Council met at 7:55 P, M.

Mayor Kane state that this is
the regular monthly meeting of the
City Council for the. purpose of act-
ing upon such business; as may pro•
perly come-before ,the meeting,
Councilman Schiltz moved .to sus-
pend the rules for the purpose of
allowing any one ,present in the
Council Chamber, who wishes to do
so, to address the Council. Second-

Council was presented with a silk

bate to the flag, being given by Mrs,
Jennie Royoe, patriotic instructor,
Mayor Kane accepted the dag on be-
half of the City Council.

ceived from four (4) companies up
to 11;00 A, M, today ih regard to
our requested prices for a new
`fraotor and Bulldozer. Our present
second hand, 8-year-old 60 H, P,
Caterpillar ahd Bulldozer is broken
down and will likely cost about
$1500 to repair It seems very nec-
eseary to consider the pm'chase of
a new, modern, but smaller tractor
and bulldozer far necessary use of
opening snow drifts in the residen•
tial sections this winter and for im-
mediate use at the Airport.
N`or. your information, there are
available for study and comparison,
five sheets of detailed specifications
submitted by the individual bidders
today, also a copy of the Nebraska
State tests made on the, same four
models on which , prices were
submitted.

Prior to requesting the bids on
these four outstanding units, all bid,
derv were advised that It was neces-
sary to defer all payments on the
leasing of equipment as follows;
5,0% of the net price of the ac•
cepted bid to be paid on or before
May 1, 1935.

50% of the net price of the ac-
cepted bid to be paid on or be-
fore May 1, 1936.
Accordingly, all bids were based
on the above outlined method of de-
ferred payment.
• The bids received are all from re-
liable and competent companies
who have made this equipment for
several years.
The lowest bid, viz. Allis-Chalmers
' W. H, Tractor, includes only a 15"
tread on each of the two tracks,
All three other bids quoted on 16"
widths. It is stated today that 16"
width track can be secured at very
little additional cost, as even 18"
wide tracks would cast only $15,00
more than the 15" tracks.
Certain other minor comparative
features in other makes of tractors
and bulldozers might appear slightly
mare beneficial. However, due to
the fact that the Allis-Chalmer's bid
is over $400,00 less than the next
lowest bid, and due to the fact that
tractor parts for replacement can be
• secured from Des Moines, or Spring-
field, Ill., at the plant, on 24-hour
service and bulldozer parts also
from Springfield, Ill., at the plant
there, and due to the fact that there
• are over 300 No. 35 models in opera-
tion in Iowa at this time, the writer
does accordingly, respectively rec•
ommend the purchase of the Al1ie-
Chalmers Tractor and Baker Bull-
dozer, the lowest bid submitted,

ascertain if the City holds a tax sale
certificate against said property and
for the Treasurer to report back to

To the Honorable Mayor and City
Council, Dubuque, Iowa,
Gentlemen: In connection with
the request for a sanitary sewer on
Cox and Chestnut Streets, also in
connection with the objections filed
on various dates to said construc•
tion, the City Council viewed the
site of the proposed sanitary sewer
from 14th Street south on 'Cox
Street to Chestnut Street and on
Chestnut' Street ~ eastwardly from
Cox Street to near the lot line be-
tween Lots 6 and 7 in the F. E,
Bissell Subdivision.
The approval of the Council was
tentatively made on this basis and
the City Engineer was instructed to
prepare plans and specifications for
this sanitary sewer to be chargable
to property on bath sides of Cax
Street, with the exception of the cor-
ner lots at 14th and Cox Streets as
far south as Chostnut Street and the
sewer was to be constructed as
close as is passible to the north side
of Chestnut Street, to be available
for lots in the F. E. Bissell Sub-
division from Lots 1 to 7. Said
sewer is .also to be available and
accessable to such lots on the south
side of Chestnut Street as are at
present not served by sewers in
Rose Street.

ing of the City Council held Octo-
ber 1st the petition of Mr, li. A.

Terrace be repaired and, made in
passable condition was referred to
the City Council to view the street.
Accordingly, on the afternoon of
October 26th the Council passed
over Grove Terrace and 11th Street
from Bluff Street to 12th Street.
The decision was that 11th Street
be covered with stone and ditched
to prevent surface water Washing
out the new stone roadway from
Bluff Street west t0 top of steep
grade oh Grove Terrace, According-
ly, this construction has been sub-
mitted to the Street Supsrintendent.

