Parking System Supervisor Tim Horsfield is recommending City Council approval of a
28E Agreement with the Dubuque County Treasurer's Office. This agreement will allow
the Dubuque County Treasurer's Office to place a "hold" on a vehicle registration until
parking fines owed to the City of Dubuque are paid. Upon payment of the parking fines
to the City of Dubuque, the vehicle owner will be able to renew their vehicle registration.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

In 2007, the Iowa Legislature passed a bill indicating the County Treasurers in
the State of Iowa provide assistance in the collection of parking fines for
municipalities.
For some time, I have been working with officials from Des Moines, Polk County
and IDOT to identify how we can implement this process and begin collection
activities here in Dubuque.
In speaking with officials from IDOT, the first thing we need to provide to them is
a signed 28E agreement between the Dubuque County Treasurer and the City of
Dubuque to begin the process. Secondly, we will have our Information Services
staff coordinate a daily data transfer from our parking enforcement software to
IDOT files providing a daily update of license plates with outstanding parking
tickets and also an update of license plates that have been paid in the last day.
This daily transfer of information will place and remove "holds" on vehicle
registrations automatically.
I have had extensive conversations with Eric Stierman, Dubuque County
Treasurer regarding this process and he is fully on board. The information at the
Treasurer's office will indicate a hold on a vehicle having any unpaid parking
tickets when someone comes in to renew their vehicle registration. At that time,
the Treasurer's office staff will simply advise the individual at the window that
they have parking tickets and that they have to be paid prior to renewal. That
person then will need to go to City Hall or the Parking Office and pay any
outstanding fines. They can then return to the Treasurer's office with a receipt of
payment and renew their vehicle registration.
Our records indicate that we have approximately $107,000.00 in delinquent fines
in just the past 12 months. This new process should assist us greatly in the
collection of these past due fines.

Following conversations with the Treasurer, I am submitting for you review
approval and subsequent request for City Council approval, the attached 28E
Agreement between the City of Dubuque and the Dubuque County Treasurer's
Office. This document was authored by Crenna Brumwell from the Legal
Department. Eric Stierman is concurrently submitted the agreement to the
Dubuque County Board of Supervisors for their approval.

COOPERATIVE AGREEMENT BETWEEN
THE CITY OF DUBUQUE, IOWA AND DUBUQUE COUNTY
FOR COLLECTION OF CITY OF DUBUQUE PARKING TICKETS
THIS AGREEMENT made an entered into this /3ti day of

Dubuque County, Iowa (County) WITNESSETH:
WHEREAS, it is in the best interest of the City and County to enter into this
cooperative agreement,
THEREFORE, IN CONSIDERATION of the recitals, representations, covenants,
and Agreements set forth herein, the parties herby represent, covenant and agree as
follows:
1. City parking tickets that are unpaid within seven (7) days after the date of
issuance, are eligible to be presented for collection through the Dubuque
County Treasurer's Office and the Iowa Department of Motor Vehicles.
2. Designated City personnel shall be allowed access to County records to
indicate the license plates of those vehicles with outstanding and unpaid City
parking tickets. It shall be the responsibility of the City to update this
information daily to ensure the status of a ticket is changed due to payment at
City Hall, or a ticket being voided for any reason. The City shall hold the
County harmless and the City shall assume all liability for any failure to
update the status of a ticket.
3. The Dubuque County Treasurer shall place a hold on an account with unpaid
City parking tickets. Any person with a hold placed on the person's account
shall be referred to City Hall in order to make payment on the account. Upon
submitting a City receipt indicating a zero account balance, or the daily
update of the account records by City staff, whichever is first, the County shall
remove the hold from the account.
4. This Agreement shall take effect upon approval by both parties and shall
continue in effect until terminated as set forth herein.
5. This Agreement may be terminated at any time by either party upon thirty (30)
days written notice to the other party.
6. The County Treasurer and the City of Dubuque Parking Systems Supervisor
shall administer this Agreement. The County Treasurer shall consult with the
Dubuque County Board of Supervisors and the Dubuque Parking Systems
Supervisor shall consult with the Dubuque City Manager on matters related to
this Agreement. No real or personal property shall be acquired by either party
during the term of this Agreement.
7. Any notices, demand, or communication to be given pursuant to this
Agreement shall be in writing and mailed by certified mail, postage prepaid
and properly addressed to the parties as follows:
