came before a regular meeting of

Councilman Chalmers moved to
suspend the rules for the purpose of
allowing any one present in the
Council Chamber, whe wishes to do

An Ordinance authorizing and pro-
viding for the issuance of $6,000
Swimming Pool Revenue Sinking
Fund bonds for the City of Dubuque,
Dubuque County, Iowa, under the
provisions of Chapter 308-F1, of the
Code of Iowa, 1935, for the purpose
of defraying the cost of the con-
struction and operation of a munio-
ipal swimming pool, prescribing the
details of said bonds and providing
for the collection, segregation and
disposition of the revenue of said
swimming pool of said City for the
purpose of paying the cost of opera-
tion and maintenance thereof, pro•
viding an adequate depreciation fund
therefor and paying the principal
and interest of said swimming pool
Revenue Sinking Fund Bonds and
declaring an emergency; said ordin-
ance having been passed upon first
and second readings on May 25th,
1936, was presented and read a third
time.
ORDINANCE N0. 5-36,
An Ordinancf; authorizing and provid-
ing for the issuance of $6,000 Swim-
ming Paol Revenue Sinking Fund bonds
for the City of Dubuque, llubuque
County, Iowa, under the provisions of
CH:AI'TER 308-F1, of the CODE OF
IOWA, 1935, for the purpose of defray-
ing the cost of the construction and
operation of a municipal swimming
pool, prescribing the details of said
bonds and providing for the collection,
segregation and disposition of the rev-
enue of said swimming' pool of 'said
City' for the purpose of paying the
cost of operation trod maintenance
thereof, providing an adequate depre-
ciation fund therefor and paying the
principal and interest of said swim-
ming pool Revenue Sinking Fund Bonds
and declaring an emergency;
WHEREAS, it will be of great bene-
fit to the City of Dubuque and the
inhabitants thereat to have a modern
monicipal swimming pool erected in
said city; and
WHEREAS, a proper site is avail-
able therefor; and
WHEREAS, the Federal Government,
acting through its proper agencies, has
granted the application of the munici-
pal officials to construct a swimming
pool within said city, on condition that
the City expend certain funds for
spaoified purposes; and
WHEREAS, said City has no funds
available for such purposes but is au-
thorized to issue revenue bonds in an-
ticipation of the collection of funds
Erma the operation of said project, such
project being hereby declared to be
self-liquidating;
NOW, THNIREFORE, BE IT OR-
DAINED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA, as
follows:
SEC'PION 1. That the City Council
of tho City of Dubuque has heretofore
caused an estimate of the cost of such
monicipal swimming pool to be made,
and has heretofore and does hereby
determine that the total estimated cost
of such project is the sum of $60,000.00.
S]:CTIUN 2, That the City Council
does hereby determine the period of
usefulness of such swimming pool to
be twenty-five years.
SECTIUN 3, That to pay the coat oP
such swimming pool it will require the
issuance of Six Thousand ($6,000) Dol-
lar Swimming Pool Revenue Sinking
Fund Bonds, bearing interest at the
rate of lice (5%) per cent per annum,
payable semi-annually.
SECTION 4. That for the purpose of
defraying- the cost of building a munici-
pal swimming pool in the City of Du-
buque, as hereinafter set Torth, there
be issued and sold Swimming Pool Rev-
enue Bonds of said City, to be desig-
nated "SWIMMING POOL REVENUE
SINKING FUND BONDS" in the prin-
cipal amount of Six Thousand ($6,000)
Dollars, which bonds shall bear date
of June 1, 1930, bear interest at the
rate'of five per cent (6%) per annum,
payable semi-annually on the first
days of June and December in each
year, shall be numbered from 1 to li'0,
inclusive, earl shall be due and payable
on Jmre 1, 1940, provided, however, the
Crty shall have the right to redeem and
pay any of said bonds at arty tithe,
prior to maturity, whenever said City
shall have on hand in the "SWIMMING
POOL FUND" as hereinafter provided,
a surplus in excess of the interest re-
quirements upon the next two interest
payment dates. Said bonds shall be
called for payment by lot and notice
of its option to redeem said bonds itt
an amount to exhaust such excess
shall he given by publishing notice of
such call in the Telegraph-Herald, a
revvspaper• of general circulation in the
City of Dubuque, at least thirty (3U)
days prior to the date of calf and by
notifying- the last known holder of tite
bonds to be redeemed by registered
mail, after which time interest shall
cease on the bonds so called. The de-
nominations of these bonds shall be
Fifty ($50.00) dollars each.
SECTION 5. Both principal and in-
terest of said SWIMMING POOL REV-
ENUE SINifING BONDS shall be paY-
able in lawfid money of the United
States of America at the office of the
City Treasurer of the City of Dubuque,
Iowa. Sair] bonds shall be executed
by the D4ayor and the City Clerk and
sealed with the Corporate Seal of said
City of Dubuque and the interest cou-
pons attached to said bonds shall be
executed by the facsimile signature of
said Mayor and City Cleric, and said of-
ficials, by the execution of said bonds,
shall adopt as and for their own proper
signatures their respective facsimile
signatures appearing on said coupons.
Said bonds, together with the inter-
est thereon, shall be negotiable and
payable solely and only from the spe-
cial fund. herein provided for such
payment, and they shall not, in any
respect, be a general obligation to the
City of Dnbudue, nor shall they be pay-
able in arty manner by taxation, nor
shall said City be liable in any manner
by reason of the earnings being insuf-
ficient to pay the bonds or interest
thereon.
Any of such bonds may be registered
as to principal at any time prior to
the maturity in the name of the holder
on lire books of said City in the of-
fice of rho City Treasurer, such regis-
tration noted on the reverse side of the
bonds by the City Treasurer, and there-
after the principal of such registered
bonds shall be payable only to the reg-
istered holder, his legal representative

PRESENTS: that the City of Dubuque,
Dubuque County, Iowa, For value re-
ceived, hereby promises to pay to bear-
er (or if this bond be registered, as
hereinafter provided, then to the regis-
tered holder thereof) solely from the
SWIMMING POOL FUND of the City
of Dubuque, as hereinafter mentioned,
and not otherwise, the sum of Fifty
($50.00) Dollars, lawful money of the
United States of America, on the first
day of Jmte, 1940, together with inter-
est thereon from the date hereof until
paid, at the rate of five per cent (5%)
per annum, payable semi-annually on
the first days of June and December,
respectirely, in each year, upon pre-
sentation and surrender of the annexed
interest coupons as they severally be-
come due, beginning- with December
1, 1930. Both principal of and interest
upon this bond are hereby made pay-
able at the office of the City Treasurer
iu the City of Dubuque, Iowa.
Tltis bond and all other bonds of this
issue may be called far redemption and
payment at any time prior to matur-
ity. Notice of redemption shall be
made by publication in the Telegraph-
Herald, anewspaper of general circu-
]atinn in the City of Dubuque at least
thirty (30) days prior to the date of
redemption and by notifying by regis-
tered mail the last known holder of
the bonds to be redeemed, and, there-
after, interest shall cease on the bonds
so called for payment,
This bond is payable solely from rev-
enues derived from the swinuning pool
of said City of Dubuque and not other-
wise earl is issued under authority of
CHAPTER 308-F1. of the Code of Iowa,
]935, for the purpose of defraying the
cost of constructing and operating a
municipal swimming pool, and this
bond shall not in any event constitute
an indebtedness of said City rvithin any
com;titutional or statutory limitations.
Under said CHAPTER and the Or-
dinance adopted pursuant thereto, all
revenues from the operation of said
municipal swimming pool shall be de-
posited is a separate fund designated
as the "SWIiIiMING POOL FUND" of
said City, which shall be used only in
paying the cost of operation and main-
tenance of such swimming pool, pro-
viding au adequate depreciation fund
and paying- the principal of and inter-
est on the bonds of said City that are
issued under authority of said CI]AP-
TER and are payable by their terms
only from the revenue of such swim-
ming pool.
It is hereby certified and recited
that all acts, conditions and things re-
quired to be done precedent to and [n
the issuance of this bond have been
done, happened and performed in reg-
ular and due form of law, and that
provision has been made fot• deposit-
ing in said "SWIMMING POOL FUND"
al] revenues received from the opera-
tion of said swimming pool to be ap-
plied in the manner as hereinabove
set forth.
This bond may be registered as to
principal only, in the name oP the
holder on the books of said City in
the office of the City Treasurer, such
registration to be evidenced by nota-
tion hereon by the City Treasurer after
whlclt no transfer shall lie valid un-
less made on said books and similarly
noted hereon, but it may he discharged
from such registration by being trans-
fert•rd to bearer, after which it shall be
transferable by delivery, bttt it may be
again registered as before. The regis-
tration of this bond shall not restrict
the negotiability of the coupons by de-
livery merely.

