This memorandum transmits a resolution to include the FY 2019 Annual Action Plan in the FY 2019 City Budget. BACKGROUND The City is required to submit an Annual Action Plan to the United States Department of Housing and Urban Development (HUD) for the Community Development Block Grant (CDBG) program. The attached FY 2019 Annual Action Plan provides for use of Community Development Block Grant (CDBG) funds for the anticipated entitlement of $968,235 and revenues of $490,421 in program income, for a total of $1,458,656. The FY 2019 Annual Action Plan provides for year four of the five-year Consolidated Plan. The FY 2016-2020 Consolidated Plan was adopted by City Council in July 2015. DISCUSSION The attached plan is recommended for inclusion in the City Budget. The United States Department of Housing & Urban Development (HUD) has not announced the entitlement allocations for use in the City’s fiscal year 2019. The attached plan was prepared using an estimated entitlement amount of $968,235. HUD requires communities submit a plan based on the actual entitlement allocation and not an estimate. The plan will be amended in accordance with the City’s Citizen Participation Plan to reflect the actual allocation prior to submission to HUD. The final plan will be adopted after a public hearing held by the Community Development Advisory Commission and approval by City Council. The amended action plan must be submitted to HUD on or before August 16, 2018. RECOMMENDED ACTION I recommend the City Council approve the attached resolution adopting the FY 2019 Annual Action Plan for inclusion into the City’s FY 2019 budget. Whereas, the City of Dubuque has, through a series of public meetings and hearings, proposed a Fiscal Year 2019 (Program Year 2018) Community Development Block Grant Annual Action Plan for inclusion in the City Budget addressing housing and non -housing needs in the community; and Whereas, the City Council has held a public hearing on the proposed plan on February 12, 2018. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the Community Development Block Grant Fiscal Year 2019 (Program Year 2018) Annual Action Plan, attached hereto as Exhibit A and by this reference made a part hereof, is hereby adopted for inclusion in the Fiscal Year 2019 City Budget on February 28, 2018. Section 2. That Fiscal Year 2019 Annual Action Plan is based on an estimated entitlement and may need to be amended prior to submission to the United States Department of Housing and Urban Development to reflect the actual entitlement amount awarded; and, Section 3. Exhibit A PREPARED BY THE HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT 2 CITY OF DUBUQUE, IOWA FY 2019 ANNUAL ACTION PLAN FOR THE USE OF PROGRAM YEAR 2018 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS The City of Dubuque distinguishes between four different but complementary areas of program development in its overall CDBG program: Housing Development, Economic Development, Neighborhood and Community Development and Planning & Administration. The following description of activities summarizes the projects to be completed in the FY 2019 Annual Action Plan with the use of CDBG funds. This document is subject to revision based on availability of federal funding. RESOURCES_____________________________________________________$1,458,656___ Entitlement 2019 $968,235 The Fiscal Year 2019 entitlement allocations have not been announced. The entitlement is an estimate based on Fiscal Year 2018 Allocation. Program Income $490,421 Program income projects are based on forecast for loan repayments based on the loan portfolio and program income generated from CDBG funded programs. PLANNING AND ADMINISTRATION $266,850 CDBG regulations limit expenditure on panning and administrative funds to 20% of the current year program income plus the current entitlement. The proposed plan budgets for 20% of expenditures for administration and planning activities. CDBG Administration Services and Staff $119,061 Staff support for general management. Oversight and coordination of the Community Development Block Grant program; assures compliance with federal regulations and reporting requirements. Includes $25,000 for consultant for Consolidated Plan. Priority: High Objective/Outcome: Suitable Living Environment/ Sustainability (SL3) Housing Planning/Administration Services and Staff $76,655 On-going staff support for general housing planning activities, including Consolidated Plan, and department administration. Priority: High Objective/Outcome: Decent Housing/Accessibility (DH1) Neighborhood Development Services & Staff $71,134 The Neighborhood Development Specialist coordinates the City’s neighborhood Development programs and provides technical assistance to organizations and residents to improve Dubuque's neighborhoods. National Objective: Low and Moderate-Income Housing Location: Citywide Proposed Accomplishments: 18 Housing units Priority: High Objective/Outcome: Decent Housing/Sustainability (DH3) Purchase/Rehab/Resale $40,000 Provides funding to address the redevelopment of sub-standard and vacant/abandoned city-owned properties. Properties acquired, rehabbed, and sold to low and Moderate-Income homebuyers or to property owners maintaining affordable rents. National Objective: Low and Moderate-Income Housing Location: Citywide Proposed Accomplishments: 1 Housing Unit Priority: High Objective/Outcome: Decent Housing/Affordability (DH2) Rental Unit Rehabilitation $50,000 1) Emergency Code Enforcement Loan Program Provides loans to correct code deficiencies and emergency or health and safety corrections for rental properties. The program prevents the displacement of economically disadvantaged tenants resulting from code enforcement actions. 2) Rental Unit Rehabilitation Provides loans for property owners to correct code deficiencies and make substantial repairs to sub-standard rental units. 