Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicanYs representative spoke in favor of the request, explaining the site will have
two access points, but not to Cedar Cross Road.
Staff reviewed the staff report, noting this site is in a Planned Unit Development (PUD)
that stipulates site plans must be reviewed by the Zoning Advisory Commission and City
Council. Staff noted the site plan has been approved by the Development Review
Team. Staff noted the site access on an aerial photo.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it was appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request. ;

INTRODUCTION
In November 1997, Richard Hansel received zoning approval for a PUD Planned Unit
Development with a PC Planned Commercial designation for property located at the
southwest corner of Cedar Cross Road and Starlite Drive. As part of the Ordinance
approving the planned commercial district, it was required that all final site development
plans be submitted and approved by the Zoning Advisory Commission and City Council
to assure they are in compliance with regulations adopted for the planned commercial
district.
DISCUSSION
IIW Engineers & Surveyors have submitted a site plan for the ENT Medical Office
building to be located between Birch Fireplace and Patio and Vision Health Center at
the south end of Cedar Lake Plaza and fronting on Cedar Cross Road. Attached to this
memorandum is a copy of the site plan for the proposed new business and a copy of
Ordinance 63-97 that established the planned commercial district and a copy of the
conceptual plan approved in 1997.
The proposed medical office building will take its access from the existing reciprocal
access easements available on either side of the subject site. There will not be any
direct access onto Cedar Cross Road from the subject property. This arrangement was
part of the original concept for the development to limit the number of access points
along Cedar Cross Road. The submitted site plan is in all other respects in compliance
with the adopted planned commercial district regulations and the conceptual plan.
RECOMMENDATION
The submitted site plan for the ENT Medical Office Building is in compliance with the
adopted PUD Ordinance for the property and staff recommends approval of the
submitted site plan.

C, Performance Standards.
The development and maintenance of uses in this PUD District shail be
- established in conformance with Section 3-5.5 of the Zoning Ordinance and
the foilowing standards:

1) Proposed public streets in the Pianned Commerciai development shall be
designed and buitt to City Engineering specifications.
2) Erosion control devices shall be pravided during ail phases of construction
of the Pianned Commercial development.
3) Parking tequirements for aliowed uses in the PC developments shall be as
per the parking group for the designated use, in accordance with Section.
4-2 of the Zoning Ordinance.
4i Sidewalks shall be provided adjoining all public streets inciuding Starfight
Drive and Cedar Cross Road.
5) Storm water detention facilities wiii be instailed as per City Engineering
requirements.
6) Finat site deveiopment plans shall be submitted in accordance with
Section 44 of the Zoning Ordinanca of the City of Dubuque, lowa, prior
to construction of any buildings. No commercia! building shall be
constructed untess it was included in final site development pians
submitted on a building by buiiding basis as the site develops and
approved by the Zoning Advisory Commission and City Councit.
D. Ooen So�e and Recreational Ar - c
Open space and landscaping in the PU� Disuict shall be regulated as follows:
1) A screen of deciduous and evergreen trees shall be planted atong Stariight
Drive and Cedar Cross Road to act as a buffer between ihe proposed
Planned Commercia( development and the adjacent existing residentiat
development. Evergreen screening to be 6 feet in height within three
growing seasons shall be planted 5 feet on center in this 6uffer.
2) Those areas not designated on the conceptuai plan for development shai(
-- be maintained as open space, as defined by Section 8 of the Zoning
Ordinance, by the propetty owner and/or association.
3) Buiiding pads shall be maintained below the grade of Cedar Cross Road
- and Starlight Drive.

Signs in the PUD District shall be �egulated as follows:
1) Signs shall be allowed in the Ptanned Commercial development in

1) That all previously approved conceptual developmenS pians are hereby
amended to ailow for the attached conceptual development pian.
G. Transfer of Ownershio
Transfer of ownership or lease of property in this PUD District shail inciude in
the transfer or lease agreement a provision that the purchaser or_lessee
acknowledges awareness of the conditions authorizing the establishment of
the district.
y, �classification of Subject Praoertv.
The City of Dubuque, lowa, may initiate zoning reclassification proceedings to
the AG Agricuhural District in accordance with Section 6 of the Zoning
Ordinance if the property owner(s) faii(s) to complete or mainiain any of the
conditions of this o�dinance.
I. Modifications.
Any modifications of this Ordinan�e must be approved by the City Councii in
accordance with zoning reclassification proceedings of Section 6 of the Zoning
Qrdinance.
J. Re .sordina•
A copy of this ordinance shall be recorded at the expense of the property
ownertsl with the Dubuque County Recorder as a permanent record of the
conditions accepted as part of this reclassification approvat within ten (101
days after the adoption of this ordinance. This ordinance shaii be binding
_ upon the undersigned and hislher heirs, successors and assigns.