Section 7. That upon the issuance
of such Swimming Pool Revenue Sink-
ing Fund Bond herein provided for,
the Swimming Pool of said City ' of
Dubuque, far the purpose oY this ordi-
nance, shall be operated on a fiscal
year basis commencing the first day of
April and ending the thirty-first day of
March of the succeeding year. There
shall be installed and' maintained a
proper system of accounts showing the
amount of revenue received from such
pool and the application of the same.
At least once each year such accounts
shalt be properly audited and a repprt
of such audit shall be open for public
inspection at all proper times. From
and after the delivery oP any bonds is-
sued under the provisions of this ordi-
nance, all revenues from the operation
of such pool of said City shall be set
aside as collected and be deposited in
a separate fund which is hereby cre-
ated, to be designated as the "Swim-

ming Pool Fund" of the City of Du-
buque, which shall be used only in pay-
ing the cost of operation and mainte-
nance of said pool providing a proper
and adequate depredation fund ae
hereinafter set forth, and paying the
principal and interest upon the Swim-
ming Pool Revenue Sinking Fund Bond
of said City that are payable by their
terms only from such revenues and each
Fund shall be used only for such pur-
poses.
It is hereby determined that the
amounts to' be set aside in said Swim-
ming Pool Fund for the purpose of pay-
ing interest on said bonds as it be-
comes due and for the purpose of cre-
ating asinking fund for the payment
of the principal of said bands at ma-
turity, shall be as follows; the same

Distribtttion of the amounts in Bald
fund sufficient to cover the above re-
quired sums for interest on Bald
Bonds, for the purpose of creating a
sinking fund for the payment of prin-
cipal of said bonds at maturity, for the
purpose of paying the cost oY operation
and maintenance, and an adequate de-
preciation fund, shall be made month-
ly on the first day of each month.
Said Fund, as hereinabove provided
for, shall be user) solely and only, and
is hereby pledged for the purpose of
paying the principal and interest of the
bonds herein authorized, the cost of
operation and taintenance and to pro-
vide an adequate depreciation fund;
which depreciation fund shall be ac-
cumulated at the annual rate of at
least one-half of one per cent (~ of 1
%a) of the value of said pool.
If in any fiscal year said City shall
Pail to set aside the full amount herein
provided far any of the purposes speci-
fied, then an amount equivalent to
such deficiency shall be set aside from
the first available revenue of the follow-
ing fiscal year or years.
Any surplus accumulated in said
FUND in excess of the cost of opera-
tion and maintenance, the amounts
necessary for the creation of a depre-
ciation fttnd, and to pay the interest
on said bonds and the sinking fund
for the payment oY principal of the
bonds at their maturity, in excess of
an amount necessary for payment of
interest on said bonds for the next
two succeeding interest payment dates,
shall be used solely and only for rho
purpose of calling and paying the
bonds issued under the provisions of
this ordinance prior- to their maturity
in accordance with SECTION 4 hereof.
GF'Iten any bonds are called and re-
tired before maturity, as herein provid-
ed for, the requirements for interest
and sinking fund shall be correspond-
ingly altered and modified so as to
provide for the payment of interest
and principal to comply with the ad-
justed ceudition.
Section 8, While the bonds author-
ized hereunder, or any of theut, remain
outstanding or unpaid, rates charged
for use of the facilities of said pool
shall be sufficient at all times to pay
the cost of operation and maintenance,
to provide a proper and adequate de-
preciation fund and to pay the interest
and principal on the bonds issued
hereunder.
Section 9. Any holder- of a bond or
bonds or any of the coupons of any
bond or bonds issued hereunder may,
either in law or equity, by suit, action,
mandamus or. other proceedings, en-
force or compel performance of all
duties required by this ordinance or
the law under which the same Is
passed, including the establishing and
collecting of sufficient rates or charges
for the use of the facilities of said
pool and the application of the income
and revenue thereof.
Section 10, The City of Dubuque
hereby convenant~s and agrees with the
holder or holders of the bonds herein
proposed to 3~e issued, or any of them,
that it will punctually perform all
duties with reference to said swim-
ming pool required by the terms of this
Ordinance including the making and
collecting of sufficient charges for the
use of the facilities of said pool and
segregating the revenues of said pool
and the application of the respective
funds created by this Ordinance and it
hereby cohvenants and agrees not to
sell, lease, loan, tnortgage or in any
manner dispose of said pool, including
and all extensions and improvements
that may be made thereto, until all of
the bonds hereon authorized to be
issued shall have been paid In Lull,
both principal and interest; and the
City further convenants and agrees
with the holders of said bonds to oper-
ate said swimming pool and ntalntain
it in good condition.
Section 11. That the Proceeds of Bald
bonds herein authorized derived from
the sale thereof, shall be applied on
the cast of constructing and operating
a swimming pool in the City of Du-
buque in the Eagle Point areas and
other incidental expenses, together
with interest to a date six months sub-
sequent to the estimated date of com-
pletion oP the project, said construction
to be done in accordance with plane
and specifications heretofore prepared
for said pool and now on file for publla
.inspection.
Section 12. That said bonds shall be
sold in such manner as the City
Council shall hereafter determine, pro-
vided, however that the selling price
of any of such bonds shall be such
that the Interest cast to the City of
the money received from such bond
shall not esceed six per cent (6%) Per
anmm~, complete to maturity, accord-
ing" to standard tables of bond values.
There shall be deposited in said
SWIMMING POOL I~'UND out of the
first proceeds from the sale of said
bonds, hereby authorized, the sum of
Three Hundred ($300.00) dollars for the
purpose of paying the interest on the
bonds hereby authorized for a period
of twelve months, being the amount
necessary to pay interest on said bonds
to a date six months subsequent to the
estimated date of completion of said
pool
Section 13. If any section, para-
graph, clause or provision of this
Ordinance shalt be held invalid, the
invalidity of such section,' paragraph,
clause or provision shall not affect any
of the other provisions of this Ordi-
nance.
Section 14. All ordinances, resolu-
tions or orders or parts thereof, in
conflict with the Provisions of this
Ordinance, are to the extent of such

