. Seconded by Councilman Mur-

Resolution No. 72-41
Whereas, The Council of the City
of Dubuque has duly considered and
caused to be prepared the budget esti-
mate of expenditures for the fiscal
year beginning April 1, 1942, and end-
ing March 31, 1943, as a basis for the
tax levy for the year 1941, the same
to be collected in the year 1942, and
said budget having been duly approved
by it; Now, Therefore,
Be It Resolved by the City Council
of the City of Dubuque that said bud-
get estimate be and the same is here-
by ordered filed in the office of the
Clerk of Dupuque and the date of pub-
lic hearing thereon is hereby fixed as
the 4th day of Aupust, 1941, at 7:30
o'clock P. M. in the Council Chamber
in the City Hall.
Be It Further Resolved, That said
Clerk be and he is hereby directed to
cause said budget estimate of expendi-
tures and proposed tax levy to be pub-
lished in the official newspapers of the
City of Dubuque and an official notice
to be given of the time and place,
when and where said budget estimate
will be considered by said Council for
final adoption, at which time and place
tax payers will be heard for and
against said estimate, said publication
to be not less than ten (10) days be-
fore said date of hearing.
Be It Further Resolved, That in lieu
of all of the separate annual levies for
the General Fund, the Grading Fund,
the Improvement Fund, the Sewer
Fund and the electric bight and Pow-
er Fund, there shall be levied one (1)
tax which shall be designated as the
"Consolidated Tax Levy."

and catch basin which is located in his

Alta Vista Street and suggesting that
if it is possible that said storm sewer
be removed from his property and if
that is not possible then the storm
sewer should be completely checked
for leaks, repaired and enlarged pre-
sented and read. Mr. C, ~. Rhoades
addressed the Council and requested
that the Council view his property.

condition and all it needs is a little
patching here and there to make a
servicable street. To impose the large
burden of an entirely new pavement
on this particular block between Burch
and James Streets ~'e feel would be
an unfair matter and we respectfully

ing aTourist Camp in connection with
his oil station on Dodge Street and
the Planning and Zoning Commission
takes the liberty to draw to the at-
tention of the City Council that Tour-
ist Camps and Trailer Camps are not
permissable under the ordinance as
no~v enacted. If your honorable body
is favorable to the establishment of
such camps within the City Limits,
may we suggest that now is perhaps
a good time to draw up proper regula-
tions to cover same. Such regulations
covering location, building, health and
hotel features would naturally command
the study and consideration of other
city departments as well as that of
the Planning and Zoning Commission
which has gn~en the matter some study
and hence a general conference ou the
matter might prove profitable. This
is rnly a suggestion and if you have

the City Council of the City of Du-
buque:
That said recommendation, be, and
the same is hereby approved, and the
Cityt Clerk, be, and he is hereby darect-
ed to cause to be published in the Du-
buque Telegraph-Herald and the Du-
buque Daily Tribune, a proposed
change and amendment, the date of
said hearing being hereby fixed at
7:30 P. M., on the 21st day of August,
1941, and to be held in the Council
Chamber in the City Hall, said notice
to be published so as to leave at
least fifteen (15) days between the day
of publication thereof and the time fix-
ed for said hearing, That at said hear-
ing parties in interest, and citizens
shall have an opportunity to be heard.

Amending Ordinance No. 12-1938 "Au-
thorizing the Interstate Power Com-
pany to substitute motor bus trans-
portation for street railway transporta-
tion, designating motor bus routes,"
by changing certain defined motor bus
routes and by repealing any and all
ordinances or parts thereof in conflict
herewith presented and read. Coun-
cilman Thompson moved that the read-
ing just had be considered the first
reading of the ordinance. Seconded
by Councilman Wharton. Carried by
the following vote: Yeas-Mayor Van
Duelman, Councilmen Murphy, Schuel-

rules be suspended requiring an ordi-

man Wharton moved that the rules
be suspended for the purpose of al-
lowing any one present in the 'Coun-
cil Chamber, who wishes to do so, to
address the Council. Seconded by
Councilman Thompson. Carried by

senting the City of Dubuque Bridge
Commission addressed the Council m
support of the petition of the City of
Dubuque Bridge Company, and urg-
ing Council to order the removal of
said platform. Herbert J Hoffmann,
Attorney, representing Swift and Com-
pany addressed the Council objecting
to Swift and Company bearing any
expense for the construction of the
bridge and urging Council not to order
removal of their platform as requested
in the petition of the City of Dubuque
Bridge Commission.
Councilman Wharton moved that
