Public Works Director Don Vogt is recommending acceptance of the Floodwall Levee
Slope Stabilization Project, as completed by Eastern Iowa Excavating and Concrete
LLC, in the final contract amount of $224,617.91, which is a 22.68% increase from the
original contract amount of $183,087.50. The increased cost of this project was due to
additional repairs being required on a longer section of shoreline than originally planned
and specified.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The attached resolution provides for the acceptance of the construction contract for the
Floodwall Levee Slope Stabilization Project.
DISCUSSION
Work has been completed on the project by Eastern Iowa Excavating and Concrete
LLC, of Cascade, Iowa in the final contract amount of $224,617.91. I am
recommending that the City Council accept the improvements and establish the final
contract price at $224,617.91, which is a 22.68% increase from the original contract
amount of $183,087.50. The increased cost of this project was due to additional
repairs being required on a longer section of shoreline than originally planned and
specified. This project expense overage was previously addressed in my October 9t"
memo to you, which was provided to the City Council at its October 19t" meeting.

The City Council is requested to adopt the attached resolution accepting the
improvements and establishing the final contract amount.

ACCEPTING THE FLOODWALL LEVEE SLOPE STABILIZATION PROJECT
AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public Improvement Contract for the Floodwall Levee Slope
Stabilization Project (the Project) has been completed and the City Engineer has
examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the City Engineer
recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the General Fund appropriation for the contract amount of $224,617.91 less any
retained percentage provided for therein as provided in Iowa Code chapter 573, and to
pay such retainage only in accordance with the provisions of Iowa Code chapter 573.