conduct hereby repealed.
Section, 15. This Ordinance, being
deemed urgent and for the preaerva-
tlon of the peace, health and safety
of said City and its inhabitants, shall
be in force and effect from and after
Its final passage, adoption and ap-
proval and publication as provided by
law.

requesting that the City Council in-
vestigate the dangerous nuisance of
harboring snakes by Edward Huber
at 760 Angelha Street, presented and

Mr. Edward Haber addressed the
Council stating that none of his
snakes have aver escaped, and the
snakes complained of in the petition
were being driven from the rock
quarry due to the blasting of rock
in the quarry.

Gentlemen: Dr. W. J. Connell, Di•
rector of Health, and the writer
have been discussing recently the
general Milk Inspection Plan.
Originally, as the Milk Inspection
Ordinance tivas adopted on October
7th, 1935, it was estimated that the
rate of one cent per 100-weight for
all mills delivered in Dubuque would
be sufficient ~to cover the operating
costs. For a few months we had con-
tributions from the Federal Market
Administratign equal to approxim-
ately $50,00 per month. This contri-
bution was eliminated in February,
1936.
Attached is au estimate as pre-
pared by the local Milk Inspector,
Mr. V. F. Chapman. He states that.
at present the revenue for this fiscal
year will amount to approximately
$1,300,00. The Budget for 1936.37
includes expenditm•es equal to
$1,900.00, In order to provide over
30% of the estimated non-available
revenues, it is suggested that con-
sideration by the City Council be
given to this question.
One suggestion included in a let-
ter from Mr. Chapman, attached
hereto, is on the basis of establish-
ing a minimum yearly fee of $20.00
for all mint service.
Another method pf increasing row
cone might be to increase the rate
per 100 lbs. of mills from one cent
to one and one-half cents.
However, if the determination of
the Council is that nu increase in
mills charges is to be made at prea•
ent, the reserve balance in the Con-
solidated Fund may partially be ap•
plied to the Mills Inspection Depart-
ment.

