DATE: March 21 , 2018
Dubuque South Pointe, LLC, is currently constructing a residential development off
Rockdale Road. As part of the development, Dubuque South Pointe, LLC is required to
obtain a secondary emergency access to Tower Drive. In order to construct the
secondary emergency access, there are abandoned water pipes on private property
which must be removed, and the utility easements vacated.
City Engineer Gus Psihoyos recommends the City Council set a public hearing for
April 16, 2018, to vacate any interest the City of Dubuque may have in utility easements
located on Lot 1-1-2 of Tower Investments Subdivision No. 1 (South Pointe
Subdivision).
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for the disposition of certain property by vacating any interest
the City of Dubuque may have in utility easements located on Lot 1-1-2 of Tower Investments
Subdivision No. 1 , in the City of Dubuque, lowa. This property is located at the westerly end of
Tower Drive and is owned by Dubuque South Pointe, LLC.
BACKGROUND
Dubuque South Pointe, LLC, is currently constructing a residential development off Rockdale
Road. As part of the development Dubuque South Pointe, LLC, is required to obtain a
secondary emergency access to Tower Drive. In order to construct the secondary emergency
access to Tower Drive, there are abandoned water pipes on private property which must be
removed, and the utility easements vacated.
DISCUSSION
The property is currently encumbered by the two attached utility, water line and access
easements. The City may be one of the beneficiaries of these utility easements recorded as
instruments 10011-95 and 10198-95 with the Dubuque County Recorder because of the
presence of water main utility pipes and appurtenances on the property.
The City of Dubuque Water and Engineering Departments have reviewed this subject and
have indicated there is no useful purpose to the City in maintaining the abandoned pipes in the
ground nor the utility easements.
RECOMMENDATION
I recommend that the City vacate any interest in the easements indicated on the attached
easement documents over Lot 1-1-2 of Tower Investments Subdivision No. 1, in the City of
Dubuque, lowa, and that a public hearing be set for the disposition of the City's interest in the
subject area on April 2, 2018.

of certain property by vacating any interest the City of Dubuque may have in utility easements
located on Lot 1-1-2 of Tower Investments Subdivision No. 1, in the City of Dubuque, lowa.

RESOLUTION SETTING A PUBLIC HEARING ON THE DISPOSITION OF

Whereas, Dubuque South Pointe, LLC, is constructing a development off Rockdale
Road; and
Whereas, as part of the development Dubuque South Pointe, LLC, is required to
obtain a secondary emergency access to Tower Drive; and
Whereas, in order to construct the secondary emergency access to Tower Drive
there are abandoned water pipes on private property which must be removed, and utility
easements vacated; and
Whereas, the City may have an interest in the utility easements recorded as
instruments 10011-95 and 10198-95 with the Dubuque County Recorder; and
Whereas, the. City of Dubuque Water and Engineering Departments have reviewed

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City Council sets a public hearing on the Vacating of the City's
Interest in the utility easements for April 16, 2018 at 6:00 p.n in the City Council
Chamber, Historic Federal Building, 350 W. 6th Street, Dubuque, Iowa.
Passed, approved and adopted this 2nd day of April, 2018.
