Council met at 7:35 P. M.

Mayor I{one stated that this is the
regular monthly meeting of the City
Council for the purpose of acting up-
on such business as may properly
come before the meeting.
Communication of Witwer Grocer
Company stating that they will glad-
ly follow all instructions contained
in Resolution No, 72-34, granted to
them by the City Counci] pertaining
to the erection of a refrigeration
car in the rear of their building, pre-
sented and read.
Councilman Andelfinger moved
that the communication be received
and made a matter of record, Sec-
onded by Councilman Schiltz. Car-
tied by the following vote:

Communication of Dubuque Joint
Committee of Catholic Ordet• of For-
esters requesting permission to use
the Athletic Field on Tuesday eve•
ning, August 14th, 1934, for the hold-
ing of a Band Concert and Boxing
Exposition far the benefit of the
Catholic Order of Foresters "Boy
Ranger's Band," and in case of bad
weather they to be granted the use
of said Athletic Field on the follow-
ing night, presented and read.
Councilman Andelfinger move d
that the prayer of the petition be
granted for the use of the Athletic
Field as requested with the under-
standing that the Catholic Order of
Foresters are to pay the charge for
electric current. Seconded by Coun-
cilman Schiltz, Carried by the fol-
lowing vote;

Communication of Dubuque Boat
and Bailer Company suggesting that
this would be an ideal time to dredge
the Ice Harbor, with a view of cor-
recting the serious damage which
has been done by the location of a
storm sewer discharging into the
harbor Presented and read.
Councilman Andelfinger moved to
receive and file the communication.
Seconded by Councilman Roberts.
Carried by the following vote:

closed membership receipt in the

Secretary-Treasurer of the League

that the bill be paid and a warrant
in the amount of $50.00 ordered
drawn on the City Treasurer in fa•
vet of Frank Pierce, Secretary
Treasurer, League of Iowa Munic-
ipalities, for annual dues in the
League of Iowa Municipalities, Sec-
onded by Councilman Roberts. Car-
ried by the following vote;

Petition of George M. Scherer re-
questing permission to put up a port-

To the Honot•able Mayor and City
Council, Dubuque, Iowa,
Gentlemen: The writer was re-
quested to arrange fora conference
with a group of officials of the Du-
buque Humane Society. Accordingly,
the fallowing persons, namely Miss
Frances Couch, President, Mr. Lee
McNeeley, Vkce-President, and Mr.
Walter Blades, Treasurer, discussed
the question of the removal of the
shelter house from Jackson Street
today at 9:00 A. M.
The result of the meeting was that
the writer be requested to make a
plea to the City Council that, if nec-
essary, the 10•day period of removal
of such she]ter from the present
location be extended. Several at-
tempts have been made to secure a
suitable building and area for the
storage of animals in the outskirts
of the City or beyond the city lim-
its, in a location that would not
interfere with neighbors who live in
the immediate vicinity. However,
they stated that up until today no

decision has been made as to the
change of the shelter house.
They stated that if no deal is
made in 10 days and the shelter
house on Jackson Street must be
closed 10 days after the last Council
meeting, namely July 30th, it will be
necessary for the Humane Society to
cease business. They further pointed
out that if they ceased operation, it
will be necessary for the City to
assume the handling and storage of
dogs and other animals in the City..

Councilman Schiltz moved that
the Dubuque Humano Society be
granted 'an extension of time until
such time that they Snd it conven-
ient to secure a suitable site. Sec-
onded by Councilman Andelfinger.

Councilman Andelfinger moved to
suspend the rules for the purpose of
allowing any one present in the
Council Chamber, who wishes to do
so, to address the Council. Seconded

Miss Kemler addressed the Coun-
cil requesting that the `vooden sheds
in the rear of her property in the
Alley between Locust and Bluff
Streets and between 8th and 9th
Streets be allowed to remain, and
nbt to be tmm down as per order of
City Council of July 30th, 1934. Misa
Kemler was informed by the Council
that the City Manager and Building
Commissioner would again inspect
the sheds and ascertain if said sheds
could be repaired.
Mr, N. Grommersch addressed the
Council requesting permission to dig
up about ten feet of the Alley first
west of Muscatine Street between
Charles and Putnam Streets in order
to destroy quack grass which is
growing in the Alley.
Councilman Andelfinger moved tc
refer the request to the City Man
alter to take whatever steps he
deems necessary in the handling o'
the request. Seconded by Council
man Roberts. Carried by the fallow
ing vote:

