Minutes Human Rights 2 10 03DUBUQUE HUMAN RIGHTS COMMISSION MINUTES OF February lO, 2003 Judy Giesen called the meeting of the Dubuque Human Rights Commission to order at 4:15 p.m. on Monday, February 10, 2003, in Conference Room 2 at the City Hall Annex. Roll Call: Present: Raydora Drummer Sr. Corine Murray Bill Ross Chuck Ryan Evelyn Jackson Judy Giesen Penny Ehlinger Lou Oswald Absent: Vincent Vanden Huevel Staff: Kelly I_arson Bill Blum Carol Spinoso The Commission heard oral arguments from Attorney Mike Schubatt, representing the Respondent, and Attorney Chad COx for the Complainant, pdor~eliberations in DHRC #3935, Richard Kenniker vs. Pomery, Inc., d/b/a Unique Balance. Commissioner Oswald moved pursuant to section 21.5(1)(f) of the Iowa Cede, to proceed to dosed session to deliberate a contested case - DHRC #3935, Richard Kenniker vs. Pomery, Inc., d/b/a Unique Balance. Commissioner Murray seconded. Roll call: Drummer Aye Giesen Aye Jackson Aye Murray Aye Ross Aye Oswald Aye Ehiingher Aye Ryan Aye All in favor. (4:53 p.m.) Commissioner Ryan excused himself at 4:54 p.m. Commissioner Jackson moved to return to open session. Commissioner Ross seconded. (6:02 p.m.) Commissioner Ehlingher moved to accept the Administrative Law Judge's proposed decision in DHRC #3935, Richard Kenniker vs. Pomery, Inc., d/b/a Unique Balance as submitted. Commissioner Murray seconded. Roll cell: Drummer Aye Giesen Aye Jackson Aye Murray Aye Ross Aye Oswald Aye Ehlingher Aye Commissioner Oswald moved to allow the Complainant's attomey fifteen days to file an application for attorney's fees, and to allow Respondent's attorney fifteen days after that to file an exception. Bill Blum stated that staff will prepare the Final Decision once the Commission has ruled on awarding attorney's fees.
