June 30th relative to the present
status of Lot No, 1, Mill's West Du•
buque Subdivision to Dubuque
which was handed to me for investi•
gation and report, beg to advise as
follows.
On March 13, 1929, the City of
Dubuque levied against the afore-
said lot in the sum of $68.78 for a
sewer in Green and Aveca Streets,
called Fund No, 809. As nothing had
ever been paid on this lot for this
sewer it was advertised for sale at
the scavenger sale held at the Court
House and sold on April 13, 1936,
to Mr, Lundin for the sum of $1.00,
Mr. Lundin also purchased this lot
at the regular tax sale for $3.29 the
amount of regular taxes, I would
like to suggest that it would be ad•
visable to get in touch with Mr. Lun•
din who could furnish an estimate
oa the amount required for redemp•
iron.
I have been advised that at the
time of the scavenger solo the total
amount was $112,00-this included
penalties, interest, advertising costs,.
etc. At the present time, figuring
on $1.00 per month, extra penal-
ties would make the total approxi•
mately' $115.00.

Gentlemen: An investigation hoe
been made regarding the sewer
trouble at the property of Mrs: Jane
Dougherty at 984 Mt. Loretta Ave.
Two bills were- submitted on June
30th to the Council by Mrs. Jane
Dougherty including a request that
the City refund to her the first bill,
dated May 12th, of $18.42. This bill
has been paid by her to the plumb-
ers on May 19th. Mrs. Dougherty
also requested that the City pay to
the Qurtis•Straub Cd, the second
bill, dated June 8th, amounting to
an additional $44.7Y, Her basis of
requesting the City to• pay both of
these two bills was because of her
determination that her sewer con•
section pipe was all proper and not
broken, but that the entire trouble
was at her "Y" connection at the
city main sewer 'which had broken
off and her lateral had-sunken and
was clogged just at the main sewer.
The city main sewer was not clog-
ged and no other sewer connections
above this location were in trouble.
1n constructing sanitary sewers,
the City assessed to property own•
ers the entire main sewer cost and
each "Y" connection to individual
owners. The contractor is respon•
sible to the City for two years, after
completion and acceptance, of the
main sewer and ail lateral connec•
irons, including "Y's" or "T's", etc.
In this case the maintenance period
had expired in 1926, Now it falls
upon the City to care for emergency
breaks or necessary repairs in main
sewers or "Y" breakage.
The first plumbing work on May
12th was not reported to the City,
No city oficiala knew of any trouble
at this location, No work at this
period was performed at or near the
main sewer. Apparently the City
is not responsible for this first bill
as the plumber and owner believed
that the trouble had then been elim•
footed at the riser.
However, the second bill of $44.71
was caused by plumbers working
while city officials had been advised
and were there to see the actual
conditions, including the break of
the "Y" connection. The City in-
stalled two new 8 in. main sewer
pipes and a new "Y" at the City
cost but the real cost of $44.71 was
duo to Curtis & Straub having exca-
vated clear down to the 18 ft. deep
main sewer area, prior to the City
repairing this main.
Subject to the legal opinion on
this question, the decision should
be made by the City Council: It ap•
pears to the writer that the City
should pay for the Coat of excava•
iron and analysis of the actual break
at the "Y" branch, which totals
$44.71 and is due to Curtis & Straub,
.the plumbers.

Dubuque,. Iowa.
Gentleman: A serious attempt
has been made by city olTicials for
some time. to eliminate 11 prior
cross•connections at various indus-
trial locations in our city. Thus
far 10 of the 11 cross•connections
have already been eliminated. ~ The
present remaining one, at the Ad•
.ems Co. plant south of East Fourth
Street, is now agreed to be elim-
inated.
Accordingly, within a short time
after this last remaining river haz-
ard is removed, our city shall be
allowed to furnish regular city water
to regular railroad coaches. Also
proper signs can be erected on high-
ways, at or near thz city limits, in•
viting strangers to use city water,
which will now be approved by the
State Health Department.
The danger in these previous river
gross-connections would have result-
ed if the city water pressure was
low at any time and the non•purifted
river water was being pumped to
any industry, The river water would
then be forced from the industry
into the city mains and would be
mixed with our pure water supply.
This mixture would surely result
in typhoid fever and other serious
epidemics among our citizens, where
any of this non•purified mixture
could enter homes, etc.
This elimination of river cross~
connections has been recommended
and demanded from the State De•
partment of Health.

