Van Milligen, City Manager Gus Psihoyos, City Engineer FROM: Robert Schiesl, Assistant City Engineer SUBJECT: lowa Department of Transportation - SWiss Valley Interchange Project Wetland Mitigation Agreement Agreement No. 2018-16-265 DATE: June 12, 2018 INTRODUCTION The purpose of this memorandum is to request authorization for the City to enter into an agreement with the lowa Department of Transportation (lowa DOT) for the construction and management of a stream and woodland mitigation project that will offset impacts from the upcoming lowa DOT SWiss Valley Interchange Project. BACKGROUND The lowa DOT is developing a projed to reconstrud US Highway 20, beginning at Cottingham Road and ending at Seippel Road, and constructing a new system interchange at the intersedion of US Highway 20 and Swiss Valley Road. This projed, known as the Swiss Valley Road Interchange Project will tie into the Southwest Arterial Project, currently under construction and administered by the City. In order to mitigate the unavoidable environmental impacts within the Catfish Creek watershed due to the Swiss Valley Road Interchange Projed, the lowa DOT approached City staff about making improvements on a site located on nearby City- owned property. The identified mitigation site has a segment of South Fork Catfish Creek, along with associated wooded and grass riparian zones. The segment of South Fork Catfish Creek running through the site was recently improved by the City in partnership with the Catfish Creek Watershed Management Authority (WMA) through the State Revolving Fund loan sponsorship program. The proposed site is shown on the attached Exhibit A. The Corps of Engineers has issued a permit authorizing the mitigation work associated with Swiss Valley Project. The permit allows for the resulting impacts to be mitigated through the restoration, enhancement, creation and preservation of streams, wetlands, woodland and existing natural areas on the nearby property owned by the City. The lowa DOT prepared and presented the attached Wetland Mitigation Agreement for the City's consideration. DISCUSSION Per the proposed Wetland Mitigation Agreement, the lowa DOT will design, bid, and administer a project to construct riparian benches, rock riffles, and stream bank stabilizations within the approximate 8.3-acre area within the City property. This will include earthwork, seeding, and any other associated work deemed necessary. They will also plant approximately 22.8 acres of South Fork Catfish Creek floodplain to a savanna type tree planting. Some of the existing young trees will be cleared and replanted with more desirable and diverse species. Additionally, approximately 15.4 acres will be enhanced by selective tree clearing of undesirable weedy invasive species. The lowa DOT will insure the success of the mitigation improvements and perform any corrective measures deemed necessary by the lowa DOT, lowa Department of Natural Resources (DNR), or the Corps of Engineers (COE). They will also be responsible for two years of tree replacement and mowing responsibilities. Because the City already owns the property, it is currently responsible for the costs associated with maintaining the natural drainage through the property. The proposed improvements will result in a more sustainable, non-erosive creek which will minimize any significant future maintenance costs. Moreover, per the Agreement, it will be lowa DOT's responsibility to "maintain and/or repair the (City property) in the event of catastrophic damage...including but not limited to extraordinary siltation, loss of structures, severe scour erosion, etc." Per the Agreement, the City would maintain and manage the vegetation, such as controlling noxious weeds, beginning in year three after construction. The City will need to protect the property and maintain it for its environmental purpose in perpetuity but would be able to establish trails, signs, or any other facilities deemed necessary by the City as long as it does not detract from the integrity of the designated mitigation areas. RECOMMENDATION I recommend that the City be authorized to execute the lowa Department of Transportation Wetland Mitigation Agreement (Agreement No. 2018-16-265) to create mutually beneficial sustainable stream and woodland improvements on property owned and maintained by the City. Iowa DOT Agreement No. Staff Action No. Dubuque NHSN-020-9(249)--2R-31 2018-16-265 This Agreement is entered into by and between the Iowa Department of Transportation, hereinafter designated the "DOT" and the City of Dubuque, hereinafter designated "CITY" in accordance with Iowa law as follows: The DOT proposes to reconstruct U.S. Highway 20 (U.S. 20) and associated side roads beginning at Cottingham Road and ending at Seippel Road; in Dubuque (grading projects NHSX-020-9(251)--3H-31 and NHSX-020-9(183)--3H-31). This project (known as the Swiss Valley Road Interchange Project (Swiss Valley)) will tie into the Southwest Arterial Project, currently under construction and administered by the CITY. 1. The CITY has offered parts of a large property (Parcel 1031376002, hereinafter designated SITE) owned by the CITY to provide stream and woodland mitigation for unavoidable impacts from the Swiss Valley project. Most of the lower elevations of the property were used by the CITY in partnership with the Catfish Creek Watershed Management Authority (WMA) to improve a segment of South Fork Catfish Creek, which was authorized by D.A. Permit #2016-1424. The SITE will be known as Upper Catfish Creek, which has a segment of South Fork Catfish Creek and an unnamed tributary, along with associated wooded and grass riparian zones. The SITE is located in the SW 1/4 of Section 31, T -89N, R -2E (Dubuque Township), in the City of Dubuque, in Dubuque County, Iowa (see attached Exhibit A). The U.S. Army Corps of Engineers (Corps) has issued Department of the Army 404 Permit (Permit): The Permit authorizes the work associated with Swiss Valley and at the SITE. The Permit indicates that the stream impacts from Swiss Valley can be mitigated at the SITE. The issued Permit requires the restoration, enhancement, creation and preservation of streams, wetlands, woodland and existing natural areas (not including enhancement areas) at the SITE. 2. The SITE is currently owned by the CITY and includes approximately 2,258 linear feet of 2nd order perennial stream channel. This stream is a direct tributary to South Fork Catfish Creek (see Exhibit A). 3. As will be required by the Permit, an approximate 8.3 acre area within the SITE is designed to restore/improve approximately 2,258 linear feet of stream by constructing riparian benches, rock riffles, and stream bank stabilizations. 