Economic Development Director Maurice Jones recommends City Council approval of a
Resolution of Necessity that finds that an Amended and Restated Urban Renewal Plan
for the Dubuque Industrial Center Economic Development District is both necessary and
appropriate and sets a public hearing on the proposed amendment for May 21 , 2018.
The proposed Amended and Restated Urban Renewal Plan for the Dubuque Industrial
Center Economic Development District would expand the District to include the property
to be designated as a new Subarea K. This parcel is expected to accommodate the
construction of corporate offices for Medline Industries, Inc.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
This memorandum presents for City Council consideration a Resolution of Necessity
thatfinds that: 1) an Amended and Restated Urban Renewal Plan forthe Dubuque
Industrial Center Economic Development District ("District") is both necessary and
appropriate; and 2) sets a public hearing on the proposed amendment for May 21,
2018.
The proposed Amended and Restated Urban Renewal Plan ("Urban Renewal Plan") for
the District would expand the District to include the property to be designated as a new
Subarea K (see attached map).
BAC KG RO U N D
The original Dubuque Industrial Center Economic Development District was created on
May 2, 1988. The District is an urban renewal area which allows the City of Dubuque to
capture tax increment revenue from improvements made in the District in order to
promote economic development activities. The original area included the Dubuque
Industrial Center (known as Subarea A) and has been expanded several times over the
years to include the Dubuque Industrial Center West, the County Farm, the Bergfeld
Farm, the North Siegert Farm, the Rail Site, the South Siegert Farm, the Graf Farm,
McFadden Farms, small adjacent parcels, and several County-owned parcels (known
as Subareas B, C, D, E, F, G, H, I, and J respectively).
Before a municipality can exercise the authority conferred by Chapter 403 "Urban
Renewal" of the lowa Code, a Resolution of Necessity must be adopted finding that the
area being considered for urban renewal district designation is either a slum, blighted or
economic development area and that the rehabilitation, conservation, redevelopment,
development, or a combination thereof, of the area is necessary in the interest of the
public health, safety or welfare of the residents of the city.
DISCUSSION
This proposed expansion and amendment of the Dubuque Industrial Center Economic
Development District would result in the addition of property that is currently
undeveloped. The parcel added is expected to accommodate the construction of
corporate offices for Medline Industries, Inc. City Staff have negotiated an agreement
with Medline Industries, Inc., a local company that has outgrown its current facility. The
company desires to expand, bringing additional jobs to Dubuque, and identified a parcel
in Dubuque Industrial Center that would accommodate its larger facility. In order to
provide appropriate business incentives for this local growth, Staff wishes to amend and
restate the current Urban Renewal Plan to include the property on which this facility
would be constructed and identify the agreement with Medline Industries, Inc. as an
urban renewal project. The offices will be housed in an approximately 120,000 SF
building — an investment of over $18.4 million. Medline has committed to bringing at
least 105 high quality jobs to Dubuque, with starting wages ranging from $16.29 to
$25.80 per hour.
Staff has recommended removal of this parcel from the District as part of a proposed
2018.1 Amended and Restated Urban Renewal Plan to be considered by City Council
on April 16, 2018. The parcel was undeveloped, and therefore not creating any
increment. Due to legislation in 1995, the collection of tax increment in urban renewal
areas designated for economic development purposes is limited to 20 years. This
means the Subarea C of the District in which this parcel had been a part of has its "TIF
sunseY' in June 2028. If the parcel had remained in Subarea C, the City would have
been unable to provide an incentive of a sufficient length to Medline. By now
designating the parcel as a new Subarea K, the City has 20 years to provide TIF
incentives for any development.
The attached Resolution directs staff to prepare a Version 2018.2 Amended and
Restated Urban Renewal Plan for the Dubuque Industrial Center Economic
Development District, describing the Medline project as one of the urban renewal
projects that are currently expected to be undertaken in the District and including the
new Subarea K described above. Additionally, staff is required to hold a consultation
process, required by law, with the affected taxing entities concerning the proposed Plan.
A City Council public hearing on the 2018.2 Amended and Restated Urban Renewal
Plan will be scheduled for May 21 , 2018. The public notice will be published four to
twenty days before the meeting to allow for the appropriate publication requirements.
This will allow time for preparation of the Plan and the consultation process with the
taxing entities.
RECOMMENDATION/ ACTION STEP
I recommend the City Council adopt the attached Resolution of Necessity that begins
the process of drafting the Amended and Restated Urban Renewal Plan for the
Dubuque Industrial Center Economic Development District to include the Medline
project and create Subarea K.

