Council for the purpose of acting upon
such business as may properly come

Claim of Robert Fitzke in the
amount of $25,00 for injuries received
by his son, Bobby Fitzke, caused in a
fall at the corner of Algona and Delhi
Streets, the result of tripping over sev-
eral bricks protruding above the nor-
mal street level, presented and read.
Councilman Clarlc moved to refer the
claim to the City Solicitor for investi-
gation and report, Seconded by Coun-
cilmau Thompson. Carried by the fol-
iotviug vote: Yeas-Mayor Murphy,
Councilmen Clark, Thompson, Van

rules be suspended for the purpose of

addressed the Council, submitting a
verbal request for the vacation of a 4-
foot strip south of their property litre
and also for the vacation of a 4-foot
strip east of their property line at the
intersection of Rhomberg and Lincoln
Avenues in order that they may be able
to erect gasoline curb pumps to con-
form with the Zoning Ordinance. Coun-
cilman Wharton moved that the verbal
request of John K. Chalmers, Attor-
ney, representing the Perfection Oit
Company, be referred to the City Coun-
cil to view the grounds. Seconded by
Councilman Clat•k. Carried by the fol-

Petition of Leo Schwind Post No.
508, Veterans of Foreign Wars, re-
questing permission to hold a carnival
during the week of July 17th to July
22nd, 1939, on the city property ad-
joining the Base Bal] Park, presented
attd read. Mr, Arnold Utzig addressed
the Council requesting that the prayer
of their petition be granted. Council-
man Thompson moved that the request
be granted and that the license fee and
rental fee be waived. Seconded by
Councilman Van Duelman, Carried
by the following vote: Yeas-Mayor

er Van Service, addressed the Council,
making inquiry as to what disposition
has been made of their claim for dam-
a;es to their truck caused in striking a
tree on 1~Ierz Street, this claim havutg
been referred to the Council for con-
sideration at a previous meeting, &Ia}nor
Murphy advised Mr. Amoth that upon
the recommendation of the City Solici-
tor that the claim had been denied.
Communication of May Clarlc, Li-
brarian, advising Council that the terms
of Dr, James Alderson and Mr. Frank
Huftill expire July 1, 1939, as members
of the Board of Trustees of the Cat•-
negie-Stout Free Public Library, also
the communication of Dubuque Trades
and Labor Congress advising Council
that they would appreciate the reap-
pointment of Mr. Frank Huftill as a
member of the Board of Trustees of
the Carnegie-Stout Free Public Li-
brar}~, also the communicatiot of James
Alderson advising Council that he
would be pleased to accept reappoint-
ment as a member of the Board of
Trustees of the Carnegie-Stout Free
Public Library, presented and read.
Councilman Van Duelman moved that
Dr, James Alderson and Mr. Frank
Huftill be reappointed as members of
the Board of Trustees of the Carnegie-
Stout Free Public Library for a term
of six }ears, said terms expiring July
1st, 1945. Seconded by Councilman
Clarlc. Carried by the following vote:

Petition of Rev. Kirchhoff, St. Cath-
erine's Parish, Route 4, requesting per-
mission to stretch a banner across Main

and read. Councilman Clark moved
that the request be granted, the erec-
tion of said bamter to be done under
the supervision of the Building Com-
missioner, Seconded by Councilman
Van Duelman, Carried by the follow-

Petition of Mrs. Sophia Schnee re-
questing that the City Treasurer be in-
structed to accept the face amount of
the Tax Sale Certificate, in the sum of
$85.46, held by the City of Dubuque
against Lot 20 of McCrane}%s First
Addition, presented and read. Coun-
cilman Clark moved to refer the peti-
tion to the City Manager for investi-
gation and report. Seconded by Coun-