Be It Further Resolved that the

completed on or before the 1st day
of August, 1936.
Be It Further Resolved that the
cost of the construction of said im•
provement be assessed against Lot
No. 4 of Jackson School Subdivision
in the City of Dubuque and said
assessment shall be paid at one time
or in ten annual installments, as
provided by law.
This resolution, being deemed urg-
ent and of immediate necessity,
shall be in effect from and after its

your decision made Juno 2nd that
the bells at the Fourth Stt•eet rail-
road crossing were not necessary
and, due to the serious objections
filed, said bells were ordered by the _
Council to be eliminated, please be
advised as follows:
The City Manager wrote to the
Iowa Board of Railroad Commission-
ers at Des 111oines June 3rd, advis-
ing them of these serious bell ob•
jectiens and the decision of our
Council. Today Mr. Franklin, the En-
gineet• of said Board, and two other
offtcials from the railroad companies
came to my offtce, The officials ex-
amined the filed protests, discussed
the questions with our Polico De-
partment and finally made the deci-
sion that the Fourth Street cross-
ing bells were to be eliminated at
once,
Another question was discussed
regarding contemplated plans of in-
stalling other bells at 13th, 14th,
15th, etc., crossings. The writer rec-
ommended that at least now no oth-
er crossing bells be considered, I
further stated that, if necessary at
any future time, the Council would
make decisions and advise the Rail-
road Commission and railroad com-
panies in regard to any additional
equipment that was required. It is
my belief that now no other bell in-

stallations are being planned at any
other railroad crossings.

presented to the writer at noon to-
day whereon requests wet~~ made i'or
immediate approvals which had to
be made by the City Council. Three
of the Council members were con-
tacted and they approved the two
questions on the following condi-
tions-
(1) Use of City Land for Circus an
June 20th,
A member of the Fraternal Ordor
of Orioles verbally inquired and
later ou the same day filed the at-
tached petition signed by an ofilrial,
viz., Mr. Geu. D. Wybrant, Treas-
urer, requesting the right to use the
City owned land outside of and
northwest from the Fourth Street
Doll Parlt on the day and evening of
Saturday, June 20th, 1936, without
rental charge. The purpose of this
use is fora circus, designated the
Rice Brothers' Dog and Pony Show,
The circus is to provide a certain
dnnation to the Oriole Fraternity,
The agreement, as determined, was
that the use of the land vas to be
permitted without any rental fee,
but the Rice Brothers were to pay
to the City the regular one-day lic-
ense fee amounting to $50,00 for the
right to hold their Dog and Pony
Circus, within the City. The $50,00
fee was approved by the advance
agent of the circus. No. other date is
scheduled this day or night at the
Ball Park.
(2) Right to Install Well, Etc., at
Trausch Bolting Ce. Sidewalk.
Mr. James W. London of Mullen
Brothers ~; Co., Plumbers, presented
a request for the right to install a
well and equipment under the west
sidewallt space at 19-31 Main Street,
in front of the Trausch Batting Com•
pony, The conditions of this well
installation were that a small sec-
tion of the present concrete side-
wallt was to be temporarily tern out;
the well was to be drilled by Mr.
C. W. Varner of 2054 Marshall
Street, Dubuque; the well was to be
piped and sealed and the depth of
the well was to be 120 feet. The
equipment, fn addition to -the well,
includes also a 4' x 8' round, extra
heavy, steel tanlt to be installed in
ground under the sidewalk for the
purpose of water storage and also a
5'x T reinforced concrete vault area
of a height of 6' to provide an elec•
tric pump space also under the side-
wallt. The ceiling over this pump
vault is to be heavily reinforced and
the top will be on the grade of the
present adjoining sidewalk, A 30"
diameter manhole cover is to pro-
vide entrance into this pump vault
from the sidewalk. The vault under
this sidewalk will be located next to
the property line and shall not be
closer than at least 2' from the curb.
The purpose of this installation
under the sidewallt is to provide for
an air-conditioning and cooling sys-
tem at the Battery. No cellat• is un-
der the Bakery building. The `yell
drilling equipment could not be oper-
ated within the building,
Attached is a plan of the condi-
tions of construction details as pre-
pared by the Building Commissioner.
The agreement as made orally by
the three Councilmen included the
right to install the above mentioned
equipment under the sidewalk on
conditions that above -the sidewalk
level no obstructions nr hazards
were to exist; further, that the own-
er oY the Baltery was to be respons-
ible for any and all damage in case
of brealtage, settlement, etc., of the
sidewallt ot• street due to said con-
struction and location of the pump
vault under this city sidewallt.
In case your final approval is of-
ficially made, particularly on this
second case, it is suggested that the
definite approval, subject to condi-
tions, be made on the Council
records,

