City Engineer Gus Psihoyos recommends City Council approval of a resolution vacating
any interest the City of Dubuque may have in utility easements located on Lot 1-1-2 of
Tower Investments Subdivision No. 1 , in the City of Dubuque. This property is located
at the westerly end of Tower Drive and is owned by Dubuque South Pointe, LLC.
Dubuque South Pointe, LLC, is currently constructing a residential development off
Rockdale Road. As part of the development, Dubuque South Pointe, LLC is required to
obtain a secondary emergency access to Tower Drive. In order to construct the
secondary emergency access to Tower Drive, there are abandoned water pipes on
private property which must be removed, and the utility easements vacated.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for the disposition of certain property by vacating any interest
the City of Dubuque may have in utility easements located on Lot 1-1-2 of Tower Investments
Subdivision No. 1, in the City of Dubuque, lowa. This property is located at the westerly end of
Tower Drive and is owned by Dubuque South Pointe, LLC.
BACKGROUND
Dubuque South Pointe, LLC, is currently constructing a residential development off Rockdale
Road. As part of the development Dubuque South Pointe, LLC, is required to obtain a
secondary emergency access to Tower Drive. In order to construct the secondary emergency
access to Tower Drive, there are abandoned water pipes on private property which must be
removed, and the utility easements vacated.
DISCUSSION
The property is currently encumbered by the two attached utility, water line and access
easements. The City may be one of the beneficiaries of these utility easements recorded as
instruments 10011-95 and 10198-95 with the Dubuque County Recorder because of the
presence of water main utility pipes and appurtenances on #he property.
The City of Dubuque Water and Engineering Departments have reviewed this subject and
have indicated there is no useful purpose to the City in maintaining the abandoned pipes in the
ground nor the utility easements.
RECOMMENDATION
I recommend that the City vacate any interest in the easements indicated on the attached
easement documents over Lot 1-1-2 of Tower Investments Subdivision No. 1, in the City of
Dubuque, lowa.

DISPOSING OF PROPERTY BY VACATING ANY INTEREST THE CITY MAY HAVE IN
UTILITY EASEMENTS LOCATED ON LOT 1-1-2 TOWER INVESTMENTS
SUBDIVISION NO. 1, IN THE CITY OF DUBUQUE, IOWA
Whereas, the City Council, by Resolution No. 84-18, dated the 2nd day of April,
2018, declared its intent to dispose of the City interest in utility easements in real property,
legally described as:
Lot 1-1-2, Tower Investments Subdivision No 1 in the City of Dubuque, Iowa,
according to the recorded Plat of Easements
(the Property); attached as Exhibit A and recorded as instruments 10011-95 and 10198-
95 with the Dubuque County Recorder; and
Whereas, pursuant to published notice, a public hearing was held on the proposed
disposition on the 16th day of April, 2018 at 6:00 p.m. in the Historic Federal Building, 350
W. 6th Street, Dubuque, Iowa; and
Whereas, it is the determination of the City Council that any interest the City holds
in the utility easements at the Property should be vacated and doing so is in the public
interest of the City of Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA;
Section 1. The City hereby vacates any interest it may hold in utility easements
located at the Property.
Section 2. The City Attorney or the City Attorney's designee is hereby authorized
and directed to take any action necessary to bring this matter to resolution.
Passed, approved, and adopted this 16th day of April, 2018.

DISPOSING OF PROPERTY BY VACATING ANY INTEREST THE CITY MAY HAVE IN
UTILITY EASEMENTS LOCATED ON LOT 1-1-2 TOWER INVESTMENTS
SUBDIVISION NO. 1, IN THE CITY OF DUBUQUE, IOWA
Whereas, the City Council, by Resolution No. 84-18, dated the 2nd day of April,
2018, declared its intent to dispose of the City interest in utility easements in real property,
legally described as:
Lot 1-1-2, Tower Investments Subdivision No 1 in the City of Dubuque, Iowa,
according to the recorded Plat of Easements
(the Property); attached as Exhibit A and recorded as instruments 10011-95 and 10198-
95 with the Dubuque County Recorder; and
Whereas, pursuant to published notice, a public hearing was held on the proposed
disposition on the 16th day of April, 2018 at 6:00 p.m. in the Historic Federal Building, 350
W. 6th Street, Dubuque, Iowa; and
Whereas, it is the determination of the City Council that any interest the City holds
in the utility easements at the Property should be vacated and doing so is in the public
interest of the City of Dubuque.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA;
Section 1. The City hereby vacates any interest it may hold in utility easements
located at the Property.
Section 2. The City Attorney or the City Attorney's designee is hereby authorized
and directed to take any action necessary to bring this matter to resolution.