Society, Des Moines, Iowa, requesting
permission to hold a tag day on either

date being set as July 29th, 1939. Sec-
onded by Councilman Thompson. Car-
ried by the following vote. Yeas-

the City Council to view Lot 29 of C.
A. Voelker's Addition and insist that
the owner of said lot be compelled to
remove the trees which constitute a

tion and report. Seconded by Council-

RESOLUTION N0. 82-39
Resolution and aoplication for au-
thority to transfet• the sum of $602.08
from the Library Fund to the Library
Building Fund of the City of Dubuque.
IVHEREAS, in June, 1937, the
Board of Trustees of the Carnegie-
Stout Public Library.entered into con-
tracts with the J. J. Nagle- Estate and
Louis Lagers et al, £or the purchase of
the following described real estate:
North 17.2' of Lot 6SS and South lfi.2'
of East / of Lot 6S9 and South Mid-
dle 32' of Lot 6S8 in the town (now
city) of Dubuque, Iowa, for the total
price of $16,000,00, said real estate to
he used for the purpose of enlarging
library grounds and premises owned
by the City of Dubuque; and
WHEREAS, pursuant thereto, the
City Council, in July, 1937, caused to
he levied a tax in the amount of $16,-
144.00 for the Library Building Fund,
said tax to be collected fn the year
1938; and
WHEREAS, up to May ZZ, 1939;
there has been collected from taxes for
the Library Building Fund the sum of
$15,397.92; and that out of this amount
there has been paid upon the Nagle
contract the full price of $10,500.00:
that no part of the Lagers contract of
$S,S00.00 has been paid, although pay-
ment was due February 1, 1939; that
there exists a balance ut the Library
Fund at this time of $4,897.92, which
is $602.08 less than the amount needed
to pay the Lagers contract; and
WHEREAS, there is now in the
hands of the City Treasurer attd cred-
ited to the Library Fund the sum of
$4,752.19;
NOW, THEREFORE„ Be it Re-
solved by the City Council of the City
of Dubuque that, subject to the ap-
proval of the State Comptroller, there
be and there is hereby transferred from
the Library Fund of the City of Du-
buque to the Library Building Fuud
of said City, the sum of $602.08, which
is now in the hands of the City Treas-
urer, and the State Comptroller is here-
by petitioned to authorize such transfer.
BE IT FURTHER RESOLVED
that the collection of delinquent taxes
accruing iu the Library Building Fuud
during the balance of the fiscal year
ending March 31, 1940, be refitrued to
the Library Fmtd in payment of the
above transfer.
BE IT FURTHER RESOLVED
that when such approval has been re-
ceived frotn said State Comptroller that
the Auditor and Treasurer adjust their
books accordingly.

for the use and benefit of said City,
and the inhabitants thereof forever,"
by striking certain parts of the title of
said Ordinance and by repealing Para-
graph 119, Section 2, and Paragraph
120, Section 3, of said Ordinance, said
ordinance having been passed upon
first and second readings on May 22nd,
1939, presented and read a third time.

Gentlemen:
I submit to you herewith for adop-
tion by your Honorable Body ttvo or-
dinances repealing Ordinances Nos. 23
and 24 of the Revised Ordinances of
1919.
Ordinance No. 23 relates to the bath-
ing beach commission and defines the
powers and duties of this commission
and provides for the management of
public beach or beaches by said com-
mission. This ordinance was never re-
pealed after the change of our form of
government in 1920 but has been ig-
nored and no commission has ever been
appointed since that time so far as I
have been able to ascertain. It ap-
pears to me that all of the functions of
this commission are now exercised by
our recreational commission to whom
has been given the supervision of the
swimming pool.
Ordinance No. 24 relates to the ap-
pointment of a levee improvement com-
mittee and defines its duties and pow-
ers and provides for the furnishing of
bond by members of the commission.
This ordinance has never been repealed
or changed in any way since the change
in our form of government and it ap-
pears to me that the duties of the com-
mission as set out in the ordinance are
now being performed by the dock com-
mission,
I would respectfully recommend both
of the ordinances transmitted herewith
be adopted in order that ordinances
23 and 24 may be repealed before the
publication of the new revised ordi-
nances of the City,