Gentlemen: The request of th
Rainbo Oil Company, submitted t
t 6th, 1934
;be City Council, July 19th, for per•
nission to change the sidewalk ap•
broach at the north sidewalk on
fast 4th Street, just east of Bodega
3ti'eet, was referred to the Council
to view the grounds. Accordingly,
on August 3rd four of the Council
members viewed this site and dis-
cussed the project with the Rainbo
Oil Company employees. The deci-
sion was as follows:-
That the present location of the
sidewalk on the north side of East
4th Street, immediately east of the
Bodega Street curb line for at least
5' east of said Bodega Street and
next to the 4th Street curb line, was
not to be eliminated. If the side-
walk at this point is rebuilt, the
necessary minimum 5' section to-
ward the East 4th Street curb and
a longer section of sidewalk at the
property line of East 4th Street is
required, The denial of the right to
use the entire sidewalk up to Bo•
delta Street was based on the the-
ory that pedestrians should have a
place to stand in safety prior to
starting across the railroad tracks
toward the west or in crossing in
front of moving traffic toward the
east in front of the Rainbo Oil Com•
pony station.
Permission was also granted to re-
move the present sunken brick
along the gutter line adjacent to the
curb in front of the Rainbo Otl Com-
gany station.
The cost of the new sidewalk, in-
cluding an extension of the approach
to the gutter and the raising of the
present sunken gutter line, is to be
borne by the Rainbo Oil Company,
the work to be done under the super
vision of the City Engineer.

day of April, 1934, caused to be is-
sued aClass "B" Beer Permit bear-
ing the Number 46 to yVm. O'Neill
operating a beer tavern at 130 West
8th Street in the City of Dubuque;
and
Whereas, it has come to the atten-
tion of this Council that the owners
and holders of said permit have con-
ducted their place of business ih a
disorderly manner and otherwise in
violation of law: Now, Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that Class
Regular Session, August 6th, 1934 23S
"B" Beer Permit No. 46, heretofore
issued by Wm. O'Neil], be and the
same is hereby revoked and the
Chief of Police is directed to take
up such permit forthwith and rettirn
the same Par cancellation.

Gentlemen: Mr. C. J. Gassman,
in connection with Board of Health
action of July 30, 1934, says thaf
he has no money to pay for sewer
connections on Eagle Street.
A private sewer built there years
ago would cost him $150.00 plus
cost of sanitary connection from
sewer to his house.
He agrees that if a contract is
let for this job and the cost is as-
sessed to him for payments in years
to come, that it would be satisfac•
tort' to him. However, he wants
the contractor, who takes the job,
to give at least one of his grown
boys a chance to work on the dig-
ging for the sewer connection.
He only wants one toilet installed
and one water pipe leading to toilet
at this time.

Resolution No. 86-34
Whereas, the Council of the City
of Dubuque caused to be prepared
and published, as provided by law,
Budget Estimate of Expenditures for
the fiscal year 1935, and the hearing
upon said Budget Estimate was fixed
far the 10th day of August, 1934, at
7:30 o'clock P. M. at the Council
Chamber in the City Hall; and,
Whereas, this being the time and
place set for said hearing said Bud-
get Estimate was taken up for final
consideration by the Council and all
tax payers have been given an op•
portunity to be heard for or against
said Budget Estimate:
It is therefore resolved by the
City Council of the City of Du•
bugne:
That the Budget Estimate of Ex•
penditures for 1935 heretofore pre-
pared and published be and the
same is hereby finally approved and
adopted and the Mayor and Clerk
are directed to certify the same to
the County Auditor of Dubuque
County, Iowa, together with the veri•
fled proof of publication and the
notice of hearing upon said Budget
Estimate,
Be it further resolved, that the
taxes required to be collected in the
year 1935 be and the same are here-
by levied in the various funds in
the amounts shown in said Budget
Estimate,

