INTRODUCTION
This memorandum transmits a resolution authorizing the FY 2019 CDBG environmental
review record and authorize a Request for Release of Funds and Certification for the FY
2019 CDBG programs and activities.
BACKGROUND
As required by the Community Development Act of 1974, as amended, the City of
Dubuque must conduct an environmental review finding for projects to be funded in the
Community Development Block Grant Program.
The Environmental Review Record is one component of the complete environmental
review. The City published notice and written determinations, or environmental findings
required by Part 58 as evidence of review, decision making actions, and pertaining to
particular projects yet to be identified, as part of the environmental review process.
The City is the Responsible Entity for activities in the jurisdiction of Dubuque.
Community Development Specialist Erica Haugen completed the environmental review
for the attached projects within the jurisdiction of Dubuque. Activities proposed are
categorized as: Exempt from NEPA review; Categorically Excluded and NOT subject to
§58.5 authorities; Categorically Excluded SUBJECT to §58.5 authorities. The attached
Environmental Review Record establishes a level of review for each activity planned for
Fiscal Year 2019 and will be amended as necessary when new activities are added.
Activities requiring compliance measures not described in the attached review record or
requiring a Phase I or Phase II environmental assessment require a separate
environmental review.
Prior to expending federal grant funds, the City must request for release of funds and
certify those funds will be used in accordance with federal requirements. Notice of
Intent to Request Release of Funds was published in the Telegraph Herald on July 27,
2017 to begin seven (7) day local comment period. Following the local comment period,
the review findings and Request for Release of Funds and Certifications will be
forwarded to HUD for a fifteen (15) day comment period prior to HUD authorizing the
use of funds.
RECOMMENDATION
The recommended action is to approve the resolution authorizing the environmental
review determination and request for release of funds and certification for the Fiscal
Year 2019 CDBG programs and activities.
ACTION STEP
The requested action is for the Mayor, as the Certifying Officer for the City of Dubuque,
to sign the attached Environmental Review Determination and Request for Release of
Funds and Certification(s).

A RESOLUTION AUTHORIZING REQUEST FOR RELEASE OF COMMUNITY
DEVELOPMENT BLOCK GRANT FUNDS FOR FISCAL YEAR 2019 (PROGRAM
YEAR 2018)
Whereas, the City of Dubuque will enter into a Community Development Block Grant
Agreement for the Fiscal Year commencing July 1, 2018, with the U.S. Department of
Housing and Urban Development, providing for financial assistance to the City under Title
of the Housing and Community Development Act of 1974, as amended; and
Whereas, pursuant to the rules and regulations as promulgated by the U.S.
Department of Housing and Urban Development, an environmental review has been
processed for the hereinafter listed projects to be financed with Community Development
Block Grant funds; and
Whereas, a Notice of Intent to Request Release of Funds for said grants has been
published on July 27, 2018 to commence the required seven (7) day public comment
period; and
Whereas, any and all comments received as a result of such notice will be duly
considered before proceeding with a Request for Release of Funds and Certification, and
Whereas, a Request for Release of Funds and Certification must be sent to the U.S.
Department of Housing and Urban Development at the conclusion of the comment period.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Mayor of the City of Dubuque is hereby authorized and directed to
execute a Request for Release of Funds and Certification for the following identified
Community Development Block Grant projects on or about August 6th, 2018 and submit
to the U.S. Department of Housing and Urban Development.

assume the status of a responsible federal official under the National Environmental
Protection Act, insofar as the provisions of the said Act apply to the U.S. Department of
Housing and Urban Development responsibilities for review, decision making, and action
assumed and carried out by the City of Dubuque as to environmental issues.
Section 3 That the Mayor of the City of Dubuque is hereby authorized to consent
personally, in his official capacity and on behalf of the City of Dubuque, to accept the
jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation
to environmental review, decision-making and action.