Gentlemen:
Pursuant to your instructions sealed
bids were received until 10:00 A. M.
June 22, 1939, for the furnishing and
installing of a New Deep 1Ve11 Tur-
bine Pump, otherwise known as Con-
tracts No. 7A and 7B of P. W, A•
Docket Iowa 1684-F. Four proposals
were received of which two, in our
opinion, are disqualified for the reason
that they refused to guarantee the
pump efficiency for a period of one year
as provided by the specifications. This
guarantee provision is a very impor-
tant feature and wa§ incorporated itt
the specifications only after consider-
able study and consultation with the
PWA officials.
Attached is a copy of the tabulation
of bids 1Ve recommend that Contracts
7A and 7B combined for furnishing
and installing a New Deep Well Tur-
bine Pump be awarded to khe A. Y.

of the Code of Iowa, 193$, pertaining

WHEREAS, the City Council met
in Special Session this 22nd day of

The pumping equipment of our Fire
Department is in need of some replace-
ments because of the age of-some of
the units. The two oldest pumpers in
regular service date from 1917 and 1922
respectively and the reserve pumper is
a 1915 model
I recommend that the Council in-
struct the City Clerk to advertise for
bids for the purchase of two new 750-
gallon triple combination pumping en-
gines. I further recommend that bids
be solicited upon a cash payment basis
solely from manufacturers and such

plete stocks of replacetnent parts and
competent mechanical service.
If two such pumpers are purchased
the replaced units could then be placed
in reserve and the fire fighting facili-

Resolution and application for au-
thority to levy an emergency tax for
the City of Dubuque.
WHEREAS, the City Council of the
City of Dubuque has made a compila-
tion of the expenses which will be in-
curred during the fiscal year beginning
April 1, 1940, and ending March 31,
1941, including the payment of prin-
cipal and interest upon outstanding in-
debtedness, and tax levies for the vari-
ous funds and purposes have been de-
termined; and
WHEREAS, a serious effort has
been made to keep operating costs as
low as is consistent with. good govern-
ment; and
WHEREAS, in the past bonds have
been issued in anticipation of some of
the taxes embraced in the consolidated
tax levy and the revenues derived'from
such taxes are pledged to the payment
of such bonds, as to principal and in-
terest; and
WHEREAS, payments of $47,000:00
in principal, and of $15,460,00 in inter-
est are to be made during the fiscal
year beginniig April 1, 1940, and end-
ing March 31, 1941, from the funds em-
braced in the consolidated tax levy;
and
1~~HEREAS, the inadequacy of the
revenues for ordinary purposes remain-
ing after the payment of such principal
and interest constitutes an emergency
which requires the levy of an emer-
gency tax and this Council considers
the levy of an emergency tax of one
(1) mill to be absolutely necessary;
NOW, THEREFORE, Be It Re-
solved by the City Council of the City
of Dubuque that the State Comptroller
be and he is hereby requested to au-
thorize and approve the levy of an
emergency tax in the year 1939 to be
approximately $33,467.00, the same to
be used in supplementing the funds re-
quired for debt service and in the man-
ner provided by law.
The foregoing'cesolution was adopt-
ed' at aspecial meeting of the City
Council of the City of Dubuque on the
22nd day of June, 1939.

There has been referred to me for
investigation and report by your Hon-
orable Body, the claim of Nan Mc-
Cafferey, filed February 23, 1939, in
the sum of $5,000.00 for injuries sus-
tained by her on January 17, 1939, by
reason of falling upon a crosswalk on
the westerly side of Main Street, at
the intersection of Main and Thirteenth
Streets, said injuries alleged to have
been sustained by reason of the negli-
gence of the City.
I beg to advise that upon investiga-
tion of this claim I find no evidence of
negligence on the part of the City of
Dubuque and respectfully recommend
that the claim be disallowed.
I am returning herewith claim.

Gentlemen:-
Prior to my assumption of that office,
there was referred to the City Solici-
tor, the claim of Mrs, T;mily Hoppmann
filed January 1, 1938, in the sum of
$1,500.00 for injuries alleged to have
been sustained by the claimant in a fall
on the sidewalk on Alta Vista Street
on the morning of December 19, 1937,
between the hours of 7 and 8 o'clock
A. M.
I have completed investigation of this
claim and find that the claimant did
fall upon the sidewalk on the Easterly
side of Alta Vista Street on the date
and at about the hour in question, but
that the injuries sustained was not due
to the negligence on the part of the
City of Dubuque, and from, the evi-
dence adduced as a result of the inves-
tigation made, I am satisfied there is
no liability on the part of the City of
Dubuque, and I therefore recommend
to your Honorable Body that the claim
be disallowed.