A Resolution establishing the tax
levies for the year 1934, the taxes
to be collected in the year 1935 and
used for municipal purposes of the
City of Dubuque,
Be it resolved by the City Coun•
cil of the City of Dubuque, Iowa:
That there be and there is hereby
levied the taxes for municipal pur•
poses for the ensuing year 1935 of
the fallowing number of mills on
the dollar of all taxable property
within the corporate limits of said
City:
7,00 mills for Consolidated Fund,
as provided for by Section 8217 of
the Code of Iowa, 1931.
.50 mills for Street Cleaning and
Garbage Fund.
.27 mills for Recreation Fund.
3.00 mills for Fire Maintenance
Fund.
.66 mills for Library Fuud.
.59 mills for Park Fund.
.442 mills for Police Pension Fnnd,
.50 mills fm• Fire Pension Fund.
1.741 mills for Regular Bond In-
terest Fund.
2.39 mills for Bond Fund,
.103 mills for Playground Baud
and Interest. Fund.
.937 mills for Docle Bond and In-

A tax of seven (7) mills on the
dollar is hereby levied upon all lots
of more than ten (10) acres Nhich
are occupied in good faith and which
are used for agricultural or hori•
cultm•al purposes.
Be it further resolved that all pro•
perty within the corporate limits
of said City is hereby determined
to receive benefits from each of said
tax levies.
Be it further resolved that the
Mayor and Clerk be and the same
are hereby directed to certify the
sums of money that above tax lev-
ies will produce as shown by the
Budget Estimate of Expenditures
adopted by the Council to the Couu-
ty Anditpr on or before the 15th
day of August, 1934.

Resolution No. 88=34
Resolution Ordering the Construc•
tion of Sewers
whereas, it is deemed necessary
and advisable by this Council to
construct certain storm sewers with-
in the City of Dubuque, said sew-
ers,in some cases, to be constructed
before the streets wherein they are
to be laid are paved and, the con-
struction of said improvements at
this time will tend to relieve the
Special Session, August 10th, 1934 239
unemployment situation now exist-
ing in this City; and,
Whereas, in order_to finance the
cost of said improvements, it is
necessary to cause to be issued anil
sold, sewer bonds in a sum aggre-
gating Twenty-eight Thousand Dol•
Lars.
Now, therefore:
Be it resolved by the Council of
the City of Dubuque:
That storm sewers be and the
same are hereby ordered construct-
ed in Rhomberg Avenue, and in, up-
on and along other streets for which
plans and specifications have been
prepared and that the cost thereof
be paid front the proceeds of sewer
bonds to he issued and sold by said
City, and that all necessary and
pertinent proceedings for the issu-
ance of such bonds in the sum of
Twenty-eight Thousand Dollars be
taken, passed and adopted by this
Council,
This Resolution being deemed ur-
gent and of immediate necessity, in
the preservation of public peace,
health and safety, shall Ue in farce
and effect immediately upon its pass-

SEWER BONDS.
Whereas, the City of Dubuque, in
the County of Dubuque, and State
of Iowa, has hereto ordered and
provided for building and constt•act•
ing certain sewers in and for said
City, the cost thereof to the amount
of $28,000.00 to be borne by said
City; and
Whereas, it is deemed for the best
interests of said City that the cast
to be so paid be realized at this
time and that sewer bonds of said
City be issued therefor, but it is
first necessary to give notice bf
hearing as required by Section 363
of the Code of Iowa: Now, there-
fore:
Be it resolved by the City Coun-
cil of the City of Dubuque as fol-
lows
Section 1. That this City Coun•
cil meet at the Council Chamber in
the City Hall within the City of Du-
buque on the 4th day of Septem•
ber, 1934, at 7:30 o'clock P. M. at
which time and place procedure will
be instituted and action taken for
the issuance of $28,000.00 sewer
bonds, for the purpose of defraying
the cost to this amount of building
and constructing sewers in and for
said City,
Section 2. The City Clerk is here-
by directed to give notice of pro-
posed action for the issuance of said
bonds, setting forth the amount and
purpose thereof, the tune when and
place where said meeting- will be
held, by publication at least once
and at least ten days before said
meeting in the Telegraph-Herald
and Times-Journal, the official news-
paper of said City and which has
a general circulation within said
City. Said notice shall be in sub•
stantially the following form:
"The City Council of the City of
Dubuque, Iowa, will meet on the 4th
day of September, 1934, at the Coun-
ci] Chamber in the City Hall, Du-
buque, Iowa, at 7:30 o'clock, P. M.
for the purpose of instituting a pro•
cedure and taking action for the is•