Commerce, stating a resolution was
adopted by the Sewage Disposal
Committee of the Chamber of Com-
merce calling upon the City Council
to arrange for tests to be made of
the water in the Mississippi River
adjacent to the City of Dubuque and
several miles down stream in order
to secure accurate data regarding
the effect of sewage from the City'of
Dubuque which is emptied into the
river, presented and read.

Be it ordained by the City Council
the City of Dubuque; Par. 461 Sec-
tion 1. That that portion of said In-
dustry Track which is to be construct-
ed from East 37th. Street to East 16th.
Street on Sycamore Street, shall be
maintained for the exclusive use of the
Dubuque Packing Company, its succes-
~?~ sors and assigns, and in the event
that other industries located' or to be
i located to the East or South of said
Dubuque Packing Co. should desire
railroad trackage to serve diem, then
any extension of said Industry Track
shall commence North of East 17th.

the Crown Oil Company for permis-
sion to change the sidewalk ap•
proaches and the heighth of the
sidewalk on the west side of Central
Avenue between 23rd and 24th
Streets at property formerly owned
by Mr. W, H, Meurer, please be ad-
vised that this information was pre•
rented to Council prior to the date
on which certain projects were
viewed.
On October 26th the Council did
view this project and the following
decision was granted;
That the Crown Oil Company be
permitted to lower the sidewalk on
the west side of Central Avenue in
front of the former Meurer property
conditioned that the approaches at
the north and south ends of the side-
walk to other adjoining sidewalks
be properly constructed not to ex•
need 4%, Permission was also grant-
ed for the necessary reconstruction
of new curb and gutter to the ap-
proaches required to the-new gas•
oline filling station,
The work is to be performed un-
der the direction of the City Engi-
neer.

termine the area of yards and other
open spaces about buildings; to regu-
late and determine the density of use
of lands and lot areas and for that pur-
pose, to divide the City into districts;
to provide for a Board of Adjustment
and the orderly enforcement of the reg-
ulations hereof; to provide penalties
for the violation of the provisions here-
of; repealing a1I ordinances or parts of
ordinances in conflict herewith; and
designating this ordinance as "The
Zoning Ordinance of the City of Du-
buque"; by repealing subdivision H, of

Whereas, it is deemed advisable by
this Council to amend the Zoning Ordi-
nance and the Zoning Map of .the City
of Dubuque, entitled: "Ordinance No.
3-34. An Ordinance to provide for the
comprehensive zoning of the City of
Dubuque, and to regulate and restrict
the location and use of buildings, struc-
tures and land far trade, industry, resi-
dence,. or other purposes; to regulate
and restrict the height of buildings
hereafter erected or altered; to regu-
late and determine the area of yards
and other open spaces about buildings;
to regulate and determine the density
of use of land and lot areas and for
that purpose to divide the city into .
districts; to provide far a Board of Ad-
justment and the orderly enforcement
of the regulations hereof; to provide
penalties for the violation of the pro-
visions hereof; repealing all other ordi-
nances or parts of ordinances in con-
flict herewith; and designating this Or-
dinance as "The Zoning Ordinance of
the City of Dubuque," by repealing
Subdivision H, of Section 1 of Article
V. of said ordinance and enacting a
substitute therefore, so as to allow sign
boards and electric signs to extend six
feet from the building or structure to
which they are attached in local busi-
ness districts, and by changing certain
districts upon the Zoning Map; and
' Whereas, notice of such proposed
changes has been published, as pro-
vided by law, and that an opportunity
has been afforded to all interested par-
ties to object thereto at a public meet-
ing held on the 12th day of November,
1934, and
Whereas, no objections have been
filed to the proposed changes in said
ordinance and Zoning Map;
Now, Therefore,
Be it Ordained by the City Council
of the City of Dubuque:
Par. 463, Section 1. That subdivision
H, of Section 1 of Article V, of the or-
dinance described in the preamble here•
of, be, and the same is hereby repealed,
and a substitute in lieu thereof is here-
by enacted; so that hereafter the sub-
division shall read as follows:
"H. Sign boards and electric signs,
indicating the name and character of
business transacted on the premises,
attached to the b siding or structure,
but not suspended ar projected more
than six feet therefrom.
Par. 464, Section 2. That the Zoning
Map be, and the same is hereby amend-
ed and changed as follows:
(a) By changing, from Light Indus-
, trial District to Heavy Industrial Dis-
trict, all lands lying `between the cen-
ter line of South Locust street on the
east, and the center line of Bluff street
Extension on'the West, from the center
line of Dodge street an the north,
southerly to a point where the south
line of Rush street, if extended easter-
ly, would intersect the center line o4
South Locust street on the east.
(b) By changing from Single Resi-
dence District to Local Business Dis-
trict, the premises described as lots No.
3 and 4 of Schuler's Subdivision in the
City of Dubuque,
(c) By changing from Two Family
and Multiple Residence District to Bus-
iness District, all of Lots No. 1 of 2 of
1, and No. 2 of 2 oP 1, in McKinley's
Subdivision and Lot No. 6 of City Lot
No. 653, in the City of Dubuque, Iowa.