Introduction
Attached are the Grant Agreements and Funding Approvals (two copies) for the City's Fiscal Year 2019
Community Development Block Grant award in the amount of $1,073,776. This memorandum requests the
Mayor's signature on the contract between the Department of Housing and Urban Development and the
City of Dubuque.
Background
Resolution No. 32-18 Authorizes staff to prepare and submit the Fiscal Year 2019 Annual Action Plan for the
use of Community Development Block Grant with all related documents.
The U.S. Department of Housing and Urban Development has completed the review of the City's
application for Community Development Block Grant funds to administer activities included in the Fiscal
Year 2019 Annual Action Plan and sent the grant agreement to the City.
Requested Action
To establish a line of credit, the City needs to execute and return one copy of the Grant Agreement. HUD
requires the original "wet" signature. Please provide the Mayor with the copies of the Grant Agreement for
his signature and return the originals to Erica Haugen for submission to HUD and retention in the Block
Grant files.

This is to inform you that a review of your fiscal year 2018 Annual Action Plan has been
completed. The grant assistance, which you are receiving, includes Community Development Block
Grant (CDBG) funds in the amount of $1,073,776.
Enclosed are the Grant Agreements and Funding Approvals (two copies), which constitute the
contract between the Department of Housing and Urban Development and the City of Dubuque,
Iowa.
You should note particularly the special conditions included in the Grant Agreement. If you
are planning to charge any expenses as indirect costs to the grant, you must complete the indirect
cost chart for the grant before returning the agreement. Also, of a particular note are the requirements
for compliance with the Universal Numbering System and System for Award Management (SAM)
and the Federal Funding Accountability and Transparency Act (HATA). Other special conditions
regard period of performance; selling, trading or transferring CDBG funds; review of activities
providing CDBG to for-profit entities; and the restrictions on using eminent domain for CDBG
activities. It is also important to understand the date you may begin to obligate grant funds for
eligible activities. Please contact your HUD program representative if you have any questions
regarding your agreement.
In order to establish a line of credit for these grant funds, you should execute and return one
copy of the Grant Agreement. Retain one copy of the Grant Agreement for your files. If there is a
need to establish or change the depository account to which these grant funds are to be wired, a
Direct Deposit Sign -Up Form (SF -1199A) must be completed by you and your financial institution
and mailed to this office.
You are reminded that certain activities are subject to the provisions of 24 CFR Part 58
(Environmental Review Procedures for the CDBG Program). Funds for such activities may not be
obligated or expended unless the release of funds has been approved in writing by HUD. A request
for the release of funds must be accompanied by an environmental certification.

The special condition in your Grant Agreement and Funding Approval concerning the review
procedures under Executive Order (E.O.) 12372, Intergovernmental Review of Federal Programs,
and HUD's implementing regulations at 24 CFR Part 52 restricts the obligation or expenditure of
funds for the planning or construction of water or sewer facilities until the completion of the review
process and receipt of written notification of release of funds from HUD. Since you have not
submitted your final statement for review under E.O. 12372, we assume you do not propose to use
funds for activities subject to review. However, the condition requires that in the event you amend
or otherwise revise your Annual Action Plan to use funds for the planning or construction of water
or sewer facilities, you must receive written release of funds from HUD before obligating or
expending funds for such activities.
A primary goal of the Department is to reduce housing discrimination, affirmatively further
fair housing through CPD programs and promote diverse, inclusive communities. To that end, we
encourage your community to take all measures necessary to ensure compliance with the Fair
Housing requirements associated with these funds. A copy of your Consolidated Plan/Annual
Action Plan was provided to the Office -of Fair Housing and Equal Opportunity (FHEO) for review.
At the time of this letter, the Omaha office had not received any comments from our Fair Housing
and Equal Opportunity (FHEO) Division regarding your Plan. Should FHEO have any comments,
they will be forwarded to you.
You are encouraged to continue to vigorously promote full partnerships between the City of
Dubuque, Iowa, and its non-profit service providers, neighborhood organizations, the economic
community and private citizens as you implement your Consolidated Plan. In the process of
transforming plan elements into projects, the quality of success will depend in large part on the
closeness of cooperation among all the Consolidated Plan partners. We offer our continued support

Grant Agreement: This Grant Agreement between the Department of Housing and Urban Development (HUD) and the above named Grantee is made pursuant to the

