Duggan and Members of the City Council DATE: March 3, 2003 RE: Claim Against the City By John Schreiber Claimant Date of Claim Date of Loss Nature of Claim John Schreiber 02/24/03 02/16/03 Property Damage This is a claim in which claimant states that a City sewer line backed up and flooded into the floor drain and shower of his residence located at 550 Cooper Place. According to the report of John Klostermann, Street/Sewer Maintenance Supervisor, the Operations & Maintenance Department was notified of a possible sewer problem at 4:10 p.m. on February 16, 2003. Operations and Maintenance crew discovered the main line was clogged, due to a frozen manhole. The manhole was cleaned and service was restored in a timely manner. Operations and Maintenance records show that there is not a history of problems with this sewer line. It is therefore the recommendation of John Klostermann to deny this claim due to lack of prior knowledge. The Legal Department concurs with this recommendation. Our records show that we were notified of a possible sewer problem at 4:1 Opm on February 16, 2003. When the crew acrived, they found that our main line was plugged. The cause of the cloggage was a frozen manhole. The manhole was cleaned and service restored in a timely manner. Our records show that we do not have a history of problems with this line. It is therefore my recommendation to deny the claim due to the lack of prior knowledge. If you need any additional information concerning this claim, please contact me.