Inasmuch as the desire of this
church committee is to quicltly erect
this sign, and since previous per-

Gentlemen: Attached is a report
of the .yearly comparison of gross
and net total bonded indebtedness
of the City of Dubuque. This report
includes the years 1919 to 1936, as
of the April lst date, Prom April 1st,
1928 to 1936, the total net indebted-
ness has been reduced by $476,31G.27.
The net indebtedness in 1919 was
$1,1.33,782.00. Since then a grand
total of bonds equal to $1,242,563.00
was issued. As of April 1, 1936, the
net total indebtedness was $1,397,-
666.31, which amount is only ,$263,-
884.31 in excess of the 1919 record
in spite of nearly lr/4 million dollars
Laving been issued since 1919.

Gentlemen: Recently many objec-
tions have been filed with the wrt•
ter regarding parking of cars, trucks,
etc., on Sixth, Locust and Bluff
Streets in front of and near the Post
Office site. Local citizens object to
many people leaving their cars in
front of or at the side of their prop-
erty far the entire day, Others com•
Ing to the Post Office cannot find a
place to leave their cars fora min-
ute or more while they must enter
the Past Office.
It is suggested that consideration
be made by the City Council in re-
gard to amending the Parking Ordin-
ance to include one Lour parking in
day time for. the entire area of
streets adjacent to the busy Federal
Building. Also on Eighth Avenue be•
tween Locust and Bluff Streets.

the appeal from Mr. John Mayerle
oY 400 Central Avenue to I•epay him
the $3,20 fee charged to him and
paid by Mr, llTayerle to the Mullen
Bros. & Company, please be advised
as follows:-
Mullen Bras. were called to hie
building on April 16th. The plumb-
er attempted to drain the flooding
water from his basement but could
not, due to several feet of excessive
water in the sewer main and man-
holes on Fourth Street west aY the
railroad tracks.
The city sewer department was
advised at this time oY the Page
Hotel, Canfield Hotel and several
other basements near there being
flooded. The river stage was then
about 16 feet. This sewer system
should have drained into the river,
even at this 16 foot stage, but near
the discharge point below the City
Harbor a great amount of heavy
sewage in this sewer cauacd a con-
gestion and the water in the man-
hole rose as high ae within two
feet oY the street paving level of
East Fourth at White Street.
By tapping a manhole' near the
rivel• front this excessive sanitary
sewage head was finally lowered.
However, another congestion -still
existed south of East Fourth Street.
This was also eliminated after con-
sldereable work,
Accordingly, the flood in Mr. May-
erle's basement was not due to his

own sewer, but from stoppage of
the main city sewer,

advised that a delinquency in spe-
cial asaessmenta has resulted far
years due to his inability to pay
yearly payments for the paving of
West 17th Street, including his va-
cant Lot 13 of Yate's Sub,
The original assessment on this
Lot 13 for the paving of West 17th
Street as levied October 14, 1929,
was $249.66. Three payments, in.
eluding principal of $74.92, are re-
ported paid by Mr, Otto Puls, City
Treasurer. The balance of this prin•
cipal is $174,74,
From records received from the
County Auditor the total unpaid
principal, interest and penattitee cu
date equal $263.73.
Mr. McMullan requests that since
this is still a vacant lot, but he de•
sires to continue the ownership of
same, that authority be made by
the City Council for him to pay the
balance of the principal plus 6% in-
terest on said amount still due, Mr.

