City Engineer Gus Psihoyos is recommending acceptance of the public improvement
construction contract for the FY17 Sewershed 10 Sanitary Sewer Manhole Project, as
completed by Drew Cook & Sons Excavating, in the final contract amount of
$127,349.21 , which is a 4.24°k increase from the original contract amount of
$122,161 .00. The cost increase was primarily due to unsuitable backfill materials found
during construction and additional sanitary sewer fittings.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the acceptance of the public improvement
construction contract for the FY17 Sewershed 10 Sanitary Sewer Manhole Project.
BACKGROUND
The City of Dubuque, lowa is under a Consent Decree according to Case
2:11-cv-01001-EJM, United States of America and the State of lowa v. the City of
Dubuque, IA (N.D. lowa), Civil Action Number 2008V00041, DOJ Case Number
90-5-1-1-09339 effective June 27, 2011. The City is required to submit Corrective Action
plans for each of the Sanitary Sewersheds identified in the Consent Decree. The
FY2017 budget appropriated funds for sanitary sewer manhole improvements in the
Consent Decree Correction Action Plan.
DISCUSSION
ThP 2�17 Sewershed 1� Manhols Replacement Pro}ect was completed by Drew Cook
& Sons Excavating of Dubuque, lowa, in the final contract amount of$127,349.21 which
is a 4.24% increase from the original contract amount of$122,161.00. The project
included the replacement of fourteen (14) manholes and the elimination of four (4)
manholes in Sewershed 10. The cost increase was primarily due to unsuitable backfill
materials found during construction, and additional sanitary sewer fittings.

RECOMMENDATION
The City Council is requested to adopt the attached resolution to accept the
improvements and to authorize the payment of the contract amount of $127,349.21 to
Drew Cook & Sons Excavating for the FY17 Sewershed 10 Sanitary Sewer Manhole
Project.

RESOLUTION NO. 197-18
ACCEPTING THE THE FY17 SEWERSHED 10 SANITARY SEWER MANHOLE
PROJECT
WHEREAS, the public improvement contract for the FY17 Sewershed 10 Sanitary
Sewer Manhole Project, (the Project) has been completed by the Contractor, Drew
Cook & Sons Excavating (Contractor), the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $127,349.21;
WHEREAS, the Contractor has previously been paid $120,981.75, leaving a balance
of $6,367.46; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $6,367.46 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa
Code chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that
he has inspected the FY17 Sewershed 10 Sanitary Sewer Manhole Project, and that
said Project has been performed in compliance with the terms of the Public
Improvement Contract, and that the total cost of the completed work is $127,349.21.
