Leisure Services Manager Marie Ware is recommending acceptance of the Washington
Park Gazebo Painting Project, as completed by Colonial Painting and Decorating, Inc.,
in the final contract amount of$30,559, which is a $1 ,809 increase due to cost for a
performance bond not specified in the original contract but required by City projects,
and to replace the mast that was determined to be missing from the top of the gazebo.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to recommend that the City Council accept the
Washington Park Gazebo Painting Project and approve the attached resolution.
BACKGROUND
The Washington Park Gazebo Painting Project included the preparation and painting of
the gazebo, preparation and painting of railings and guardrails attached to the gazebo,
and preparation and painting of the inside and outside of inetal skirting below gazebo
slab. Additionally, the repair and/or replacement of broken/missing architectural
ornaments was included.
DISCUSSION
The Washington Park Gazebo Painting Project has been completed by Colonial
Painting and Decorating, Inc. of Dubuque, lowa in the final contract amount of
$30,559.00. The original contract amount was $28,750.00. The increase in cost of
$1809.00 is due to the cost for a performance bond not specified in the original contract
but required of city projects and to replace the mast that was determined to be missing
from the top of the gazebo. The project remains in budget.
RECOMMENDATION
I recommend that the City Council accept the Washington Park Gazebo Painting Project
and authorize the payment of the contract amount of $30,559.00 to Colonial Painting
and Decorating Inc based on the facts above.

RESOLUTION NO. 248-18
ACCEPTING THE WASHINTON PARK GAZEBO PAINTING PROJECT AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE
CONTRACTOR
Whereas, the Public. Improvement Contract for the Washington Park Gazebo Painting
Project (the Project) has been completed by the contractor and the Park Division Manager
has examined the work and filed a certificate stating that the Project has been completed
according to the terms of the Public Improvement Contract and that the Park Division
Manager recommends that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the Park Division Manager is approved, and the
Project is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Washington Park Gazebo Painting Project capital improvement appropriation for the
contract amount of $30,559.00 Tess any retained percentage provided for therein as
provided in Iowa Code chapter 573, and to pay such retainage only in accordance with
the provisions of Iowa Code chapter 573.