Building Commissioner, and the Chief
of the Fire Department and found to
be a dangerous structure and unfit far
human habitation and a menace to pub-
lic safety by reason of want of repair,
and defects in drainage and plumbing;

IVHEREAS, this Council has here-
tofore appointed a Condemnation Com-
mittee of three disinterested persons to

thorny to levy an emergency tax for
the City of Dubuque.
WHEREAS, the City Council of the
City of Dubuque has made a compila-
tion of the expenses which will be in-
curred during the fiscal year beginning
April 1, 1940, and ending Nlarch 31,
1941, including the payment of princi-
pal and interest upon outstanding in-
debtedness, and tax levies far the va-
rious funds and purposes have been de-
termined; and
WHEREAS, a serious effort has
been made to keep operating costs as
low as is consistent with good govern-
ment; and
WHEREAS, in the past bonds have
been issued in anticipation of some of
the taxes embraced iu the consolidated
tax levy and the revenues derived from
such taxes are pledged to the payment
of such bonds, as to principal and in-
terest; and
WHEREAS, payments of $47,000.00
i^ principal ,and of $15,480.00 in interest
are to be made during the fiscal year
beginning April 1, 1940, and coding
March 31, 1941, from the funds ettt-
hraced in the consolidated tax levy;
and
of Dubuque that the State Comptroller
be and he is hereby requested to au-
thorize and approre the levy of ar,
emergency tax to the year 1939 to be
approximately $33,467.00, the same to
be used in supplementing the funds re-
quired for debt service and in the man-
ner provided by law.

torney John A. Cunningham would

Restaurant Employees Union, ad-
dressed the Council stating that the
State Law sets out the license fee for
Class "C" beer permits and the Council
was in no position to raise the license i
fee as requested in the petition"attd re-
quested that no more Class "C" beer
permits be issued as this type of per-
mit leads to the cutting in prices by
some and makes unfair competition
among the holders of other permits and
further requesting that when a permit
holder gives up his license that the
practice of allowing some one else to
add his name to the permit be discon-
tinued as too many taverns operating
in a city is not to the best interest of
the tavern business, also suggesting
that a conference be held with a com-
mittee of the Tavern Keeper's Assn. to
talk over the violations which are oc-
curring under Class "C" beer permits.

Paragraph 814, Section 1
That it shall be unla~vfu] for any
person, firm or corporation owning
property within the limits of the City
of Dubuque to permit any weeds of
any variety and noxious growths to
grow thereon and it sha!1 be tha duty
of every such owner of lands to cut
said weeds and noxious growths be-
tween the 15th day of July and the
15th day of August of each year so that
said weeds may not be permitted to
bloom or blossom or go to seed.
Paragraph 815, Section 2
The terms "Weeds and Noxious
Growths" shall be taken to mean weeds
of all varieties and especially quack
grass, Canadian thistle, cocklebur, wild
mustard, sour or curied dock, smooth
dock, buckhorn or ribbed plantain, wild
parsnip, horsenettle, velvetweed, or but-
tonweed, burdock, shoofly, wild carrot
and Russian thistle.
Paragraph 816, Section 3
Any owner of lands who fail to cut
and remove said weeds or noxious
growths from his land or permits said
weeds to bloom, blossom or go to seed
within the time above stated, shalt be
fined for each lot or parcel of land upon
which said weeds are permitted to
grow, a sum not to exceed one hundred
($100.00) dollars or imprisonment not
to exceed thirty (30) days, and it shall
be the duty of the Street Commissioner
to report all violations of this Ordi-
nance.