It is my recommendation that
authority front the City Council be
sanctioned for the proper official ad•
vertising fat' bids for a new gar-
bage contract including the follow-
ing proviaions:-
1. Length of new contract to be
five (5) years,
2, Payments by the City to be
made twice each month, each pay-
ment to be 1.24 of the annual award-
ed bid price.
3. Collection of garbage in each
of three garbage districts, under
present contract, shall continue far
next five (5) year period.
4. Garbage contractor shall be
required, at his bid price, to col-
lect all garbage, dead animals daily
and decayed matter within the en-
tire limits of the City; he shall re•
move the same from the City Lim•
its and be shall dispose of the same
at a proper and described (in the
bid) plant located outside the City
Limits of Dubuque.
5. Non•leakable and covered ve•
hicles shall be required for all col-
lections,
6. Upon the award of the five
year contract by the City Council,
the garbage contractor shall furn•
ish to the City a surety bond at
his expense in the sum of $5,000.00
conditioned upon the faithful per•
formance, for the five year period,
of all conditions of the contract and
in order to protect the City against
all damages. This surety band shall
be a portion of the contract.
7. Bids shall be submitted, ap-
proved and awarded or rejected by
the City Council.
8. After final award, a Resolu•
tion shall be effective authorizing
the City Manager and City Clerk
to execute said contract,
9. Bids are to be advertised and
received up to Tuesday, September
4th, 1934, at 11:00 A. M. and referred
to City Council at 7:30 P. M. on
the same day.

Petition of Frank Macgino request-
ing the City Council to suspend ac-
tion on the revocation of his Class
"B" beer permit, located at 574 East
16th Street, and to adopt a resolu-
timr or motion reconsidering their
previous action of August 20th, 1934,
in revoking said permit pending
judgment on his appeal to the Dis-
trict Court at Dubuque, Iowa, pre-
sented and read,
Councilman Roberts moved to sus-
pend the rules for the purpose of
allowing any one present in the
Council Chamber, who wishes to do
so, to address the Council. Seconded
by Councilman Schiltz. Carried by
the, following vote:

Attorney J. A. Cunningham ad-
dressed the Council relative to the
petition of Frank Macgino and re-'
quested the City Council to recon-
sider their previous action in revok-
ing the Class "B" beer permit of
Frank 114acgino at least until such
time as a decision can be handed
down by the Supreme Court as to
the power of the City Council to re•
voke Class "B" beer permits.
Councilman Jaeger moved to refer
the petition of Frank Macgino to tfie
City Solicitor. Seconded by Council-
man Roberts. Carried by the fo]low-
ing vote:

Claim of Sidney L. Brown, in the
amount of $5,000.00, far personal in-
juries and damages sustained due to
a defective apron at the corner of
Seventeenth and Maple Streets
which caused her to fall and sustain
severe fractures to her right leg;
presented and read.
Councilman Schiltz moved to refer
the Claim to the City Solicitor. Sec-
onded by Councilman Roberts, Car-
ried by the following vote:

Meeting called by order of Mayor
Kane and Councilman Roberts.
Mayor Kane read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of approving
applications for the sale of beer and
authorizing the issuance of permits
and acting on any other business as
may properly come before the
meeting.
Resolution No. 98-34.
A Resolution approving applica-
tions for the sale of beer and auth-
orizing the issuance of permits.
Whereas, the City Council of the
City of Dubuque has examined the
applications which have been filed
for permits for the sale of beer with-
in the City of Dubuque and has ap•
proved such applications as apply to
the persons herein named at the
locations described heroin: Now,
Therefore,
Be It Resolved by said Cou ncil that
permits for the sale of beer within
the City of Dubuque be and the
same are hereby authorized and or
dered issued as follows:

instructed to confer with the offic-
ials of The Chicago Great Western

their railroad m'ossings within the
City Limits. Seconded by Council-

ing vote:
