On December 16, 2002, City Council authorized the purchase of three properties on Old
Mill Road subject to receipt of funds from the Iowa Emergency Management Division
and the Federal Emergency Management Agency.
The City has received notice that the project has been approved for eligible project cost
of $201,596 (Federal 75% share). The State share will be 10%, or $20,160, and the
local share will be 15%, or $30,239.
City Solicitor Bill Blum is having the title seamhes completed and will be ready to close
on the properties on Mamh 25. It normally takes 30 to 45 days for the FEMA fund
request to be processed, so the City will not be in receipt of the FEMA funds until mid to
late April. Two of the owners are close to losing properties they are attempting to
acquire as their new homes due to the delays encountered in this project. The City
would be cash flowing the pumhases for 30 to 45 days, which will allow the property
owners to close on their new homes and relocate prior to spring rains.
Administrative Services Manager Pauline Joyce requests authorization to proceed with
the property purchases.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

City Council authorized the purchase of these three properties subject to the City's
receipt of funds from the Iowa Emergency Management Division and the Federal
Emergency Management Agency at their December 16 meeting.
We received notice per a letter dated February 21 from Ellen Gordon that the project
has been approved for eligible project cost of $201,596 (federal 75% share). The State

office will be forwarding the contract (covers federal and state share) dudng the week of
March 10 for your signature, as the designated City representative. The request for
FEMA reimbursement will be submitted immediately following contract approval.
Bill Blum is having the title searches completed and will be ready to dose of the
properties March 25. It normally takes 30 to 45 days for the FEMA fund request to be
processed, so the City will probably not be in receipt of the FEMA funds until mid to late
April.
I would ask for your approval to proceed with closing on the properties on March 25,
pending receipt and processing of the FEMA contract on March 14. Two of the owners

On September 16, 2002, the City Council authorized submittal of an application for
financial assistance from the Iowa Emergency Management Division and the Federal
Emergency Management Agency to purchase six properties along Old Mill Road that
had been substantially damaged in past storm events. Official notification is expected in
the next 30 days indicating that the City will receive 75%. or approximately $260,000,
toward the purchase of three of the properties at 1620, 1695 and 1699 Old Mill Road,
Ten percent of the matching funds will be provided by the State of Iowa, and the
remaining 15%, or $46,000, will come from City of Dubuque storm sewer construction
funds.
These properties were included in this program at the request of the homeowners.
Public Works Director Mike Koch is requesting approval to purchase these properties
upon receipt of the grant funds.

INTRODUCTION
The purpose of this memorandum is to request that the City Council authorize the
purchase of 1620 Old Mill Road. 1 695 Old Mill Road, and 1 699 Old Mill Road subject
the City of Dubuque's receipt of funds from the Iowa Emergency Management
Division and the Federal Emergency'Management Agency under the Hazard Mitigation
Grant Program, The three homes were substantially damaged by the rainstorm on
June 4, 2002.
BACKGROUND
The Federal Emergency Management Agency (FEMA) administers the Hazard Mitigation
Grant Program (HMGP) that provides funding to States and local governments to
implement long-term hazard mitigation measures after a Presidential declared disaster:
This program authorizes the voluntary purchase and demolition or relocation of buildings
subjected to repeated flood damage and the converting of such property to open space.
Located in the 100-year floodplain at the confluence of the Catfish Creek and the Middle
Fork of Catfish Creek, floodwaters have repeatedly damaged the homes located at 1620_
1695, and I699 Old Mill Road. The homes experienced some flood damage in 1993.
significant flood damage in t999, and major damage in June of 2002. Kyle Kritz. acting for
the City of Dubuque's designated floodplain manager, Laura Carstens. determined that the
three homes were substantially damaged which means that the damage to the structure
exceeds f-rYty percent (50%) of the structures value.
individual property owners are not able to apply for these program funds, The owners of
the three properties have requested that the City pursue funds to purchase their
properties. The proposed purchase by the City will result in removal of the structures and
the creation of open space.
The City applied for and received funds under this program to purchase a home that was
located on Pennsylvania Avenue just west of John F. Kennedy Road, following the
Presidential Disaster Declaration in 1999.
DISCUSSION
On September 16, 2002, by resolution the City Council authorized the City Manager
to submit an application for financial assistance under the HMGP to purchase six (6)
properties and agreed to provide $99,383.00 of local funds to be used as matching
funds for the HMGP. The $99,383,00 is fifteen percent (15%) of the estimated
$662,554,00 required to purchase the six properties included in the grant application,
Following the direction of the City Council, an application was submitted for funding
to purchase the six properties: 1580, 1620, 1650, 1695, 1699, and 1711 Old Mi
Road.
According to the EMD, fourteen (14~ applications, one being the City of Dubuque's
application have been selected by the state for the development of the full HMGP
application These fourteen (14) applications request approximately Sl 2.2 million in
grant funding. The currem estimate of available funds under the HGMP for the 2002
Federal Disaster Declaration (DR-1420t is $1,700,000, highlighting the competitive
nature of the program.
The process EMD uses when reviewing applications includes distinguishing between
properties that are substantially damaged and those that are not. Substantially
damaged properties are of the highest priority under the HMGP and will be funded
before other projects.
Official notification is expected in the next thirty days indicating that the HMGP will
provide seventy five percent (75%}., or approximately $260,000 toward the purchase
of the three substantially damaged properties. The fifteen percent (15%) local match
is estimated to be $46,000 to purchase the three substantially damaged properties
The remaining ten percent (10%) is provided by the State of Iowa,
According to Mark Schneider. Community Development Director for the East Centrat
Intergovernmental Associatior, who is working with City staff and EMD for this
project, the property purchases could close in January or February of 2003.
BUDGET IMPACT
The current request for $46.000.00 is the fifteen percent (15%) local
under the HMGP to purchase the three substantially damaged homes,