Thepetition of Mr. John Wieser and
Mrs, Charlotte Shambaugh attached
hereto was considered further at the
June 19th meeting of the Planning and
Zoning Commission. Since the prop-
erty ownerships represented by the pe-
tition have changed since the original
petition was presented, the planning
and Zoning Commission takes the lib-
erty to recommend to your Honorable
Body that a new petition be required
before any action is taken. If such a
petition is granted later, the Commis-
sion feels that the parties taking over
vacated property should pay a fair
price, or else the city make a long term
lease reserving to itself all the rights
to such property.

At the session of the City Council
held June 22, 1939, the petition of J.
E. Kemler requesting reductions on
special assessments levied against the
East / of the North 88 feet of Lot 783
of A. McDaniel's Stib. and also on City
hots 281 and 282 in order to handle the
tax sale redemptions was referred to
the City Manager for investigation and
report.
The records show that tax certificate
No. SS was sold to Dubuque County
on January 2, 1939, against the East
of the North 88 feet of Lot 783 of A.
McDaniel's Sub. for the paving of Nest
Fourteenth Street in the amount of
826.69 plus interest of $1.33. The de-
linquent assessments against City Lots
281 and 282 are for paving Central
Avenue in the amount of $133,83 plus
interest of $8.52 and for Boulevard
lights on Central Avenue in the amount
of $27.62 plus interest of $2.07.
I recommend that following the re-
demption of the tax sale certificate
held by Dubuque County and after the
payments of the delinquent special as-
sessments that the City Auditor be au-
thorized to draw a warrant on the Spe-
cial Bonded Fttnd in the amount of
$11.42, representing a refund of 'all
Interest in excess of S% per annum
and all penalties included in the pay-
ments made to the County Treasurer.

held June 5, 1939, the petition of Mrs.
Sophia Schnee requesting that the City
Treasurer be instructed to accept the
face value of the tax sale certificate in
the amount of $85.46 held by the City
of Dubuque against Lot 20 of Mc-
Craney's First Addition was referred to
the City Manager for investigation ahd
report.
An examination of the records dis-
closes that on December 7, 1931, the
City bought tax sale certificate 142
against Lot 20 of McCraney's First Ad-
dition for paving Garfield Avenue in
Fund SS3 in the amount of $38.40 and
for paving of Ann Street in Fund 831
in the amount of $47.06 or a total of
$85.46. Since the date of the sale pen-
alties of $6.84 and interest of 851.42 has
accrued, making a total of $143.72,
I recommend that the petitioner be
allowed to redeem tax sale certificate
142 held by the City against Lot 20 of
McCraney's First Addition upon the
payment of the face. value of the cer-
tificate plus S% interest per annum, the
balance of interest and penalties to be
waived.

At the session of the Citv Council
held June 5, 1939, the petition of A. A.
Helling reouesting the removal of trees
from Lot 29 of C. A. Voelker's Addi-
tion was referred to the City Manager
for investigation and report.
f have examined the lot, which is
owned by Miss Mildred Schuster of
Chicago, and find it to be entirely cov-
ered with trees. There is no doubt that
the trees along the lot line are a source
of annoyance to the adjoining neigh-
bor, but since they are not public nuis-
ances, the remedy does not rest with
the City Council. However, the trees
overhanging the alley in the rear are
obstacles and hazards to the public use
of the alley. I, therefore, recommend
that the City Council order the trim-
ming and removal of the trees over-
hanging the alley.

At the session of the City Council
held June 22, 1939, the petition of Al.
J. Boland and others requesting the
installation of a street light at the inter-
section of Windsor Avenue and Provi-
dence Street was referred to the City
Manager for investigation and report.
Providence Street and East Twenty-
second Street are parallel streets only
52.6 feet apart. There is, at present, a
street light at the intersection of Wind-
sore Avenue and Providence Street,
which is unobstructed by trees or build-
ings. There is no reason for placing
another light within 100 feet of an ex-
isting one. I, therefore, recommend
that the petition be denied.

Entringer and Sanitary Officer Scherry
advising Board of Health that approxi-
mately 25 houses on Southern Avenue
are not connected with 'the sewer,
where sewer and water are both avail-
able, presented and read. Mr. Carl A.
Clark moved that the communication
be referred to the City Manager and
Water Superintendent for to try and
work out some solution of this matter.
Seconded by Mr. F. W. Thompson.