Gentlemen: Today Mr. Isaac Wy-
burn, who lives at 110 Southern Av-
enue, (Lot 8 of Randall Sub.), made
a verbal statement that be would
purchase the two small lots south
of his home, the said lots now owned
by the City, for a total of $100,00
in cash, This proposal includes the
purchase of Lot 9, which is 50 ft, in
width and approximately 65 ft. in
depth, and Lot 10, which averages
43 ft. in width and about 56 ft. in
depth, Tho total approximate area
of those two combined lots would
be less than 5700 sq. ft. Lot 11,
which faces Southern Avenue south
of Lot 10, extends in the rear to-
ward the north and includes an ap•
proximate 50 ft, width in rear of
both Lots 9 and 10.
Lots 9 and 10 were owned by the
Nagle Estate in 1927, After the san-
itary sewer was constructed on
Southern Avenue and no payments
were made by the owner of these
lots, the City assumed the title of
the same. On August 1, 1931, when
the City actually acquired these two

Last week a request was made for
a price on certain of these lots. The
writer quoted the Council authoriza•
tion as made to me on November 7,
1932, that any and all of these lots
could be sold at the rate of $,25 per
square foot, The rate of $.25 per
square foot was practically dehied
on this day and a request was fur-
ther made to determine whether a
lower rate could be authorized.

It is suggested, as variations in

Lot 8, facing East, 4th Street, was
sold at $.20 per square foot. If the.
additional City owned lots, facing
4th Street were also authorized to
be sold at $.20 per square foot, in•
eluding Lots 3, 4, 6, 6 and 7, the
total areas of 30,825 sq. ft. would
yield $6,165.00. Then if Lot 9, which
has a 40 ft. frontage on East 4th
Street, but the large at~a is north
thereof; were listed at $.18~ for the
area of 17,400 aq, ft., this sale would
yield $3;219.00. Also Lots 10 and
11, of 26,880 aq. ft. area, at $,175 per
square foot, would yield $4,704.00.
Accordingly, the total money receiv-
ed for all lots, at the above men•
tinned prices, would equal $25,488.00
or slightly more than $1,800,00 in
excess of the coat to the City. (No
interest is included).
If at all possible, the writer sug-

lots would not interfere with the
parking space at the Ball Park. This
area is entirely wort of East 6th

on May 4th for the consideration by
the City Council to determine wheth-
er or not a new sidewalk should
be ordered to be installed on the
south side of Stanton Street between
Rhomberg and Lincoln Avenues,
The City Council members viewed
this site June 19th. A proper side-
walk is now installed on the north
side of this street, Mr. H. A. Un-
macht and Mr. Weber had previous-
ly stated that on the sides of their
properties facing Lincoln and Rhom-
berg Avenues there was apparently
no requirement for any sidewalk as
no houses faced Stanton Street in
this black and very few people
walked on Stanton Street,
The determination of the Council
members was that no new sidewalk
should be ordered installed at pres-
ent on the south side of Stanton
Street between Rhomberg and Lin•
coin Avenues.

Gentlemen: A letter was received
on June 16th from Mr. E. A. Beiler
requesting that authority be granted
by the City Council to provide pro-
per correction to the curb and gut-
ter and then to permit diagonal
parking on the north side of West
7th Street in front of the Elks' Club,
The Council members viewed this
cite on June 19th. The decision
was that cars could park diagonal•
ly south of the Elks' Club; that a
yellow line was to be painted at the
middle line of the present 16 foot
wide concrete sidewalk, providing
for a full 8 foot width of sidewalk
north of this painted line for ped_
eatrian use.; that the Elks' Club of-
flciala were to provide sufficient
amount of asphalt, etc., to fill ap•
proximately 6p% of the present con-
crete gutter and the City Street De-
partment was to install said mater-
ial in a proper manner so as not to
block any gutter discharge. By a
check on said parking provisions it
was determined that approximately
11 care could park diagonally, where-
as now only five cars can park par•
allel to the curb .and that by diag-
onal parking, partially on the south
half of the present wide sidewalk
and also on 7th Street south of the
curb, that cars would not extend
farther into 7th Street than present
parallel parked care do.
The Council determined also that
no maintenance or repairs were to
be made in the Future by the City
in case of damage done to the pres-
ent Elks' Club concrete sidewalk
where parking might damage said
concrete.

