Resolution Providing for the Is• suance of Street Improvement Bonds for the purpose of providing for the payment of the assessed cost of improving Apple Street with asphaltic macadam surfacing Whereas the contract heretofore entered into by the City of Du- buque, Iowa, for the improvement hereinafter described has been completed and the City Manager has certified the completion thereof to the City Council and the City 'I Council has ascertained the cost '. thereof and has determined that $742.77 Dollars of the cost thereof shall be assessed against the prop- erty subject to assessment there- for; and Whereas public notice, as provid- ed by law, has been published by the City Clerk stating the intention of the City Council to issue bonds for the purpose of providing for the payment of the assessed cast of said improvement and a public hearing has been held, pursuant to such notice and all objections made thereto have been considered and determined; Now Therefore Be It Resolved by the City Council of the City of Dubuque: 1. That to provide for the pay- ment of the assessed cost of im• proving Apple Street with asphaltic macadam surfacing from the North Property Line of Cleveland Ave- nue to the South Property Line of Uak Street there shall be issued Street Improvement bonds in the amount of $742.77 Dollars in antici- pation of the deferred payment of assessments levied for such im- provement. 2: Such bonds shall be called Street Improvement bonds; a n d shalt bear the date of March 4, 1953; and shall be numbered con• secutively; and they shall be num- bered, divided into series, and be in such denominations and for such maturity dates as are shown in the following table: 1. 5723, 5724, 5725, 5726-$100.00 each, April 1, 1954 2, 5727, 5728, 5729-$100.00 each, April 1, 1955 2. 5730-$42.77, April 1, 1955 3. Said bonds shall bear interest at the rate of 5 per cent per an- num, payable semi-annually in ac- cordance with coupons thereto at- tached; 4. Said bonds shall not make the City of Dubuque liable in any way, except for the application of said special assessment funds. 5. Said bonds shall provide that they may be payable at any time prior to the maturity date stated therein at the option of the City of Dubuque and shall be in substan- tially the follo~ving form: No. ......... Series No. CITY OF DUBUQUE Streelt ImprovemenP Bond The City of Dubuque in the State of Iowa promises to pay as herein- after mentioned to the bearer here- of, on the first day of , or at any time before that date, at the option of the City of Dubuque, the sum of One Hundred dollars with interest thereon at the rate of 5 per cent per annum, payable semi-an- nually, on the presentation and sur- render of the interest coupons here- to attached. Both principal and in- terest of this bond are payable at the office of the City Treasurer in the City of Dubuque, in the State of Iowa. This bond is issued by the City of Dubuque under and by vir- tue of Chapter 396 of the 1950 Code of Iowa, as amended, and the Res- olution of said City duly passed on the 2nd day of February, 1953, be- ing Resolution No. 70-53. This Bond is one of a series of 8 bands, 7 far $100.00 numbered from 5723 to 5729 inclusive, and one for $42,77 numbered 5730, all of like tenor and date, and issued for the purpose of improving Apple Street with asphaltic macadam surfacing as described in said Resolution, in said City, which cost is payable by the abutting and adjacent property °t Regular Session, February 2, 1953 1©? along said improvements and is made by law a lien on all of said property. It is payable only out of the Special Assessment Fund No. 1094 created by the collection of said special tax, and said fund can be used for no other purpose. It is hereby certified and recited that all the acts, conditions and things required to be done, prece- dent to and in issuing this series of bonds, have been done, happened, and performed, in regular and due form, as required by law and said Resolution, and for the assessment, collection and payment hereon of said special tax, the full faith and diligence of said City of Dubuque are hereby irrevocably pledged. That to provide for the pay- trgent of the assessed cost of im- proving Brunswick Street with as- phaltic macadam; surfacing from the North Property Line of Link Street to the South Property Line of Strauss Street there shall be issued Street Improvement bonds in the amount of $1152.63 Dollars in anticipation of the deferred pay ment of assessments levied for such improvement. 2. During 1952, five thousand eight hundred and forty-three ($5,- 843.99) were spent in necessary improvements at the Municipal Athleiic Field. This expenditure resulted in a new sewage system. rebuilding of the clubhouse to pra- vide two shower rooms instead of one; the enlarging of the rest- rooms; the grading of the outfield to eliminate the three feet differ- k ence in grade elevation between right and left fields; and the paint- ing of three sections of bleacher seats. 3. These changes as made during 1952 were of great value to the three hundred nine (309) boys who took active part in the Boys' Base- ball Program. A baseball school teas started on June 16th, and for two weeks these youngsters were taught the fundamentals of the game. Upon conclusion of the Baseball School, the participants were divided into teams and nine- ty-one (91) games were played dur- ing the morning and afternoon ses- sions from June 30th to August 26th. 4. The extent to which these youngsters use the facilities of the Athletic Field can readily be seen. llfeanwhile the team which Mr. Whelan represents used the Park en sixteen (16) occasions, for which they paid a fee of six hundred forty dollars ($040.00). Of this amount, two hundred forty dollars ($240.00) represents the cost of el- ectrical energy. Expense to the Ci- tg of Dubuque for the mere prep- aration of the field for their games totaled three hundred twenty-five dollars and forty-five cents ($325; 45). 5, At the reguiar meeting of the Playground and Recreation Com- ~ mission on November 10, 1952, the 1 question of further improvements was discussed and at that time the Commission members went on record as favoring correction of the lighting system. The Director of Recreation was authorized to proceed with plans and to secure - prices. In addition, it was deemed ~~ advisable to erect additional steel "~< fencing and to grant consideration to the painting of all the steel fencing. 6. When considering Mr. Whelan's suggestions, the question arises as to whether these, or the plans of the Commission, would be mare ad- vantageous far not only the Boys' Baseball Program, but also for the various independent teams who use the Athletic Field. The mem- bers of the Commission, consider- ing all arguments, believe greater benefit would be derived from the improvements as planned at their meeting on November 10th. The Playground and Recreation Commission recommend to your honorable body that the suggestions of Mr. J. Edward Whelan be waiv- ed in favor of those plans which they have adopted. As a result she has sustained considerable medical expense and loss of time in addition to her pain. Moore addressed the Council suggesting the instal- lation of semaphores at Seventh and Locust Street, also at Seventh and Central Avenue, also at Seventh and White Streets and at Twelfth and Locust Streets would help pedestrians to cross the busy intersections and that the lights be timed to permit a steady flow of traffic. Also stating that at the present time it is really hazardous for a pedestrian to cross street intersections especially since one way streets have been established as traffic has speeded up con- siderably. Mr. Moore was informed by the City Manager, Mayor and Mem- bers of the City Council that Du- buque blocks are so short that intersections would be blocked by traffic if there were lights at every corner and that the Council have been advised by experts that some semaphores should be timed and others to respond to tripping of cars that approach from side streets, also that the remarxs of Mr. Moore are worthy sugges- Regular Session, February 2, 1953 tions and should be referred to the police department and the traffic safety council and that stricter enforcement is in order if traffic has speeded up. Lt. John E, Bitner, 'of the Air Force Filter Center in Chicago, addressed the Couneil asking for backing in reorganizing a Ground Observer Corps in Dubuque, now in an inactive state, by helping to find a suitable location and a leader for the Ground Observer Carps in Dubuque. Mayor Austin informed Lt. Bit- ner that the Council will be glad to assist in trying to find a suitable location and will also be glad to appoint a leader for the Ground Observer Corps if suitable candi• dates can be found, There being no further business Councilman Kolb moved to ad• journ.
