Enclosed with this letter is a report from Architect Barney Bishop describing a potential situation
at Jorja's Restaurant at 890 Iowa Street. Also enclosed is a report from Jan Hess, describing
conditions that Jorja Moore described and demonstrated when we visited the restaurant on March
10.
Since this situation seems to be related to work performed by the City of Dubuqe by
Tschiggfrie Excavating at the beginning of the Law Enforcement Center Addition project while
installing a new water line in the alley, I am referring it to you and the City Manger.
Please inform me of the results of your investigaiton on this situation.

Dear Mr. Waller:
Yesterday, this office was notified by Supervisor Smith that a problem(s) exists with one of the
property owners (Jorja's Restaurant) on the west side of the alley west of the LEC addition
and along 9th Street. Attached, you will find a list of the reported problems/concerns that was
assembled by Jan Hess, Administrative Assistant to the Dubuque County Board of
Supervisors, following a visit both she and Supervisor Donna Smith made to Jorja's. Also,
please note that this is the first time since construction commenced on this project that Durrant
has been apprised of any reported problems to adjacent properties that may or may not have
been caused by any construction activity in that area.
As you may recall, at the start of construction of this project, the City of Dubuque contracted
with Tschiggfrie to install a new water line in the alley separating the new LEC from the
properties along the west side of the alley. That contract and work was completely separate
from the contract for construction the County signed with Prism. Since the majodty of items
on the list pertain to water, I suggest that the County notify the City to the issues identified in
the attached list.
During my telephone conversation with Supervisor Smith, she raentioned that both she and
Jan were told that the excavation for the building addition (LEC)went up to the foundation
(alley side) of Jorja's Restaurant. My response to Donna was that the earth retention system
that was installed along the alley came nowhere near Jorja's. I followed up my conversation
with Donna by talking with Rick Golus, Durrant, to try and determine if he had any recollection
as to the limits of the excavation in the alley. Rick indicated that he thought that the
excavation for the City installed water line came close to the back wall of Jorja's. He also
believed that either Prism or Tschiggfrie had photographs taken of that work as it progressed.
With regard to Item No. 11 on the list, I believe that Prism installed the crack monitor(s) on the
building(s) because of the issues that were current at that time, i.e., City of Dubuque concerns
about the earth retention system. In other words, it was for their own protection, but this could
be confirmed with Steve Bohr.

Supervisors Smith and I visted Jorja's Resturant this date and talked to Jorja
Moore. She pointed out:
1. Cracked plaster under windows in front of building, and molding slipping
around those windows
2. Sediment in cold water coming into the building for dishwasher booster
box
3. Recommendation for pressure tank on booster box
4. Booster box leaking
5. Debris in cold water to ice maching
6. City inspector did take water samples but never got back to her
7. Asked if the jail is hooked up to new water main
8. Said she is the first one on the new water line
9. Bathroom door and molding sagging
10. Expansion joints on exterior of the building have moved. Somebody filled
them in - messily; Steve Behr says he doesn't know who did that
11. Meter put on building by Steve Behr
12. Sediment in tolet tanks causing them not to work
13. Ed Tschiggfrie has exterior pictures of the the building prior to demolition
