City Engineer Gus Psihoyos is recommending acceptance of the Foye Street Curb &
Gutter, Sidewalk Replacement Project, as completed by Drew Cook & Sons Excavating,
Inc., in the final contract amount of $47,821.40, which is a 3.3% increase from the
original contract amount of $46,276.95.
The increase in cost is primarily due to the installation of 6-inch thick sidewalk through
most of the corridor versus the original 4-inch thick sidewalk. The thickness was
increased to minimize damage to the walks and the curb of the narrow street.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the construction contract for the
Foye Street Curb & Gutter, Sidewalk Replacement Project.
BACKGROUND
The Foye Street Curb & Gutter, Sidewalk Replacement Project provided for the
installation of curb, sidewalk, and pedestrian access ramps along Foye Street.
The project was awarded based on a competitive quotation process for public
improvements in accordance with Iowa Code, Section 26.14.
DISCUSSION
The Foye Street Curb & Gutter, Sidewalk Replacement Project was completed by Drew
Cook & Sons Excavating, Inc. of Dubuque, Iowa, in the final contract amount of
$47,821.40, which is a 3.3% increase from the original contract amount of $46,276.95.
The increase in cost is primarily due to the installation of 6-inch thick sidewalk through
most of the corridor versus the original 4-inch thick sidewalk. The thickness was
increased to minimize damage to the walks and the curb of the narrow street.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize payment of
the contract amount of $47,821.40 to Drew Cook & Sons Excavating, Inc. for the Foye
Street Curb & Gutter, Sidewalk Replacement Project.

ACCEPTING THE FOYE STREET CURB & GUTTER, SIDEWALK REPLACEMENT
PROJECT AND AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO
THE CONTRACTOR
Whereas, the Public Improvement Contract for the Foye Street Curb & Gutter,
Sidewalk Replacement Project (the Project) has been completed and the City Engineer
has examined the work and filed a certificate stating that the Project has been
completed according to the terms of the Public Improvement Contract and that the City
Engineer recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from
the Curb Replacement Capital Improvement Project and the Sidewalk Replacement
Program Capital Improvement Project appropriations for the contract amount of
$47,821.40 less any retained percentage provided for therein as provided in Iowa Code
chapter 573, and to pay such retainage only in accordance with the provisions of Iowa
Code chapter 573.
