The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
Staff reviewed existing lot configuration, property ownership and access to parcels.
Staff recommended approving the submitted Plat of Survey subject to waiving lot
frontage for Lot 1.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no objections.
Recommendation
By a vote of 6 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot frontage for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted plat of survey resubdivides three existing parcels into two lots. The
Zoning Advisory Commission is reviewing the plat as Lot 1 does not have frontage on a
public or private street.
DISCUSSION
The submitted plat of survey of Pinchuck - Herrig Place consolidates three existing
parcels and resubdivides the property into two lots. The newly created Lot 1 includes a
portion of Lot D Timber -Hyrst Estates that originally was approved in April 2006. At that
time, Lot D was labeled as non - buildable and was approved as not having any frontage
on a public or private street. With the resubdivision of Lot D and the other two parcels,
Lot 1 becomes a new lot, and thus subject to the City's requirement for frontage on a
public or private street. The north property line of Lot 1 basically runs through the
existing South Fork of the Catfish Creek. Lot 1 will be sold to the owner of Lot 26
Timber -Hyrst Estates , which does have frontage on Creekwood Drive.
Planning staff does not object to the proposed plat of survey as Lot 1, while not having
frontage on a public or private street, is not readily buildable due to the property's slope
and over half of the parcel is designated as being in a flood plain.
RECOMMENDATION
Staff recommends that the submitted plat of survey of Pinchuck - Herrig Place be
approved subject to waiving the lot frontage requirement for Lot 1.

RESOLUTION APPROVING A PLAT OF SURVEY OF PINCHUCK - HERRIG PLACE IN
THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey of Pinchuck - Herrig
Place in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides no frontage for Lot 1 on a public street or
approved private street as required by Section 11 -14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statues and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow no frontage on a public street or an approved
private street for Lot 1.
Section 2. That the Plat of Survey of Pinchuck - Herrig Place is hereby approved and
the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City
of Dubuque, Iowa upon said final plat.