A RESOLUTION OF NECESSITY FINDING THAT CERTAIN AREAS ADJACENT TO
THE ESTABLISHED DUBUQUE INDUSTRIAL CENTER ECONOMIC DEVELOPMENT
DISTRICT MEET THE DEFINITION OF AN ECONOMIC DEVELOPMENT AREA
UNDER THE URBAN RENEWAL LAW, THAT DEVELOPMENT OF SAID AREA IS
NECESSARY IN THE INTEREST OF THE RESIDENTS OF THE CITY OF DUBUQUE,
IOWA, AND SETTING DATES OF HEARING AND CONSULTATION ON A PROPOSED
AMENDED AND RESTATED URBAN RENEWAL PLAN FOR SAID DISTRICT.
WHEREAS, the City Council of the City of Dubuque has heretofore approved the
Amended and Restated Urban Renewal Plan (the "Urban Renewal Plan") for the
Dubuque Industrial Center Economic Development District (the "District") in order to
provide redevelopment opportunities which will further economic development purposes
and objectives as described in the Urban Renewal Plan; and
WHEREAS, the City Council has most r cently approved an Amended and
Restated Urban Renewal Plan by Resolution /V-18, adopted May 21, 2018, which
Amended and Restated Plan, among other things, removed certain undeveloped property
from Subarea C of the District; and
WHEREAS, the City Council has found that the undeveloped property removed
from Subarea C continues to meet the definition of an economic development area as
found in Chapter 403 of the Iowa Code and should be included as a new, distinct Subarea
of the District; and
WHEREAS, Chapter 403 of the Iowa Code requires that before urban renewal
authority may be exercised, a City Council must adopt a resolution of necessity finding
that the area in question is a slum, blighted or economic development area, and that so
designating such area is necessary in the interest of the public health, safety or welfare
of the residents of the municipality.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Subarea K generally described in Exhibit A to this Resolution,
which is proposed to be added to the District, is an economic development area as
defined by Chapter 403 of the Iowa Code and is appropriate for an urban renewal project.
Section 2. That the City Manager is authorized and directed to prepare an Urban
Renewal Plan for the Dubuque Industrial Center Economic Development District, such
Urban Renewal Plan to include Subarea K within the District and such other modifications
to the property contained within the District as may be appropriate, and setting forth the
urban renewal projects that are currently expected to be undertaken in the District, and
the City Manager is further authorized to determine an appropriate date for and conduct
the consultation process required by law with affected taxing entities concerning the
proposed Urban Renewal Plan.
Section 3. That the City Council hold a public hearing on the adoption of the
proposed Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center
Economic Development District on May 21, 2018 at 6:00 p.m. in the Historic Federal
Building, 350 West 6th Street, Dubuque, Iowa 52001. The notice of said hearing shall
generally identify the area to be covered by the Urban Renewal Pian and the scope of
the urban renewal project activities planned for such area, and said notice shall be
published and available to the public not less than four days nor more than twenty days
before the date of said meeting. A copy of the notice of public hearing shall be sent by
ordinary mail to the affected taxing entities.
Section 4. That the City Clerk is further directed to send by ordinary mail a copy of
said Urban Renewal Plan, the notice of public hearing, and, to the extent the Urban
Renewal Plan includes the use of tax increment revenues for a public building, an analysis
of alternative development and funding options for such public buildings, to the Dubuque
Community School District and the County Board of Supervisors, as the affected taxing
entities.

PUBLIC NOTICE is hereby given that the City Council of the City of Dubuque, lowa, will
hold a public hearing on the 215� day of May, 2018, at 6:00 p.m. in the Historic Federal
Building, City Council Chambers (Second Floor), 350 West 6th Street, Dubuque, lowa,
at which meeting the City Council will consider a proposed Amended and Restated
Urban Renewal Plan ("Plan") for the Dubuque Industrial Center Economic Development
District ("DistricY').
The proposed Plan, if approved, would amend and restate the Plan to include additional
project activities that may be undertaken in order to achieve the objectives of the Plan,
including those relating to the development, construction and operation of a corporate
office facility by Medline Industries, Inc. The Plan also would add an area adjacent to
the existing District, to be known as Subarea K, to the District for the purpose of
redevelopment and the undertaking of urban renewal project activities thereon by the
City, as described in the Plan. The City Council has found that the proposed areas
meet the definition of an economic development area as found in Chapter 403 of the
lowa Code and should be included therein.
The proposed Subarea K is legally described as follows:
A portion of Lot 2 of Dubuque Industrial Center North Second Addition described as
follows: Commencing at the most southeasterly corner of Lot 2 of Dubuque Industrial
Center North Second Addition; thence south 87 degrees 23 minutes 39 seconds west
along the south line of said Lot 2 a distance of 498.99 feet; thence north 15 degrees 24
minutes 42 seconds east along the westerly line of said Lot 2 a distance of 129.79 feet;
thence north 16 degrees 19 minutes 03 second west along the westerly line of said Lot
2 a distance of 179.83 feet; thence north 45 degrees 25 minutes 40 second west along
the westerly line of said Lot 2 a distance of 132.41 feet; thence south 77 degrees 24