sion to extend the width of a present
garage by six feet additional, please,
be advised as follows:
This property is at the southeast
corner of Locust and Weat 10th
Streets. The lot is designated ae
the N. ~/z cE N, 1.5 of Gity Lot 474.
The size of this lot to 25.6 ft. wide,
along Locust Street and 114 ft. .in
depth along Vilest 16th Street. The
ownership of this lot is listed under
the name of B. H. Chamberlain.
Within 12,7 ft. from West Locust'
Street there is erected on two. por•
tions of this double lot a two story;
brick double house. Half of ibis
double house is not located on the
north portion of the lot and not
owned by Mrs. Chamberlain,
Attached is a sketch of the pres-
ent location o>r the home and frame
garage.
The present frame garage is at
the edge of and ,20 ft. along West
16th Street and approximately 14
ft. wide along the alley between
Locust and Main Streets. The de-
sire is to have .authority to extend
the present frame garage 6 ft. south-
ward. This new south wall would
be about 5 ft. north of the south
property line of Mrs: Chamberlain's
property.
At the rear of the other ~ of N.
1.5 of Lot 474 there is now erected
a one story, two car, file garage
20 ft. by 20 ft. This :garage is ap-
proximately 9 ft. south of the Cham-
berlain ,property. No present gar•
ages are located across the alley
south of the Chamberlain property.
A one-story frame rear porch is
located aeuth of both halves of this
double house. This double porch is
approximately 13 ft, long by 4.6 ft.
wide. At present the closest cor•
ner of the present frame garage is
about 7 ft. from the southeast cor•
ner of this frame porch, In case
the frame garage ie widened 6 ft.,
then several feet of the new garage
west wall will be within 5 ft.,of this
frame porch on the Chamberlain
section of the lot.
Apparently the only new hazard
at present, if this frame garage were
widened 6 ft., would be the rear
frame closed porch on the Cham•
berlain property 6 ft. distant.

Gentlemen:. As you at•e about to
begin your consideration of the Tax
Budget for the fiscal Year, 1937, I
consider it advisable to submit to
you the results of my examination
of the condition of the' Special Im-
provement Bond. Funds and the de-
mands which will be made upon it
on April 1, 1937. You Tecall that
an April 1, 1936, ,$40,000.00 of Im•
provement Bonds matured,, and these
bonds defaulted due to the fact that
assessments levied were not paid,
These bonds were cotvverted into a
judgment, and the judgment was
subsequently funded by the issuance
of. Funding Bonds. As I view the
situation now, there is likely to be
a repetition of this condition in
April, 1937, unless something is done
to prevent it. The situation is as
follows:
Bonds aggregating $75,600.00 are
outstanding, $1,100.00 of which ma•
tared on April 1, 1935, $6,100,00 on
April 1, 1936, and $68,400.00 will
mature on April 1, 1937, The bonds
which matured in 1935 and 19,36
were not .presented for payment,
and, although they do not carry any
interest after maturity, the principle
thereof must be paid when the same
are presented by the owners. The
bonds which mature in April, 1937,
bear a 5% interest rate, payable
semiannually on October 1 and
April 1. The interest which Ne•
comes due on each of these semi-
annual dates is $1,710:00.. T h e s e
bonds are 'payable from the funds
created by the payment bf special
assessments,
The City Treasurer has prepared
for me a statement of the funds
against which there are outstanding
bonds. It appears from this that
there are no bonds against any fund
pricy to Fund 773, although there
are unpaid assessments in funds
back as far as Fund 344. In many
of these funds prior to Frrnd 773,
assessments are being paid, thereby
creating what might be termed "free
money," that is, money available
for the payment of bonds- and in-
terest outstanding in Fund 773 and
funds subsequent thereto.
A record which I prepared in
April, 1936, showiug delinquent as•
aessments as of November, 1935, re•
veals the fact that. there was ap-
proximately $12,500.00 unpaid at that
time in funds prior to Fund 773.
There are some funds subsequent
to Fund 773 in which there are no
bonds outstanding, but there remain
unpaid assessments. The Auditor
has submitted to .me a statement
showing March and April, 1936, col-
lections of funds. against which
there are no bonds outstanding.
These collections amounted to
$3,600.92. No doubt additional col-
lections will be made i^ these funds
during the year 1936, and the more
money that can'be collected there-
in the more "free money" will be
available to pay interest and prin-
cipal on bonds which mature do
1937 and subsequent years.
In 1934 the City refunded X50,000
of Special Improvement Bonds. In_
eluded in this issue was approxi-
mately $39,000.00 of bonds which
were payable from funds prior to
Fund 773. These Refunding Bonds
are now known as Fund 943,