Wm. Metcalf of 1993 Hale Street,
filed May 25th, to have the west end
of $ale Street repaired from the
hallow bet`veen Grandview Avenue
and Algona Street was considered
and viewed by the Council June
19th.
This street has not been improved
as yet this year. Very shortly the
same will be rolled, smoothed and
put in better shape, The Council de-
termined that this portion of Hale
Street was not now in a serious or
dangerous condition and that the
same maintenance should be con•
tinued as in past years. The surface
water does not wash out this sec-
tion of Hale Street near Algona as
it did formerly on the east end near
Grandview Avenue where tarring
was necessary. No available funds
are on hand this year for tarring
thin section of Hale Street,

Gentlemen: The City Council con•
sidered the complaint filed June 2nd
by Mr, George J. Mehl, etc., in re•
Bard to the storing and harboring of
snakes by Edward Huber at 760 An•
Bella Street, On June 19th the Conn•
cil viewed this situ, Mr, Huller
stated that no snakes had escaped
from his storage shed.
All of the few snakes now being
kept by Mr. Huber are n'on-poison•
ous, are safely stored in proper show
cases, boxes, etc,, and are not dan•
gerous, Practically all of these rep-
tiles were handled this day by this
young man.
The decision of the Council was
that young Mr. Edward Huber could
at least temporarily continue to pro-
vide proper storage of these non-
dangerous snakes, etc., but that he
could not include the securing and
storage in the city of any copper-
heads, rattle snakes or any type of
dangerous reptiles, etc„ and that he
must never permit said present or
future snakes, etc., to escape,

curb level. The wall is approximate-
ly at the property line of the east
side of Madison Street,
The decision of the Council was
that the City Street Department
should tear dawn the present atone
wall, move the wall back to a solid
area from 4 to S feet east and re•
build the acme to provide protection
to the ground above Madison Street,
and prevent the breaking up of this
hazard in case of heavy rain,

Gentlemen: On June 19th the City
Council viewed Angella Street south
oY West Locust Street. A verbal
request from Mr. James, Lee had
been filed with City officials two
days previous to widen Angella
Street by replacing the west curb
opposite Mr. Lee's entrance to his
storage yard. The plan of widening
this street by moving the west curb
to near the east edge of the pres-
ent concrete steps leading up the
hill was for the purpose of provid-
ing sufficient width in said street to
enable Mr. Lee to remove his large
equipment from his land.
At present no sidewalk is on tho
west side of Angella Street from
West Locust Street to the bottom of
the steps. Grass and flowers are
planted by the owners on the west
side of Angella Street on the street
area west of the present curb.
Mr. Lee discussed his request with
the City Council members and ad-
vised that the parking of cars from
Tneker & Luthe, Auto Painters, at
430 West Locust Street, had ser•
iously interfered with getting in and
cut of his storage site. Mr. Tucker
of the Tucker & Luthe Co, also re-
quested Council to make no changes
in the present curb location.
No decision by the Council was
made in this disputed question.

Gentlemen: A request for a new
street light to be installed and addi-
tional consideration for requested
new sidewalks at and near Burling
ton and National Streets was filed
May 25th. The Council determined
to investigate this site and viewed
the same on June 19th,
Two present street lights at bath
intersections, including Muscatine
and National Streets 8nd Burlington
and Primrose Streets, are fairly
close to this area, where but few
people live. It was determined that
the light at Muscatine and National
Streets was proper, that practically
no trees interfered with this ligltt
less than 300 feet from this specified
intersection, However, the light now
installed and attached by a bracket
on a pole at the southwest corner
of Primrose and Burlington Streets
is not near the middle of this inter-
section. At this present location sev-
oral large trees on the west side of
Burlington Street, north of Primrose
Street, interfere with this light ser-
vice, Accordingly, the Council mem-
bers determined that no additional
light was necessary, but that instruct
tions Suers to be given fo the Inter-
state Power Company to move the
Primrose and Burlington light to the
east aide of this intersection where
present trees would not interfere
with lighting service on Burlington
Street.
In regard to the request for side•
walks at this area, the Council mem-
bers determined that it was not ad-
visable to order the installation of
any new sidewalks at present due
to the fact that the streets are not
fully graded and by the installation
of sidewalks considerable variation
in surface of the ground and side-
walks would result in falls, non•
elimination of surface water, eta

The Council made no decision to
sell this property until the Same
could be investigated again. Accord-
ingly, an June 19th this property
Was investigated by the Council
members. It was determined that
the exterior of the house needed cer~
fain repairs, but that the inside of
the same building was shill in fair-
ly good condition. No serious dam-
ages have occurred since the pity
acquired this property.

was that this land and house should