To the Honorable Mayor and City
Council, Dubuque, Iowa,
Gentlemen: The Main Street pav-
ing contract was awarded to the K-
M Supply Co. in the fall of 1933 and
the wage scale, according to P.W.A,
regulations, was 50c per hour far
common labor, $1.20 per hour for
skilled labor and no wage rates set
for semi-skilled labor.
At the time Mr. Mulgrew started
the construction of the Main Street
improvement, he was required to
submit to Mr. P. F. Hopkins, P.W.A.
Engineer 'at Des Moines, and Mr. E.
Boeke, P.W.A. Federal Inspector on
this Project, the hourly wage scale
he proposed to pay semi-skilled la-
bor. Mr. Mulgrew did as requested
and his rate for cement finisher,
classed as semi-skilled labor, was
60c per hour. The semi-skilled rates,
as submitted by the K-M Supply Co.
were approved by Mr. Hopkins on
April 7th, 1934, and by Mr. Boeko on
April 9th, 1934.
The K-M Supply Co. completed
their portion of the contract and
paid 75c per hour to cement finisher
which was 15c per hour more than
the miriimtim required.
At about the time that Mr, James
Lee, sub-contractor, started construc•
lion on the last block of Main Street,
both the contractor and the City of
Dubuque received word that the
Federal Government had finally set
a wage scale for semi-skilled labor
and the rate'for finisher was SOc per
hour. Up to this time the contractor
had more than compiled with al]
Government requirements and, in
my opinion, should not be required
to pay additional compensation tt
the cement finisher. ,
After lengthy discussion by cor
respondence between myself and the
Government, Mr. Hopkins came tc
Dubuque in August and we dis
cussed the situation for. severs:
hours and he wrote to Washington,
giving our side of the story.
Included in the Government de-
mand was the requirement that we
pay our engineers and inspectors,
who were regular City employees re-
ceiving afixed salary per month,
$1.20 per hour to which we objected
and this requirement was finally
waived, but they still insist that we
have the contractor pay the 80c rate
and are holding up the pavement of
$1,000.00 of our 30% grant until such
payment amounting to $87.00 is
made and certified to them.
I discussed the situation with Mr.
Czizek and Mr. Evans Saturday, No-
vember 17th, and Mr. Czizek agrees
with me that the contractor should
not be required to pay the additional
amount, and that the City of Du-
buque could legally pay this in-
creased cost to the contractor and
in this manner clear up the situation
and the City of Dubuque would re•
ceive the $1,OOD.00 that is being
withheld.

to Mr. R, M. Evans and Mr. A. H.
Martin's letter from Washington, D.
C. Also a detailed copy of the under-
payment for the various types of
labor.
Mr. M. H. Czizek will give you his
opinion on how the City of Dubuque

