City Engineer Gus Psihoyos is recommending acceptance of the public storm water
detention facility improvements that the developer, Nemmers Cedar Ridge Farm Limited
Partnership, has recently completed in Cedar Ridge Farm Place No. 7 Subdivision.
Maintenance of the detention facility would become the responsibility of the City with the
costs for same being assessed to the property owners within Cedar Ridge Farm Place
No. 7.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public storm water
detention facility improvements that the developers, Nemmers Cedar Ridge Farm
Limited Partnership, have recently completed in Cedar Ridge Farm Place No. 7
Subdivision.
BACKGROUND
Cedar Ridge Farm Place No. 7 Subdivision includes 13 commercial lots off of Cedar
Crest Court. As a condition of subdivision plat approval through Resolution No. 489-04,
the developer of Cedar Ridge Farm Place No. 7 Subdivision was required to install
certain public improvements including street paving with curb, sanitary sewer main,
watermain, storm sewers and catch basins, boulevard street lighting, and storm water
detention facilities and to dedicate said improvements to the City upon completion. In
2007, all public improvements were completed by the developer and accepted by the
City except for the storm water detention facility.
DISCUSSION
Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On August 8, 2017, the owners requested City's acceptance of the storm water
detention basin improvements in Cedar Ridge Farm Place No. 7 Subdivision. As a
condition of subdivision plat approval through Resolution No. 489-04, Section 4, the
developer of Cedar Ridge Farm Place No. 7 Subdivision was required to own and
maintain the storm water detention facility until all of the following were complied with:
1. The detention basin has been fufly completed.
2. 8Q% of Lot B and subdivision thereof have been developed.
3. Adequate erosion control measures, as approved by the City, have been
installed on the remaining 20% of said Lot B.
Upon review and inspection by the City, it has been determined that the above
described conditions from Section 4 of Resolution No. 489-04 have been met and that
the public improvements required by Resolution No. 489-04, have been completed in �
accordance with plans approved by the City Council and in conformance with City
specifications. Maintenance of the detention facility would become the responsibility of
the City with the costs for same being assessed to the property owners within Cedar
Ridge Farm Place No. 7.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the public storm water
detention facility improvements as described above.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
storm water detention facility improvements in Cedar Ridge Farm Place No. 7
Subdivision.

CEDAR RIDGE FARM PLACE NO. 7 SUBDIVISION, IN THE CITY OF DUBUQUE,
IOWA
Whereas, pursuant to Resolutions 489-04, certain public storm water detention
facility improvements were installed by the developer of Cedar Ridge Farm Place No. 7
Subdivision in the City of Dubuque, Iowa; and
Whereas, the improvements have been _completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications, and has recommended that the improvements be accepted by the City
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and that
said public storm water detention facility improvements in Cedar Ridge Farm Place No.
7 Subdivision be and the same is hereby accepted.

A RESQLUTION APPROVING THE FiNAL PLAT OF CEDAR RIDGE FARM
PI..ACE NO. 7 IN THE ClTY OF' DUBUQUE, IOWA.
Whereas, there has been �led with the City Clerk a final plat of Cedar Ridge Farm
Place No. 7 in the City of Dubuque, lowa; and
Whereas, upon said final plat appears a streei to be known as Cedar Ridge Court
(Lot A), together with c�rtain public utility and sewer easements which the owners by said
fina( plat have dedicated ta th� public forever; and
Wher�as, the preliminary plat has been examined by the Zoning Advisory
Commissian and had its approval endorsed thereon; and
Whereas, said final p(at has been reviewed by the City Planner and had her
approval endorsed thereon, subject ta the Qwners agreeing to the conditions noted in
Section 2 belaw; and
Whereas, said final plat has been examined by the City Council and they�nd that it
conforms to the staiutes and ordinances relating to it, except that no streets or pubiic
utilities have yet been construcied or installed.
NOW, 7HEREFORE, BE IT RESOL.VED BY THE CITY COUNC{L OF THE C{TY
OF DUBUQUE, IQWA:
Section 1. That the dedication oi C�dar Crest Court (Lot A) , toqether with the

Section 3. Sidewalk installation shall be the responsibility of the owner of ths
property abutting the public right-of-way, as required by City Code 41-161 through 41-164.

will no# be required until the developm�nt of the lat has been completed, except as required
herein. In sparsely developed subdivisions, sidewalks on developed lots will not be

Sectian 5. Upon the City's acceptance of the detention faciVity, the undersigned
owner hereby agrees th�t periodic inspection, administrative and mainienance expenses
incurred by th� City af Dubuque 1or th� storm waler detention facility shall be assessed
against Lat B anci all subdivisior�s of Lot B in propa�lion ta the acreage of each lot as a I
percentage af th� acreage in the subdivision. Such costs wiH b� depend�ni upan the
condiiion of the facility. �'he City Manager sriall certify�uch costs to the City Cierk, wha in
turn shall then be collecied with and in the same manner as general property taxes in
accordance with provisions of law.
Section 6. Tliat the final a�ceptance oi afi public improvements shall occur upon
