The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed lot split and indicating
that access is provided by way of an access easement.
Staff reviewed the submitted plat, noting that the Commission is being asked to waive the
lot frontage requirement.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that waiving the lot
frontage requirement for Lot 2 will not adversely impact development of adjacent property.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommendS that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Section 7, T88 R3E
INTRODUCTION
The submitted final plat subdivides an approximately 30-acre parcel located at the
corner of Highway 52 South and Old Massey Road into two lots.
DISCUSSION
The submitted final plat subdivides an existing 30-acre parcel into one 6.24-acre pamel
and one 23.46-acre pamel. The property is the former Tschiggfrie Quarry located at the
corner of Highway 52 South and Old Massey Road. Lot 1 has frontage along both
Highway 52 South and Old Massey Road. 8.68 acres of Lot I lies within a roadway
easement; therefore Lot 1 will have 14.78 net acres. Lot 2, which is located on the back
half of the existing quarry, will be 6.24 acres and, although in close proximity to Old
Massey Road, will not have any frontage. Lot 2 will be accessed from an easement
from Old Massey Road across Lot 1. The subdivision allows the property owner to sell
each lot to separate business interests.
RECOMMENDATION
Because Lot 2 has an existing access easement across Lot 1, staff recommends that
the Commission approve the final plat of Lot 1 of the SE 1/4, NE 1/4 and Lot2 of the NE
1/4, SE ¼ of Section 7, T88 R3E, waiving the lot frontage requirement for Lot 2.

RESOLUTION APPROVING THE FINAL PLAT OF LOT 1 OF THE SE %, NE %
AND LOT 2 OF THE NE %, SE % OF SECTION 7, T88 R3E.
Whereas, there has been filed with the City a final plat of Lot 1 of the SE %, NE
and Lot2 ofthe NE %, SE % of Section 7, T88 R3E; and
Whereas, Lot 2 provides 0 feet of lot frontage where 50 feet of lot frontage
minimum is required for each lot by Section 42-19(b) of the Subdivision Regulations;
and
Whereas, said final plat has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 2 to have 0 feet of lot frontage where 50 feet of frontage is required for each
lot.
Section 2. That the final plat of Lot 1 of the SE %, NE % and Lot 2 of the NE
%, SE % of Section 7, T88 R3E is hereby approved and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa
upon said final plat.