In April, 1936, $1000,00 of tie
bonds matured but were not pre-
sented for paynrentti and $5,000.00
mature in April, 1937. -These bonds
should be called and paid as prompt-
ly as possible. Therefore, I make
the following recommendations as
to all funds prior to Fund 773:

1. That the Auditor be instructed
to credit such funds with all col•
lections as they are made, and af•
ter such eredita are made to trans-
fer such collections to Fund 943,
indicating upon the records in such
funds the fact of such transfers as
ordered by the City Council, until
such Fund 943 has sufficient money
in it to pay the bonds and interest
maturing in April, 1937, and the
bonds which mature in 1936,
2. That the Treasurer be in•
strutted to call for payment, from
time to tints as sufficient funds are
available in this fund, such refund-
ing bonds, thereby stopping the t~-
terest,
3, When sufficient money has
been thus transferred and if the
collections in funds prior to Fund
773 are in excess of such require-
ments, then the Auditor be directed
to transfer to other funds wherein
the assessments will not be suffi-
cient to pay the bonds maturing
in such funds in 1937, as will be
hereinafter again referred to..
4, That the Manager proceed at
once to; determine the present. de-
linquency in all such assessment
funds. When that is determined,
then that be set in motion a plan
to. collect all, assessments delinquent
in all funds prior to Fund 773, tliere•
by building ,up these "free money"
funds and make them available for
transfer,, as stated. Unless these col-
lections are made dm'ing the sum•
met and fall. months, it is likely
they will not be made at a]C I be•
lieve a great amount of delinquent
assessments can be collected if the
proper approach is made to property
owners and if a reasonable propo•
sition of compromise is submitted.
A great many people have been paid
bonus money, and if an adjustment
of these tax liens is offered to them,
many of them will use their bonus
to save their homes.
Up to this tints I have discussed
largely the disposition of funds pri-
or to Fund 773 and the proposed
transfer to 1''and 943. I find that
in Funds 777, 790, 792, 793, 794, 804,
807, 815, 836, 837, 840 and 884 there
are no outstanding bonds, but col•
lections 'have been made therein in
March and April, These collections
and if any further collections are
made therein that they be trans_
ferred in the same manner as is
recommended for funds prior to 773.
.The Auditdr has submitted to me
a statement showing March and
April, 1936, collections in funds be•
ginning with 773 (exclusive of the
funds I have above enumerated)
and ending with Fund 950. These
collections total $29,012.00. Addi-
tional collections will be made in
these funds during the current.year,
but it `is hardly. reasonable to ex•
pect that the amount needed far the
payment of these bonds and inter-
eat maturing in 1937, along with
the bonds which were. not present-
ed for payment in 1935 and. 1936,
as stated, will be realized unless
some special effort is toads by the
city to collect the same. The .city
cannot afford to enco!mter a situ
anon similar to the one which oC•
.tarred on April 1 this year when
$40,000.00 of bonds matured ,and
there .was no-money in the ,funds
with which to pay the same.: .It
was only through the. arrangement
which was made with the White-
Phillips Company that a serious sit•
uation was avoided. It cannot be
expected and we should not rely
upon such assistance being given
,again. Consequently the responsi•
bility for making a special effort
to collect delinquent assessments
falls upon the -public ofRcials.
I have stated that $68,400.00 of
bonds mature in 1937 and that th'e
March and April collections aggre•
gate $32,618.92., However; these
collections include payments in
Funds 94G, 943, 949 and 950 total-
ing $4,489,64, Nherein'no bonds are
due in 1937. By deducting the sum
of $4,489.64 from $32,618,92 we have
a balance in fends . available ,for
_1937 maturities at this time,pf•only
$28,129.28, This will be supple
niented by fpture collections.
In several. funds bonds should be
called and paid thereby stopping the
interest. For example; The March
and April collections in Fund 806
amount to $417.42. A $300,00 bond
can be called and paid. In. Fund
817 the collections were $500.86. A
$500,00 bond can be called and paid,
In Fund 826 the collections were
$241.75. A $200.00' bond cati be
called and paid. In Fund 872 the
collections were $1,483.48. A
$1,500.00 bond can be called and
paid. In Fund 879 $3,610.39 has been
collected. $3,500.00 in bond's can
be paid. In Fund 882 $817.13 has
been collected. A $500.00 bond can
be paid, In Fund 892 $170.56 has
been collected. A $100.00 bond can
be paid, In Fund 899 $120,16 has
been collected, and' a $100.00' bond
can be paid. In Fund 900 $166,87
has been collected and a $100.00
bond can be paid. In Fund 901
$241.92 has been collected and a
$200.00 bond can be paid. In Fund
903 $2,703.66 has been collected and
$2,G00.00 in bons can be paid. In
Fund 916 $34$.33 has been collected
and a $300.00 bond 'can be paid. In
Fund 917 $988.79 has been collected
and $7,000.00 iu bonds can be paid,
In Fund 923 $516.54 has been col-