Gentlemen: On November 12, 1934,
the letter to the City Council from
Reverend L, Salzmann, dated No•
vember 7th, in connection with the
request to give aid to Miss Rosine
Durand on tax questions, was re-
ferred to the writer- for investigation
and report.
Today, after my investigation, it is

apparent thatahe letter very clearly
outlines the oonditions faced by the
very aged and deserving Misa Dur-
and, Miss Durand advised me of cer•
lain specific information today, as
follows
She is 83 years old, very small,
stooped and weak. However, she,
alone, is caring for her bedridden
brother-in-law, Mr. George Hoefler,
aged 80 years, who has been can-
,~ fined' to bed at Misa Durand's home
for the last seven months.
Miss Durand stated that she has
no money, but that she does not owe
many bills. This property is now
willed to her niece, Mrs, A, A.
Thome, 308 East 5th Street, Rock
Falls, Ill. Miss Durand stated that
she had paid $1,550 for this Elm
Street property about 1924 and no
mortgage now exists on said one,
half lot and small house. The lot is
about 25 feet wide. The small, two
story, frame home is located near
the alley, west of Elm Street. The
front portion of the one-half lot near
Elm Street is vacant except for gar-
den. The City record of year 1932
for assessed valuation is $900.00.
Mr. Allen Daykin assisted at the
Court House in obtaining the follow-
ing information on taxes;-
Taxes up to 1928 must have been
exempted as no prior delinquency
existed at the year 1928.
The 1928 levy was exempted by
the Board of Review.
The 1929 levy of $32,40 was not
paid by Miss Durand and had not
been cancelled or suspended. These
taxes, with penalties, were paid by
the Ed. Muntz Estate at a total sum
of $35.09, Again in 1931 the 1930 levy
amounting to $33.41 was also paid
by the Muntz Estate, together with
a special assessment of ,$8.81, or a
total paid by the Muntz Estate equal
to $77.31. The 1931 and 1932 levies
were also exempted by the Board of
Review,
Special assessments still unpaid
on this property include: Yearly as-
sessments due in 1933 and 1934 for
the paving of Elm Street, City Fund
No. 649, amounting to $17.54 which
includes interest to December 1st,
1934. No other unpaid special as-
sessments are recorded against this
property.
After a visit with Mr. Alfred C.
Cartigny this afternoon, Mr. ~Car-
tigny advised that it was not in-
tended to force Miss Durand from
her home and that the Muntz Estate
had agreed to acceptfrbm the Coun-
ty or City the amount of actual cash,
with interest, that they had invested
in the total payments.
Today Mr. J. J. Shea advised of
the receipt of a further request to
suspend the 1933 levy and for 1934
taxes. It would seem that suspen-
sion should be considered by the
City Council, due to the willing of
the property in the future to Miss
Durand's niece.
If Council and the Board of Super-
visors can be advised that legally
they can pay the principal of •$77,31,
plus interest tc the Muntz Estate
and then suspend these taxes, to-
gether with penalties for the tax lev-
ies of 1929, 1930 and possibly 1933,
and charge all such suspensions to
the S. r/z of Lot 138, East Dubuque
Addition, Miss Durand will be great-
ly pleased. If such a plan is impos-
sible, it would seem that Mr. Car-
tigny's promise to not try to secure
this Property while Miss Durand is
able to live there would still be suf•
ficient to assure Miss Durand that
she tvil] have her property for her
own use for at least her lifetime
In case some agreement is de-
sired to be made ,with the Muntz
Estate, definitely agreeing in writing
that no change from their present
plans will be made so as to force
Miss Durand from her property,
please advise.

Gentlemen: Request has been
made by Mr. 0. F. Millin of 976 Iowa
Street, Dubuque, that authority be
granted by the City Council to in-
stall on Iowa Street a new catch-
basin along the Iowa Street east
curb between 9th and 10th Streets.
The purpose of this request is to
prevent water, as in the past years,
from running over the law curb and
entering Mr. Millin's yard and cellar
at the periods of melting snow when
the flat gutter does not properly
drain the surface water, due to ac-
cumulation of ice.
This question has been presented
to the City Council before. Delay
was caused due to our belief that

flooding trouble. Mr. Millin now says
that the melting of heavy snow has
been the chief trouble.
The City Manager suggests that

