Council met at 7:40 P. M,
Present-Mayor Kane, Councilmen
Andelfinger, McEvoy, Schiltz ,
Thompson and City Manager Evans.
Mayor Kane stated that this is the
regular monthly meeting of the City
Council for the purpose of acting
upon such business as may properly
come before the meeting.
Communication of John Heinz, Sr.,
stating that the City Council granted
him a transfer of his Class "B" beer
permit from 2396 Washington Street
to 1097 Jacltson Street and stating
that he will not be able to occupy
the building at 1097 Jackson Street
and further that he is looking for a
new location and then would like
to have his permit transferred, pre-
sented and read,
Councilman Thompson moved that
the City Council rescind their pre•
vious action in granting the request
of John Heinz, Sr., to transfer his
Class "B" beer permit from 2396
Washington Street to 1097 Jackson
Street. Seconded by Councilman
McEvoy. Carried by the fallowing
vote:

Communication of joint announce-
ment by Mississippi Valley Associa-
tion and Upper Mississippi Water-
way Association stating that they
have entered into an agreement un-
der which all governmental sub-
divisions or commissions, cammer•
cis] and trade associations and ship-
pers eligible to membership will hold
a dual membership in the two asso-
ciations and requesting an acknowl-
edgement and acceptance of this ar-
rangement, presented and read.
Councilman Thompson moved that
the arrangement and agreement be
endorsed by the City Council. Sec-

Gentlemen: In connection with
the repair' work on the sunken pier
and column at the 9th Street En-
gine House, as authorized to be
awarded to the low bidder, viz. N.
F. Schaeffer & Son, contractors, by
City Council January 29, 1934, please
be advised that a serious condition
has been discovered, after the start-
ing of the original plan of repair,
which condition has necessitated a
change in design and has increased
the cost.
The original Plan of repair was
based on the assumption that the
3' x 3' pier had settled due to inade-
quate footing and we planned only
to increase the footing, shim up the
cast iron column and raise the set•
tied floors above the pier. However,
during the first day of work in try-
ing to construct the new footing un-
der the sunken pier, it was discov
erect that the original footing of said
pier had been placed over a portion
of a three foot diameter opeh well,
or cistern, of brick construction, The
stone base of the pier has settled in-
to the well. The well is not filled;
it is unsafe and its present depth
is around 16 feet with soft mud and
loose sand at the bottom. It is
deemed unsafe and useless to try
to make the base of the present
3' x 3' stone pier, which has a dead
weight itself of over 10 tons, safe
by tilling in the well or shaft, Ac•
cordingly, a new design was pre•
pared and submitted to the contract-
or, including two new concrete foot-
ings, ttivo new vertical 12" I•Beam
columns and two new horizontal 18"
I•Beams to suspend the total load
from the present weak pier to the
new columns.
The analysis of the division of
costs of the original project and the
agreement by the contractor on the
additional costs of the revised plan,
including new materials to be furn•
fished by the City, are as follows:-

Gentlemen: At the meeting of Jan•
nary 29th the petition of Mrs. Anna
A, Sutton and Mrs. Margaret Fo•
garty requesting that the alley be i
opened east of Hil] Street and south
of Wooten Street was considered
and granted by the City Council,
This location was viewed by the
City Council February 3rd.
A serious question arises on said
alley due to the elevation of the
garage and alley east of said garage
belonging to Mr, Tony Abeln. The
City Engineer was instructed to pre•
pare a profile of this entire alley
and the grading of said alley is to
be based upon the possibility, feas-
ability and safe grade that can be
established. It may be necessary to
-erect 'a barricade east of Dlr. Abeln's
garage and provide a drop of from
5 to 15 feet in said alley at this loc~~
lion. In this case, access to the
Fogarty and Sullivan properties will
have to be made from the south. If
possible, the entire alley will be
opened.

Gentlemen: On June 28, 1933, a
petition from Mr. Joseph Schmitt, et
al, requesting that on Gilmore Street,
from Cooper Place to West 6th
Street, new sidewalks be construct-
ed along the west side of Lots 1 and
22 'and also that Gilmore Street be
repaired south of Cooper Place duct
also that the alley be repaired par-
allel and south of Cooper Place,
leadiug hrom Gilmore Street to Sum•
mitt Street, ',vas referred to the
Council to view the ground. This
site was viewed by the City Council
February 3rd.
There had already been construct-
ed acinder walk along Cooper Place
as was requested. Certain tempor-
ary repairs had been made on Coop•
er Place and the alley leading to
Summitt Street. No new construc-
tion was authorized by the City
Council.