paid. In Fund 926 $709.93 has been
collected and a $500.00 bond can be
paid. In Fund 927 $1,886.39 has been
collected and $1,600.00 in bonds can
be paid. In Fund 928 $138.98 was
collected and a $100.00 bond can
be paid. In Fund 940 $921.76 has
been collected and a $500.00 bond
can be paid, In Fund 947 $1,270:14

increase these funds, bonds should
be called and paid and the Treasurer
should be instructed to call bonds
as soon as funds show avaSlable
cash.
As I Gave indicated herein no
bands mature in 1937 in Funds 946,
948, 949 and 950, the first mot~r~
hies being in subsequent years. For
example: in Fund 946 $4,08,15 has
been collected, and $1,000,00 in
bands mature in 1938. In Fund 948
$5,000.00 in bonds mature in 1939,
and there has been collected there-
in $2,758.66. $2,500.00 of these bonds
can be called and paid. In Fund
949 $1,500.00 of bonds mature in
1939, and there has been collected
$1,309.17. $1,000.00 of these bonds
can be called and paid.
The point I wish to make is that
the city profits nothing by permit~
tins funds to accumulate. On the
contrary, there is always a loss of
interest which in years past Las in-
creased to a substantial sum. There•
fore, the Treasurer should be in-
structed to call bands in any fund
wherein there is sufflcieht money to
pay one or more bonds no matter
when the same mature,
The Council must realize that in
many funds assessments will not
be paid in amounts sufficient to meet
bond and interest payments. Spe•
cific examples may be given. In
Fund 879, the improvement of Cen-
tral Avenuo, $2,500.00 in bonds ma-
tured in 1936 and were not pre-
sented for payment, In 1937 $8,500,00
in bonds mature, making a rtotal of
$11,000.00. Interest due in 1937 is
$426.00. The' March grid April col-
lections amounted to $3,610.39. In
Fund 903, West Dubuque Sewer Dis•
trict, the March and April collec-
tions were $2,703.66, but $6,000.00
in bonds mature in 1937. Other
funds could be referred to in the
same way, but these are given to
exemplify my point. While there
will be additional collections in
these and other funds, yet it is
hardly to be expected that enough
will be collected to pay interest and
principal on bonds, Therefore, it is
the Council's duty to anticipate the
shortage. Haw can this be done?
TLe Improvoment Fund Tax
amounts to 1~/4 mills. This is the
only direct tax that can be levied
for the payment of these bonds.
But this tax is used in the Conaolf-
dated Fund. However, appropria-
tions are made from the Consolidat•
ed Fund for operation and other
purposes. Therefore, we are con-
fronted with the necessity of making
an adequate appropriation from the
Consolidated Fund to pay tRe bonds
and interest. We cannot depend up•
ott the financial aid next year such
as we received this year from the
White•Phillipa Company.
Anotger matter to be considered
fn this connection is the interest
which becomes due in October and
April on the $40,,000.00 Funding
Bands which were issued to pay the
judgment secured by the White-Phil-
lips Company on the defaulted
bonds, Provisions should be made
to pay this interest by an. appro-
priation. It does not seem possible
to pay the same' next year in any
other way.
Therefore, I make the following
recommendations regarding funds
beginning with 773 and subsequent
thereto:
1, Determine the amount. of de•
]inquent assessments and Lave the
Manager carry out a plan to collect
the. same.
2. Direct the Treasurer to call
bonds whenever there fa enough
money in any fund to pay the same,
principal and interest whether the
same matures in 1937 or subsequent
years,
3. Make ar. oppropriatios in suf•
flcient uu~.ount to pay bonds and in-
terest as the same mature and be-
come payable during the ii:,ral year
1937.
4. Anticipate the necessity 'for
such an appropriation from the Con-
solidated Fund and adjust operation
tests to allow far such appropria•
tion,