the storm sewer in Iowa Street at
a certain manhole near there,

The lowest combined bid for Mr
Grover Blunt includes the Tractor
made by the Allis-Chalmers Co. Thi
tractor is of 15" wide track tread
while the other three bids includ
16" track treads, however it i
stated by Mr. Blunt that 18" avid
treads can be secured for $15.00 ad
ditional, The draw-bar H.P, ratin
of the Allis-Chalmers Tractor is th
highest of all the bids, viz. 49.5
H.P. as compared with Bid 2-45.
H.P.; Bid 3-44,2 H.P. and Bid 4-
38,65 H.P. However, the lowest bid,
Allis-Chalmers, includes only three
speeds forward as compared with
five speeds forward in Bid 2. The
International Harveser Company's
Bid 2, Tractor is rated at a higher
pound pull at low speed and at high-
est speed ,than the Allis-Chalmers
Tractor, at lowest and highest
speeds. All the other specifications,
except Allis-Chalmers, include trans-
misslon oil pumps and filters.
Regarding use of Tractors, Mr.
Blunt states that about 300 No. 35
Models are now in use in Iowa. Mr.
Antle for the International Harves•
ter Company states that there are
over 1000 TA 40 models in use in
various states. Mr. Geo. Back states
that there are 15,000 gasoline "Cater-
pillar" No. 35 models in use in the
world. The "Cletrac" Tractor Com-
dust•y andehasn eceutly soldathe U.
S. Government a large order.
Regarding the use of the blade
equipment that must be attached to
the Tractor, Mr. Blunt states that
his type Gradebuilder 121-A is new
in this section and that no definite
assurance can be given that any
models are in use in this section.
However, this design has been used
in the west, but not made by the
Baker Mfg. Company.
We have data from several
sources that the Continental Trail-
builder, included in Mr. R. C, Fos-
ter's bid and that also of the Austin-
Western Company's bid has been in
use for about 8 years; that over 300
models of this type have been sold
and that after investigation, the U.
S. Forestry Service this year bought
60 new models. The LaPlante•
Choate Roadbuilder, included in Mr,
Bock's bid, is also known to be in
use for years, including many sales.
Our old 60 Model included this type.
In connection with the supply of
parts for maintenance of the four
tractors as quoted, the following

Gentlemen: In connection with
the fire that seriously damaged the
three story brick building an the
east side of Main Street, numbers
438 to 448, on April 28, 1934, a ser-
ious effort has been made to have
this unsafe structure removed or re•
built, but no results to date have
been secured.
On July 10th a protest was filed
with the City Manager by other
property owners of Main Street,
complaining about the delay of raz-
ing' or repairing this unsafe struc•
tore.
Two minor fires have resulted
since the initial fire April 28th, due
to boys playing and starting fires in
the basement, which basement is
dangerous and should not be
entered.
Advice has been given that insur•
ante was paid on the fire loss in
June, 1934,
On July 12th, after contact with
the Sisters of the Holy Ghost, we
were advised to wait until Father
O'Malley would return from Europe
about August 1st. This gentleman
was interviewed and stated that the
Sisters were planning either on the
sale of the burned building and land
or rebuilding the structure into a
two-story building, No definite plan,
however, as yet can be secured from
the Sisters.
On October 6, 1934, the Sisters of
the Holy Ghost were again notified
in writing by Mr, Bartels of the re-
quirement of the Building Code, Sec-
tion 642, that this decision and ac-
tual reconstruction moat be per-
formed by October 28th, six months
after' the fire,
Since then the officials of the
Chancery have been interviewed and
the question has been submitted to
His Grace, Archbishop Beckman,
Attached is a report from Mr.
Bartels, dated November 20, 1934,
advising that no one will now take
action to clean up these ruins.
Accordingly, this serious hazard is
now presented to the City Council,
in accordance with Part XIII, Sec-
tions 542 and 544 of the Building
Code, for the consideration, by legal
procedure, of condemnation,

stairway; Frame garages on the

Gentlemen: The Women's Relief
Organization, in connection with the
Milwaukee Railroad Shops, again re•
quests that the City Council auth-
orize City trucks to haul coal to cer-
tain Milwaukee former employees
who are in drastic need of assist-
ance and who have no other means
of providing for coal except by the
donation of the Milwaukee Railrcad
of freight, coal by the employees
and hauling by the City.
This has been granted for the past
three years.