4. The DOT and CITY will cooperate on the management, and maintenance of the SITE in accordance with the following terms and conditions. A. The DOT agrees to: (1) Design, let, and administer a project to construct riparian benches, rock riffles, and stream bank stabilizations within the approximate 8.3 acre area within the SITE (see Exhibit A). This will include earthwork, seeding, and any other associated 2018-16-265_Dubuque_Catfish Creek_28E 1 August 2016 work deemed necessary. Maintain and/or repair the SITE in the event of catastrophic damage that results in non-compliance of the Permit, including but not limited to extraordinary siltation, Toss of structures, severe scour erosion, etc. Provide and install signs as needed on the boundary of the Site. Insure the success of the stream mitigation and perform any corrective measures deemed necessary by the DOT, Iowa Department of Natural Resources (DNR), or the Corps. Monitor the SITE as required by the Permit for a period of at least 5 years and submit annual monitoring reports during this period to the Corps and DNR. The DOT will fulfill all requirements related to the required stream mitigation monitoring at the SITE and, after 5 years of successfully fulfilling monitoring requirements, DOT will not conduct any further monitoring. (6) Obtain all permits for both the highway and mitigation construction. (7) Comply with and fulfill all conditions listed in the Permit. (8) Plant approximately 22.8 acres of South Fork Catfish Creek floodplain to a savanna type tree planting. Areas within the SITE will have an existing monoculture of young trees (mainly Acer negundo) cleared and replanted with more desirable and diverse species. Additionally, approximately 15.4 acres will be enhanced by selective tree clearing of undesirable weedy invasive species (See Exhibit A). Grubbing of roots or other methods of fill or high disturbance will not be part of this agreement due to presence of three known cultural sensitive sites. (9) Ensure two years of tree replacement and mowing responsibilities are performed by a private contractor. B. The CITY agrees to: (1) Maintain and manage the vegetation in the site beginning in year three after construction. (2) Not cause designated stream mitigation practices in the SITE to become non- functioning. The CITY shall replant (at the CITY's expense) any trees planted by the DOT that are killed by prescribed burning initiated by the CITY. (3) Participate in an inspection of the SITE, if requested by the DOT. (4) Notify and obtain permission from the DOT, Corps and DNR for construction activities at the SITE (e.g. trails, canoe launches, etc.) Site amenities may not decrease stream mitigation functions or woodland acreages required by the Permit. Grant the DOT, DOT researchers or private consultants hired by the DOT right of entry to the SITE and savannah planting area at any time. (5) 2018-16-265_Dubuque_Catfish Creek 28E 2 August 2016 (6) Maintain the SITE boundary in perpetuity. (7) Control noxious weeds within the SITE. (8) The CITY, its assigns or any successors in interest agree to not detract from the integrity of the designated mitigation areas within the SITE, with its activities and improvements on the SITE. The DOT shall not object to the establishment of any trails, signs, or any other facilities deemed necessary by CITY. The CITY, its assigns or any successors in interest assume all of the DOT responsibilities and obligations, outside of the obligations assumed by the DOT in Section 4 (A) of this agreement, to protect the premises and maintain the premises for its environmental purpose as stated in the Permit. The CITY shall defend, indemnify and hold harmless the DOT, its officers and employees, from all suits, actions, or claims of whatever character, because of any act, omission, or neglect relating in any manner to the CITY'S ownership and use of the SITE pursuant to this agreement. (9) (10) Maintain and erect signs within the SITE, as desired. It is understood and agreed that the CITY retains the right to allow public hunting, fishing, and other similar types of non-destructive recreation on the SITE as may be permitted by law. Establishment and maintenance of any said signs, or any other facilities shall not detract from the integrity of the SITE as stream and woodland mitigation, and shall be acceptable to the DOT, the Corps, and the DNR. (11) Prohibit the recreational usage of all -terrain vehicles on the SITE by the public. It is understood and agreed that DOT or CITY personnel, or private contractors hired by the DOT or the CITY, shall be permitted to utilize all -terrain vehicles on the site only to conduct activities related to site monitoring, management, maintenance, or remediation. For instances when all -terrain vehicles are utilized on site by DOT or CITY personnel, or private contractors hired by the DOT or the CITY, these vehicles must avoid damage to stream mitigation areas and woodland tree plantings. (12) Grant the DOT the right to perform any corrective measures at DOT expense, deemed necessary to meet Permit requirements including earthwork and installation of signage, at any time. 5. Future development or land -use conversion of the SITE, or any part thereof, for any purpose which may interfere with or be detrimental to the function, intention or integrity of the SITE, is prohibited. 6. In accordance with Iowa Code Chapter 216, neither party shall not discriminate against any person on the basis of race, color, creed, age, sex, sexual orientation, gender identity, national origin, religion, pregnancy, or disability. 7. If any part of this agreement is found to be void and unenforceable then the remaining provisions of this agreement shall remain in effect. 8. It is the intent of all parties that no third party beneficiaries be created by this Agreement. 10. This Agreement may be executed in counterparts, each of which so executed will be deemed to be an original. 11. This Agreement, as well as the unaffected provisions of any previous agreement(s), addendum(s), and/or amendment(s); represents the entire Agreement between the CITY and DOT regarding this SITE. All previously executed agreements will remain in effect except as amended herein. Any subsequent change or modification to the terms of this Agreement will be in the form of a duly executed amendment to this document. 12. The CITY, its assigns or any successors in interest agree that the planting or harvesting of any crop on the SITE for profit is prohibited. It is understood and agreed that the establishment of wildlife food plots by the CITY shall be permitted as long as said food plots do not detract from the integrity of the stream or woodland mitigation areas.
