Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the location of the property, the
former use of the property, and that the rezoning to C-4 Downtown Commercial District
will provide an added level of flexibility.
Staff reviewed the staff report, noting the history of the property, size of the parcel, its
relation to the existing C-4 District to the east, and surrounding land use. Staff noted
that the small size of the parcel limits the range of allowed uses even though the C-4
District may allow it.
There were no public comments.
The Zoning Advisory Commission discussed the request, and reviewed how the
rezoning to C-4 will provide flexibility. Staff reviewed the 50% revenue rule used to ,
distinguish between a restaurant and a bar. Staff noted there were two other I
restaurants within two blocks of the property. 'I
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

Regarding: Proposal for changing zoning from C2 to C4 for the building located at 1108 Locust St.
Dubuque, IA 52001
We've recently purchased the building at 1108 Locust St. previously known as the 'Naughty Dog'. We're
modifying the building and converting it to a full restaurant and bar that will cater to men and women
aged mid-twenties and older that are looking for a casual and fun atmosphere where they can have a
great meal, appetizer and/or drink, socialize with friends,and watch their favorite game on N. We'll
serve both lunch and dinner as well as a brunch on Sunday.
We'd like to change the zoning from C2 to C4 so that our business has the same zoning as the
restaurant/bars located one block away on Main Street and 11`h Street. The new zoning will allow us
more flexibility in appealing to patrons and ensure we can remain competitive with neighboring
restaurant/bars. Since our building is in very close proximity to these businesses already zoned C4 we
believe it makes sense to have our building under the same zoning category. Our neighborhood includes
the following restaurant bars, all of which are 1-2 blocks from our building:
• Salsa's 1091 Main Street
• L.May Eatery 1072 Main St.
• Jack's Lounge 1113 Main St.
• Jubeck Brewing 115 W. 11"'St.

Property History: The subject property was originally subdivided circa 1890 and a
three-story row house built on the lot in 1900. The property was rezoned to C-2
Neighborhood Shopping Center district in 2006 to permit the first floor of the residence
to be converted to a restaurant.
Physical Characteristics: The subject property is an approximately 2,300 square foot
corner lot located at the intersection of Locust and W. 11'h Streets in a mixed-use area.
The property accommodates an approximately 1,500 square foot building on three
levels that is built up to the lot lines along both street frontages and along the north
property line. The subject building is the southern-most of five laterally attached muiti-
family residences. There is no parking on the subject lot and on-street parking is
available on both adjacent streets.
Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote
infill and mixed-use residential and commercial development and recommends
buffering non-compatible uses from each other. The City's 2030 Future Land Use Plan
identifies this area as commercial/residential.
Impact of Request on:
Utilities: All City utilities are available to the property.
Traffic Patterns/Counts: IDOT 2013 Traffic maps indicate 7,100 average daily trips
northbound along Locust Street just north of the subject property.

Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment as
the site is fully developed.
Adjacent Properties: The adjacent property to the north consists of three-story
laterally-attached multi-family residential row houses. The other surrounding
property consists of the Carnegie-Stout Public Library, a parking lot, and the back
side of commercial buildings with upper story residential development that face
Main Street. The proposed rezoning should have little additional impact on the
neighborhood.
Staff Analysis: The applicant is requesting to rezone the subject property from C-2
Neighborhood Shopping Center district to C-4 Downtown Commercial district. The
property is an approximately 2,300 square foot corner lot located at the intersection of
Locust and W. 11'h Streets in a mixed-use area. The property accommodates an
approximately 1,500 square foot building on three levels that is built up to the lot lines
along both street frontages and along the north property line. The subject building is
the southern-most of five laterally attached multi-family residences. There is no parking
on the subject lot and on-street parking is available on both adjacent streets.
The property was rezoned to C-2 Neighborhood Shopping Center district in 2006 to
permit the first floor of the residence to be converted to a restaurant. The first-floor
business has been operated as a couple of restaurants and is currently being
remodeled into a new restaurant.
The applicanYs request represents an expansion of the C-4 district that brackets both
sides of Main Street across the alley from the subject property. The C-4 district permits
additional commercial uses that are not permitted in the C-2 district. Several the uses
listed in the C-4 district would not likely locate on the subject property due to site
constraints such as limited access, parking and building/lot area. In addition, some of
the more intense vehicle related uses in the C-4 district such as drive-through
restaurants and vehicle repair require that the Zoning Board of Adjustment review and
approve a Conditional Use Permit at a public hearing. i
Staff recommends the Commission review the criteria established in Section 6-1.1 of �
the Zoning Ordinance regarding granting a rezoning.
