The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Commissioner Norton recused himself due to a conflict of interest.
Discussion
The applicant's representative, Tom Thompson, spoke in favor of the request, noting the
plat would split two family lots for a home and carriage house. He noted the plat would
eliminate a property line encroachment by the garage of the home.
Staff reviewed the staff report, noting the plat would eliminate the garage encroachment and
create two saleable lots. Staff noted Lot 1 will have 0 feet of street frontage.
There were no public comments.
The Zoning Advisory Commission discussed the request, and clarified the lot areas.
Recommendation
By a vote of 6 to 0 with one abstention, the Zoning Advisory Commission recommends that
the City Council approve the request, subject to waiving the lot frontage for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of MVT Place resubdivides .85 acre of property from two
lots into two new lots. The resubdivision of this property is designed to facilitate the
future sale of the carriage house that is currently a residence, and to address an
encroachment by the single-family house at 215 Fremont Avenue into the existing lot.
DISCUSSION
The submitted plat of MVT place resubdivides two existing parcels of land with a single-
family home at 215 Fremont Avenue and a carriage house residence at 237 Fremont
Avenue onto two new platted lots. The replatting of these existing two lots will facilitate
the future sale of the carriage house at 237 Fremont Avenue. In addition, the existing
single-family home at 215 Fremont Avenue encroaches onto the existing lot that is
associated with the carriage house at 237 Fremont Avenue.
Fortunately, this situation is under common ownership. However, the current owner
wishes to facilitate the future sale of the carriage house by addressing the situation at
this time.
The carriage has been converted to a residence and received a Special Exception in
June 1997 to allow for the existing non-conforming setbacks. The proposed Lot 1 is
platted to accommodate the existing carriage house and complies with the requirements
for lot area. However, the frontage is on a platted alley and not a public or private
street. The Unified Development Code requires that all new lots be platted in the R-1
Single-Family Residential District with 50 feet of lot frontage on a public or private
street. The applicant is asking the Zoning Advisory Commission and City Council to
waive that requirement to facilitate the future sale of the carriage house on Lot 1 .
Planning staff has no objection to the waiver of this requirement as the carriage house
has been in existence for many decades, and has always taken its access off the
existing alley. The submitted Plat of Survey basically does not change the existing
access situation.

The second benefit of the replatting of this parcel is to address an encroachment of the
single-family house addressed at 215 Fremont Avenue onto the existing lot that
contains the carriage house. The new Lot 2 will address this situation.
RECOMMENDATION
Planning staff recommends the Zoning Advisory Commission review the submitted Plat
of Survey of MVT Place and recommend approval as submitted, waiving the lot frontage
requirement for Lot 1.

A RESOLUTION APPROVING THE PLAT OF SURVEY OF MVT PLACE IN THE CITY OF
DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of MVT Place in the
City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 1 on a public or
approved private street, where 50 feet of street frontage is required by Section 11-14 of
Title 15 of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and its approval has been endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that
it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street or an
approved private street for Lot 1.
Section 2. That the Plat of Survey of MVT Place is hereby approved and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Plat of Survey.
