MEMORANDUM
March 31, 2003
Due to HUD's non-renewal of the lead paint hazard reduction program grant, the City
has searched for other sources to continue testing, public information and training
activities previously funded under the Round 4 grant received in 1997.
After developing a Fiscal Year 2004 budget showing a $33,335 deficit, in December the
City approached the Iowa Department of Economic Development (IDED) with a request
for financial assistance. This was quickly approved, in the form of a grant for that
amount. IDED realized the importance of continuing the program, as Dubuque was the
only State-certified provider of training services for lead paint removal at the time.
Contractors, health officials, municipal housing inspectors and landlords all avail
themselves of Dubuque's training programs in order to obtain and maintain necessary
certifications.
IDED's funds, however, will be provided through the State Community Development
Block Grant budget. Dubuque, as a CDBG entitlement city, is not eligible for receipt of
these funds. For this reason, Mary Rose Corrigan arranged for the Dubuque County
Board of Health to contract with IDED for this grant. The City will in turn contract with
the Board of Health, and the funds will be passed through in this manner.
Housing and Community Development Department Director David Harris recommends
City Council approval of the Interagency Agreement between the City and the Dubuque
County Board of Health, for administration of a lead paint program training grant.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Introduction
The purpose of this memorandum is to request the City Council's approval of the
attached interagency agreement, between the City and the Dubuque County
Board of Health, for administration of a lead paint program training grant.
Background

Action Step
The action requested of the City Council is to approve the attached interagency
agreement, between the City and the Dubuque County Board of Health, for
administration of an IDED grant in support of our lead paint program training
activities.

This Agreement, dated this 26th day of March, 2003 for referedce purposes only, is
made and entered into between the Dubuque County Board of iHealth (hereinafter
referred to as Board) and the City of Dubuque (hereinafter referred to as City).
1. Authority. This Agreement shall constitute the entire agreement between the
Board and the City with respect to lead certification training programs.
If any provision contained herein is in conflict with any state, federal or local law or
shall be declared to be invalid by any court of record of this State, such invalidity shall
affect only such portions as are declared invalid or in conflict w~ith the law.
2. Statement of Purpose. The purpose of this Agreement iS to delegate the Board's
authority wJth respect to the Lead Poisoning Prevention Program lead cedification
training to the City, and to specify the extent and manner of coo~)eration between the
Board and the City in condu'cting programs for the Lead PoisorJi'ng Prevention Program
lead certification training.
3. Services to be Performed by the City. The services to be performed by the City
to this Agreement shall be set out in Attachment A, w~ich is hereby made a
pursuant
part of this Agreement. J
4. Pedod of A.qreement. This Agreement shall take effect en March 3, 2003 and
shall terminate at the end of the business day on June 30, 2004.
5. No Lectal or Administrative Entity Created: No new legal!or administrative entity
is created by this Agreement. ~
6. Manner of Financin.q: The functions to be performed by !he City under the
pro,,fisions of this Agreement, shall be financed by the City.
7. Compensation to City. in consideration of the services Cerformed by the City
pursuant to this Agreement, the Board shall pay to the City $33,355, in accordance with
Attachment A. The City shall provide the Board and the Iowa Departrr~nt of Economic
Development requests for payments no more frequently than quarterly.
8. Reporting. The City shall provide the Board and the Iowa Department of
Economic Development with a report of its activities pertinent to certification to lead
certification training on a quarterly basis with the first report being due on the 10th day
of October, 2003.
9. Termination: The Board or the City may terminate this Agreement by providing to
the other party a written notice of intent to terminate this agreement, at least 30 days
pdor to the intended date of termination. The notice shall specify the reasons for
termination, and shall be delivered via U.S. certified mail.
Upon termination, the City shall transfer to the Board ail inspection and enforcement
records in its possession and all other documents generated as a result of this
Agreement not later than 30 days following the termination date.
IN WITNESS WHEREOF, the Board and the City have executed two copies of this
Agreement, each of which shall be considered an original.

SERVICES TO BE PERFORMED BY THE CITY OF DUBUQUE
1. Personnel. The City has or will acquire all personnel required for the
performance of the services specified. The City shall continue to employ sufficient
personnel to perform the services required by this Agreement.
2. Compliance. Inspections and Monitoring: The City shall conduct a Professional
Lead Certification Program, and in conjunction with the lowa Department of Public
Health, shall provide certification training to Contractors, Workers, Inspector/Risk
Assessors, Sampling TechniciansNisual Risk Assessors and property owners. Lead
professionals shall be offered lectures, demonstrations and hands-on training designed
to instruct them how to protect property owners, occupants, workers and inspectors
dudng the course of lead hazard reduction work.
Class description:
Contractor Training - 20-hour lecture training and 20 hour hands-on training in lead
hazard reduction. Contractor must pass course exam and third party exam with at least
an 80% proficiency rating,
Worker Training - 16-hour lecture training and 8 hour hands-on training in lead hazard
reduction techniques. Worker must pass course exam and third party exam with at
least an 80% proficiency rating
Contractor/Worker Refresher - 8 hours of refresher training required to be completed
every three years.
Sampling TechniciansNisual Risk Assessor (Inspector) - 20-hour training for technician
who will be visually inspecting properties only and assessing the potential risks of
properties, as well as conducting clearance dust sampling to assure that properties are
safe for occupancy. Both lecture and hands-on training exercises will be presented
Sampling TechniciansNisual Risk Assessors must pass course exam with at least an
80% proficiency rating.
Inspector Il/Risk Assessor - Course participants must have successfully taken and
passed the Sampling Technicians/Visual Risk Assessor (Inspector I) course. Twenty
(20) additional hours of training will be provided for persons who will complete building
inspections using an XRF, as well as environmental sampling of dust and bare soil
Inspectors will assess the residential environments and offer ways to address and to
eliminate lead-based paint hazards. Both lecture and hands-on training will be
presented. Inspector Il/Risk Assessors must pass the course exam and third-party test
with at least an 80% proficiency rating.
Sampling Technicians/Visual Risk Assessor (Inspector I) and Inspector II/Risk
Assessor Refresher - 8 hours of refresher training is required to be completed every
three years for Inspector I and 16 hours for Inspector II.
Eight (8) hour Safe Work Practice Course - 8 hours of lecture and hands-on training
offered to property owners, landlords, contractors and painters. Participants are
instructed how to make safe repairs and prevent lead-based paint contamination and
how to properly clean up after repairs are made.
