Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
Commissioner Norton recused himself due to a conflict of interest.
The applicanYs representative spoke in favor of the request.
Staff reviewed the staff report, noting the property location and that the plat of survey
was being jointly reviewed by the City and County of Dubuque. Staff reviewed that
access to Lot 1 was provided by an existing farm lane even though Lot 1 did not have
frontage on a public or private street.
There were no public comments.
The Zoning Advisory Commission discussed the request, inquiring about the irregular
lot lines from Lot 1 and Lot 2. The applicanYs representative explained the lot lines
follow the topography of land and existing tillable area of the property. Staff noted this is
common practice for lots in the County.
Recommendation
By a vote of 5 to 0, with one abstention, the Zoning Advisory Commission recommends
that the City Council approve the request.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of BGJ Kremer Place resubdivides 65.28 acres of property
into two parcels of land. The property is located in Dubuque County near Highway 151
just north of the Airport. The submitted Plat of Survey is being jointly reviewed by both
the City and County of Dubuque as it is within two miles of the city of Dubuque
corporate limits.
DISCUSSION
The submitted Plat of Survey of BGJ Kremer Place resubdivides existing property into
two new parcels to facilitate the sale of the property. The Zoning Advisory Commission
is reviewing this simple lot split as Lot 1 will not have frontage on a public or private
street. However, Lot 1 contains the existing farm house and related farm buildings, and
has an existing gravel lane that has served the property for many years. This is
illustrated on the submitted Plat of Survey.
The submitted Plat of Survey is in all other respects in compliance with the City of
Dubuque subdivision regulations contained in the Unified Development Code.
RECOMMENDATION

A RESOLUTION APPROVING THE PLAT OF SURVEY OF BGJ KREMER PLACE IN
DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey BGJ Kremer
Place in the Dubuque County, Iowa; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Rat of Survey has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Plat of Survey BGJ Kremer Place is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa upon said Plat of Survey.