8. Special Conditions.
(a) The period of performance for the funding assistance specified in the
Funding Approval ("Funding Assistance") shall begin on the date
specified in item 4 and shall end on September 1, 2025. The Grantee
shall not incur any obligations to be paid with such assistance after
September 1, 2025.
(b) The Recipient shall attach a schedule of its indirect cost rate(s) in the
format set forth below to the executed Agreement that is returned to
HUD. The Recipient shall provide HUD with a revised schedule when
any change is made to the rate(s) described in the schedule. The
schedule and any revisions HUD receives from the Recipient shall be
incorporated herein and made a part of this Agreement, provided that the
rate(s) described comply with 2 CFR part 200, subpart E.

Instructions: The Recipient must identify each agency or department of the
Recipient that will carry out activities under the grant, the indirect cost rate
applicable to each department/agency (including if the de minimis rate is used per
2 CFR §200.414(f)), and the type of direct cost base to which the rate will be
applied (for example, Modified Total Direct Costs (MTDC)). Do not include
indirect cost rates for subrecipients.
(c) In addition to the conditions contained on form HUD 7082, the grantee
shall comply with requirements established by the Office of
Management and Budget (OMB) concerning the Dun and Bradstreet
Data Universal Numbering System (DUNS); the System for Award
Management (SAM.gov.); the Federal Funding Accountability and
Transparency Act as provided in 2 CFR part 25, Universal Identifier and
General Contractor Registration; and 2 CFR part 170, Reporting
Subaward and Executive Compensation Information.
(d) The grantee shall ensure that no CDBG funds are used to support any
Federal, State, or local projects that seek to use the power of eminent
domain, unless eminent domain is employed only for a public use. For
the purposes of this requirement, public use shall not be construed to
include economic development that primarily benefits private
entities. Any use of funds for mass transit, railroad, airport, seaport or
highway projects as well as utility projects which benefit or serve the
general public (including energy-related, communication -related, water -
related and wastewater -related infrastructure), other structures
designated for use by the general public or which have other common -
carrier or public -utility functions that serve the general public and are
subject to regulation and oversight by the government, and projects for
the removal of an immediate threat to public health and safety or
brownfield as defined in the Small Business Liability Relief and
Brownfields Revitalization Act (Public Law 107-118) shall be
considered a public use for purposes of eminent domain.
(e) The Grantee or unit of general local government that directly or
indirectly receives CDBG funds may not sell, trade, or otherwise
transfer all or any such portion of such funds to another such entity in
exchange for any other funds, credits or non -Federal considerations, but
must use such funds for activities eligible under title I of the Act.

E.O. 12372 -Special Contract Condition - Notwithstanding any other
provision of this agreement, no funds provided under this agreement
may be obligated or expended for the planning or construction of water
or sewer facilities until receipt of written notification from HUD of the
release of funds on completion of the review procedures required under
Executive Order (E.0.) 12372, Intergovernmental Review of Federal
Programs, and HUD's implementing regulations at 24 CFR Part 52. The
recipient shall also complete the review procedures required under E.O.
12372 and 24 CFR Part 52 and receive written notification from HUD of
the release of funds before obligating or expending any funds provided
under this agreement for any new or revised activity for the planning or
construction of water or sewer facilities not previously reviewed under
E.O. 12372 and implementing regulations.
CDBG funds may not be provided to a for-profit entity pursuant to
section 105(a)(17) of the Act unless such activity or project has been
evaluated and selected in accordance with Appendix A to 24 CFR 570 -
"Guidelines and Objectives for Evaluating Project Costs and Financial
Requirements." (Source - P.L. 113-235, Consolidated and Further