Gentlemen:
At the meetings of December 1R,
1933, and January 15, 1934, two sep-
arate petitions requesting the pur-
chase of the Nick Welber tract west
of the city line and extending in a
general direction north of Pennsyl-
vania Avenue and also north of
Green Street, including a very irreg•
afar tract of 11.6 acres, was referred
to the City Council to view said
tract and to later refer this question
to a joint meeting with the City

Council, Park Board and Recreation
Commission. Accordingly, during the
afternoon of Saturday, February 3rd,
the Welbes tract was viewed by the
City Council.
The decision as to when the meet-
ing with the Park Board and Recrea•
tion Commission would be held was

Gentlemen: On January 9th a
communication from Mr. J. F. Kirch•
er was presented to the City Coun•
cil offering for sale his property as
proposed playground or park site.
This property is slightly over 20
acres in area and extends south-
wardly from Marion Street to the
line of lots north of Ccates Street
and westwardly from the alley west
of Concord Street.
The site was viewed by the City
Council February 3rd and the deter-
mination reached was that the City
could not see its way clear to pur-
chase this property for playground
purposes, and before said property
could be purchased for said pm•pose
a special election would have to be
held.

Gentlemen: A petition filed with
the CJty Council January 22nd re-
garding the opening and grading of
West Third Street, east of Algona
Street, vas referred to the Council
to view the ground. Accordingly, an
February 3rd the City Council view-
ed and determined that West Third
Street, east of South Algona Street,
should be graded and placed, if pos-
sible, to the approximate true sub•
grade of said street from Algona
Street east as far as possible or to
near the location where West Third
Street is only 25 feet in width.
A serious question arises in this
particular portion of West Third
Street due to the present house on
'the Barn property being situated
partially on West Third Street. This•
question of securing the removal of
this present house from the present
street lines of West Third Street is
to be referred to the City Solicitor
for an opinion.

a connection with the water breaks in

a new sanitary sewer south and
e west of the Plymouth Street section.

tained in connection with the water
breaks:
1, That no indication of water leak
occurred dm•ing the construction
of this sewer.
2. That the contractor and the City
Engineer did not ]znow of the
position of this water lateral at
the time of the construction of
said sewer. Mr. Bissell's water
line comes through Mrs. Wil-
mott's yard and extends through
Mr. Bissell's corn field.
Accordingly, the writer can see no
reason why the contractor should be
held for a condition that was un-
known to him as this water line was
in a certain portion of the sewer
construction that was tunnelled and,
accordingly, the water line was not
seen.

ing January 22nd the petition of Mr.
Henry Grewe, et al, requesting that
a street light be installed , at 25th
and Washington Streets, was. re-
ferred to the City Manager for in-
vestigation and report.
This location was viewed during
the evening of February 2nd and
appears very dark. Inasmuch as the
closest light on Washington Street,
to the south of this location, is at
24th and Washington and due tc the
heavy traffic at certain portions of
the year around Comiskey Field, it
is the writer's recommendation that
anew 400 C, P, street light be auth-
orized to be installed at once.

day afternoon, February 3rd,
'Phe decision reached was that a
15" or 18" storm sewer was to be
constructed, at City expense, provid•
ing proper right•of-way be granted
by Mr. Yfalzgraf along the west line
of Lot 38 and Lot 53 from Pearl
Street tc Mineral Street and that
Pearl Street be slightly regraded in
order that the low point north of
Lot 3S will be at the upper end
of the new proposed sewer.

Gentlemen; In connection with
the matter referred to the Council
on January 15, 1934, to consider the
construction of a storm sewer over
the open portions of the Bee Branch
creel{ from 17th Street north to near
22nd Street, this is to advise -that
the City Council viewed this site
Saturday afternoon, February 3rd,
The decision reached was as fol•
lows:
That an application be made to
the C. W, A, for appropriations to
construct the sides of this sewer of
quarried stone or possibly the curb
stone from Main Street, said side
walls of the sewer to be erected
vertically with dowels insetted at
the tap of said two walls. At the
location where the side walls are al-
ready 2~to 4 feet above the stream
level, said side walls are to be
4~ai~ed to the required( height of
about 10 feet. At such portions of
the creek where there is no floor, a
stone flooring is to be installed.
Upon completion of the flooring
and side walls, additional appropria-
tion for labor shall be made to the
C.W.A, conditioned upon the City's
ability, at that time, to furnish ma-
terial for reinforced concrete slab
construction from one side wall to
the other side wall to farm a rein-
forced concrete tap over the sewer.

the tearing out of this drive in the
early spring, that Dr. Falen should
be shown, on the ground, just what
the plans were.