3) Accessibility Rehab Provides forgivable loans to disabled tenants to make rental units accessible to the physically disabled. National Objective: Low and Moderate-Income Housing Location: Citywide Proposed Accomplishments: 10 Housing units Priority: High Objective/Outcome: Decent Housing/Affordability (DH2) 5 ECONOMIC DEVELOPMENT PROGRAM $0 Commercial/Industrial Building Rehab Loan Program and Revolving Loan $0 Provides low interest and forgivable loans/grants for rehabilitation of commercial and industrial buildings in the City’s older neighborhoods and downtown. Rehabilitation assistance is limited to improvements to the exterior of the building and to the correction of code violations. On-going revolving loan fund established. National Objective: Removal of Slum and Blight Location: Slum and Blight Area Priority: High Objective/Outcome: Suitable Living Environment/Sustainability (SL3) Economic Development Financial Assistance Program and Revolving Loan $0 Provides both large and small businesses with attractive low-interest and forgivable loan packages or grants to support local economic development efforts, including projects to create or retain jobs, enhance the tax base and strengthen the local economy. To the greatest extent possible, these investment capital funds are used to benefit low and Moderate-Income citizens, address slum and blight problems, leverage additional funding from state, federal and private sources and to assist in the retention and expansion of existing local businesses. (a) The period of performance for the funding assistance specified in the Funding Approval ("Funding Assistance") shall begin on the date specified in item 4 and shall end on September 1, 2026. The Grantee shall not incur any obligations to be paid with such assistance after September 1, 2026. (b) The Recipient shall attach a schedule of its indirect cost rate(s) in the format set forth below to the executed Agreement that is returned to HUD. The Recipient shall provide HUD with a revised schedule when any change is made to the rate(s) described in the schedule. The schedule and any revisions HUD receives from the Recipient shall be incorporated herein and made a part of this Agreement, provided that the rate(s) described comply with 2 CFR part 200, subpart E. Administering Direct Department/Agency Indirect cost rate Cost Base % % %a % Instructions: The Recipient must identify each agency or department of the Recipient that will carry out activities under the grant, the indirect cost rate applicable to each department/agency (including if the de minimis rate is used per 2 CFR §200.414(f)), and the type of direct cost base to which the rate will be applied (for example, Modified Total Direct Costs (MTDC)). Do not include indirect cost rates for subrecipients. (c) In addition to the conditions contained on form HUD 7082, the grantee shall comply with requirements established by the Office of Management and Budget (OMB) concerning the Dun and Bradstreet Data Universal Numbering System (DUNS); the System for Award Management (SAM.gov.); the Federal Funding Accountability and Transparency Act as provided in 2 CFR part 25, Universal Identifier and General Contractor Registration; and 2 CFR part 170, Reporting Subaward and Executive Compensation Information. (d) The grantee shall ensure that no CDBG funds are used to support any Federal, State, or local projects that seek to use the power of eminent domain, unless eminent domain is employed only for a public use. For the purposes of this requirement, public use shall not be construed to include economic development that primarily benefits private entities. Any use of funds for mass transit, railroad, airport, seaport or highway projects as well as utility projects which benefit or serve the general public (including energy-related, communication -related, water - related and wastewater -related infrastructure), other structures designated for use by the general public or which have other common - carrier or public -utility functions that serve the general public and are subject to regulation and oversight by the government, and projects for the removal of an immediate threat to public health and safety or brownfield as defined in the Small Business Liability Relief and Brownfields Revitalization Act (Public Law 107-118) shall be considered a public use for purposes of eminent domain. (e) The Grantee or unit of general local government that directly or indirectly receives CDBG funds may not sell, trade, or otherwise transfer all or any such portion of such funds to another such entity in exchange for any other funds, credits or non -Federal considerations, but must use such funds for activities eligible under title I of the Act. (f) E.O. 12372 -Special Contract Condition - Notwithstanding any other provision of this agreement, no funds provided under this agreement may be obligated or expended for the planning or construction of water or sewer facilities until receipt of written notification from HUD of the release of funds on completion of the review procedures required under Executive Order (E.O.) 12372, Intergovernmental Review of Federal Programs, and HUD's implementing regulations at 24 CFR Part 52. The recipient shall also complete the review procedures required under E.O. 12372 and 24 CFR Part 52 and receive written notification from HUD of the release of funds before obligating or expending any funds provided under this agreement for any new or revised activity for the planning or construction of water or sewer facilities not previously reviewed under E.O. 12372 and implementing regulations. (g) CDBG funds may not be provided to a for-profit entity pursuant to section 105(a)(17) of the Act unless such activity or project has been evaluated and selected in accordance with Appendix A to 24 CFR 570 - "Guidelines and Objectives for Evaluating Project Costs and Financial Requirements."