ONE-YEAR ACTION PLAN
PROGRAM YEAR 2018 (FISCAL YEAR 2019)
The City of Dubuque will direct the use of Community Development Block Grant funds for Program
Year 2018, from July 1, 2018 to June 30, 2019, to meet the following objectives:
1. Economic development to benefit the community in general and provide employment
opportunities and appropriate job skills to persons of low and moderate incomes.
2. Programs to ensure safe, sanitary and affordable housing opportunities for the homeless
and low and moderate-income renters and homeowners.
3. Community-based programs designed to support a wide range of individual, family and
neighborhood efforts to develop the personal and organizational skills needed to
become self-sufficient and self-reliant.
4. Maintenance and improvement of public and private facilities such as alleys, streets, parks
and sidewalks, to either aid in the prevention or elimination of blighting influences in
the community or to benefit low and moderate-income neighborhoods.
5. Management and oversight activities to formulate and guide policies, plans and programs
to aid in the physical, social and economic development and conservation of the
community and its resources.
The following is a list of activities to be completed as part of the Fiscal Year 2019 Annual Action Plan
for the Community Development Block Grant program and the environmental findings on each
activity. Project descriptions are shown in Appendix A.
All projects determined to be categorically excluded under NEPA (National Environmental Protection
Agency) but subject to review under authorities listed in 24 CFR 58.5 have been or will be assessed as
per the Statutory Checklist regarding regulatory compliance. No funds for site-specific projects, as
identified, will be committed prior to completion of a review for the other related laws of 24 CFR
58.5, including Section 106, and resulting Finding of No Significant Impact, if necessary. See attached
files for Section 58.5 and 58.6 checklists.
Strategy for Tiered Environmental Reviews and Assessments
The City of Dubuque lowa will annually review and analyze all projects funded with Community
Development Block Grant (CDBG) to evaluate their impact on the environment. An overall tiered
review will be completed for the entire CDBG program year and individual site-specific
environmental reviews will be completed as required.
Site specific environmental review will be completed for the following projects: Homeowner Rehab
(Home Repair Program, Residential Rehab and Water and Sewer Connection/Repair, Historic

Preservation, Accessibility Rehab); Rental Unit Rehab (Rental Rehab, Emergency Code Enforcement,
Accessibility Rehab); Purchase/Rehabilitation/ Resale; Lead Paint Hazard Control; Four Mounds
HEART Program; Bee Branch Healthy Homes Lead Waterline & Sewer Repair/Replacement, Lead
Waterline & Sewer Repair/Replacement; Neighborhood Slum & Blight residential rehabilitation
projects; Neighborhood Grants, Microeconomic lending programs, infrastructure, and sidewalk
projects.
Individual environmental reviews will be performed for site-specific projects for the Commercial
/Industrial building Rehab Loan program and the Economic Development Financial Assistance
program. Environmental Assessments will be performed when required for new construction,
demolition, and major rehabilitation when applicable.
Individual environmental reviews will be performed for slum and blight reduction activities involving
demolition and major rehabilitation when applicable.
The site-specific environmental review process for the CDBG program requires completion of the
statutory and regulatory checklists. The Section 106 review for historic preservation review will be
forwarded to appropriate staff for review and approval prior to completion and sign off for the
project. The 'Noise Attenuation Recommendations for Rehabilitation of Properties' form will be
completed by an inspector for all housing rehab projects located within 3000 feet of a railroad, 1000
feet of a major roadway or 15 miles of the airport. Upon completion of the review by planning staff
and the housing inspector, the environmental review officer will be notified for final review and
signature for the site-specific statutory and regulatory checklists.

a) First Time Home Buver Pro�ram: This program provides for loans to assist low and
moderate-income families to purchase their first homes. These funds are used to cover the
"entry costs" of homeownership— down payments and closing costs.

i) Emergency Code Enforcement Loan Program: This program provides for rehab loans to
correct code deficiencies and correct health and safety conditions of rental properties.
The program is aimed at preventing the displacement of economically challenged tenants
resulting from code enforcement actions. Loans are fully amortized, no deferred payment
terms.

COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
The City of Dubuque distinguishes between four different but complementary areas of program
development in its overall CDBG program: Housing Development, Economic Development,
Neighborhood and Community Development and Planning& Administration. The following
description of activities summarizes the projects to be completed in the FY 2019 Annual Action Plan
with the use of CDBG funds; the adopted City Budget and recommended amended City Budget are
shown in Exhibit A.