actual and necessary expenses of
maintaining the Dubuque Fite De-
partment during the next fiscal
year; and
Whereas, by the passage of an
act, designated Senate File 144, by
the 1935 Iowa State Legislature, the
City of Dubuque has the right to
make a request and secure approval
from the State Comptroller to in-
crease the Fire Maintenance Levy
from 2.50 mills to 3.50 mills: Now,
therefore,
Be it resolved by the City Council
of the City of Dubuque, Dubughe
County, Iowa, that the State Comp•
troller be and he is hereby peti-
tioned fot• his approval to the City
of Dubuque to levy an additional
tax of .85 mill (or a total levy of
3.35 mills) for the 1937-8 fiscal year
of operation,

Whereas, the inadequacy of the
revenue referred to is deemed to
constitute an emergency which re-
quires the levy of an emergency tax:
Now, therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque, Dubuque
County, Iowa, that the State Comp•
troller be and is hereby petitioned
for approval to levy an emergency
tax for the year 1936 in the sunr
of 1.000 mill on the assessed valu-
ation of $32,300,000.00 equal to
Thirty-Two Thousand Three Hun-
dred Dollars ($32,300.00) (not ex-
ceeding one (1.00 mill) said tax to
be used as set out below.
Fund to be Benefitted: The Con-
solidated Tax Levy is requested to
be benefitted,
Reason:, The assessed valuation
in August, 1929, was $48,318u504.00.
At present the estimate of the as-
sessed valuation for 1937.8 is $32,-
300,000.00, including a reduction of
33.15%• Since the 1929 levy this
assessed valuation has decreased
each year. Tke maximum levy far
the Consolidated Fund in 1929 was
$339,070.00. Now the 7.00 mill max-
imum levy, on the basis of $32,300,-
OD0.00 valuation, will only yield
$220,100.00 in regular taxes to the
Consolidated Fund, This amount
will not be sufficient to meet de-
mands for regular city operation and
will not provide renewal of a great
amount of equipment, including a
city ambulance, street truclrs, etc.,.
which have not been able to be re•
placed, as yet, after many years of
service and which may fail at any
time,
The foregoing Resolution was ad-

Whereas, the contract heretofore
entered into. by the City of Dubuque
for the Improving of Atlantic Street
hereinafter described, has been com-
pleted and said improvement has
been accepted by the City Council
of said City and the City Engineer
has computed the cost and expense
thereof to be $6,800.00.
And whereas, public notice as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds to pay the cost of said im-
provement and a public hearing has
been held pursuant thereto,, and all
objections filed thereto have been
considered and determined.
Now, therefore, be it resolved by
the City Council of the City of Du•
buque that to provide for the cost
of the paving of Atlantic Street
twenty-three (23) feet wide between
existing concrete curb and gutters
from the north property line of West
Fourteenth Street to the south pro•
party line of Dexter Street, there be
issued Improvement Bonds to the
amount of $6,800.00.
Said bonds shall be issued under
the provisions of Chapter 311 of the
Code of Iowa, 1927, which bear date
as of the 13th day of August, 1936,
shall be in the denominations of
$500.00 except that there shall be
one bond to the amount of $300,00.

M. meeting July 8th. This statement
of levies, together with two dupli-
cate Resolutions also passed by the
City Council on July 8th, were de-
livered to the State Comptroller's
office at 8:30 A. M. July 10th,
including:

were both finally approved and

secured on these special levies, that
were required to be submitted to

the' proposed 19.797 mills, or an in•
crease over the 1935 revised levies
of 19,262 mills equal to only 2.78%,
Hie instructions were that if any of
the other regular levies were finally
increased a reduction must be made

the total tax levy would not exceed
the millage of 19.797 for 1936.

been received about the outside toi-
let located at 2215 Delhi Street and
owned jointly by Mrs. Blondel and
Mrs: Cora Wolf, and further advising
the Board of Health that there are
two other houses in this immediato
neighborhood whick cannot connect
onto the sewer on account of being
below the street level and that these
homes have inside toilets and they
riin into a mice shaft, presented and -
read.