In November, at the City Council's direction, City staff requested Community
Development Block Grant Funds to be used as the local match, however that funding
was not available for this project.
Storm Sewer Construction Funds have been made available through the Fiscal Year
2004 Capital Improvement Project budget.
ACTION REQUESTED
I respectfully request that the City Council approve the $46,000 allocation of storm
sewer construction funds as the local match and authorize the purchase the three
substantially damaged properties: 1620 Old Mill Road, 1695 Old Mill Road, and 1699 Old
Mill Road.

ECIA shall provide and perform the necessary administrative services required to acquire
three properties including relocation assistance to property owners and demolish structures
as described in Grant Agreement No. 1420-0002, Project No. 1420-31-01 between the City
of Dubuque af~d the Iowa Emergency Management Division (hereinafter called IEMD).
SECTION 2. ~ OF PERFORMANCE
The services of ECIA shall commence on March 1, 2003 and be completed within eighteen
months of the date of this agreement unless the terms are altered through mutual agreement
oflEMD, ECIA, and the City of Dubuque.
SECTION 3. METHOD OF PAYMENT
Payment stroll be due upon receipt of a monthly bill for services. The payment shall be
based on the actual costs incurred by the agency in performing the services. Total payment
shall not exceed $9,000.00.
SECTION 4. PERSONNEL
ECIA represents that it has, or will acquire, all personnel necessary to perform the services
under this Contract.
SECTION 5. PROPERTY
ECIA shall be flee to acquire or use existing property, real or personal, as it deems
necessary in the performance of work under this agreement.
SECTION 6. TERMINATION BY GRANTEE
6.1 The grantee may, by thirty days written notice to ECIA, temainate this contract in
whole or in part at any time, either for the grantee's convenience or because of the
failure of ECIA to fulfill its obligations under the contract. Upon receipt of such
notice, ECIA shall:
1. Immediately discontinue all services affected (unless the notice directs
otherwise), and
2. Deliver to the grantee all data, drawings, specifications, as may have been
accumulated by ECIA in perforating this contract, whether completed or in
process.
6.2 If the term/nation is for convenience of the grantee, ECIA shall be entitled to
compensation determined in accordance with 3 of this contract.
SECTION 7. TERMINATION BY ECIA
ECIA may terminate this contract by thirty days written notice to the grantee for grantee
failure to comply with the laws, roles, or regulations of the Iowa Emergency Management
Division in carrying out the Contract. The notice shall stipulate the laws, rules, or
regulations, which have been violated, and the date ECIA advised the grantee of said
violation.
SECTION 8. COMPLIANCE WITH LAWS AND REGULATIONS
ECIA shall comply with all applicable State and federal laws, roles, ordinances, regulations
and orders. ECIA shall comply with the provisions of federal, state and local laws, roles
and executive orders to insure that no employee or applicant for employment is
discriminated against because of race, religion, color, age, sex, national origin, or disability.
A breach of this provision shall be considered a material breach of this contract.
SECTION 9. ACCESS TO RECORDS
ECIA shall pennit IEMD or its agents to access and examine, audit, excerpt, and transcribe
any directly pertinent books, documents, reports, papers and records of ECIA relating to
orders, invoices, or payments or any other documentation or materials pertaining to this
Agreement.
SECTION 10. RECORDS RETENTION
All records of Grantee relating to this Agreement shall be retained for a period of five (5)
years following the date of final payment or completion of any required audit, whichever is
later.
SECTION 11. OTHER REQUIREMENTS
In connection with the carrying out of tlfis agreement, ECIA agrees to comply with any and
all rules and regulations of the Iowa Emergency Management Division concerning third
party contracts.

The Iowa Emergency Management Division (IEMD) informed us this morning that FEMA
approved the Hazard Mitigation funding for the Old Mill Rd. property buyouts for the Timmons,
McDermott and Lanfenberg projects. The following is our best estimate of a schedule based on
the information provided up to this moment.
· FEMA project approval: February 21, 2003.
· Authorization to incur project costs: February 21, 2003.
IEMD / FEMA / ECIA / others project contract briefing: week of March I0, 2003.
IEMD will bring contracts to this meeting to be forwarded to City for approval.
· Contract approval by City of Dubuque: March 17, 2003 City Council meeting.
· Submit request for FEMA funds to acquire properties: March 18, 2003.
· Anticipate City of Dubuque receiving FEMA funds: April 15 - 30, 2003.
This brings us to the property closings. Two of the ovrners are near to losing properties they are
attempting to acquire as their new homes due to the delays we've encountered in this project,
Both closings have been delayed multiple times. Would the City of Dubuque be able to pro¼de
funds for these two acquisitions and be reimbursed when funds are made available from FEMA
in mid-to4ate April? This would resolve the closing issues and allow the remaining owners to
relocate prior to spring rains.
Please advise me of your thoughts on this possibility. I haCe will advise the affected parties as
