INTRODUCTION
This memorandum is to seek execution of the Second Amendment to the Farm Lease
between the City of Dubuque and Anthony Carl Reiss and Anthony John Reiss.
DISCUSSION
Anthony Carl Reiss and Anthony John Reiss and Engineering Department staff have
negotiated the attached lease amendment related to City of Dubuque Farms 6941 and
Farm 6995 (the former McFadden Farm site). Per the attached Exhibits A and B, this
lease is reducing the leased area by 16 acres and the City will take over the reduced
acreage on or before September 10, 2018. This will reduce the total rented acreage to
116 total acres.
Significant elements of the Amendment include the following:
• The total acreage for Farms 6941 and 6995 are being reduced by 16 acres,
leaving 116 total tillable acres �
• Landlord to take control of reduced acreage no later than September 10, 2015;
and
. Payment to Tenant is due from Landlord in the amount of$800.00 per acre for a
total of $12,800.00 per the terms and conditions of the original lease agreement.

Your execution of the attached Lease Amendment between the City of Dubuque, lowa
and Anthony Carl Reiss and Anthony John Reiss is requested. �

SECOND AMENDMENT TO FARM LEASE — CASH RENT
BY AND BETWEEN
THE CITY OF DUBUQUE, IOWA
AND
ANTHONY CARL REISS AND ANTHONY JOHN REISS
Th's Second Amendment to Farm Lease, dated for reference purposes the Z2
day of�K�, 2018, amends the Farm Lease dated May 12, 2017, as amended by
First Amendment to Farm Lease dated July 1, 2018 (the Lease), by and between the City
of Dubuque, lowa (Landiord)whose address is 50 W. 131° Street, Dubuque, lowa 52001-
4845 and Anthony Cad Reiss and Anthony John Reiss (Tenant), whose address is 1729
Sharon Drive, Dubuque, lowa, 52002.
W HEREAS, pursuant to the Lease, Landlord has leased to Tenant Landlord's real
estate described in Exhibits A, B, and C of the Lease for TenanYs use to plant crops (the
Real Estate) located; and
WHEREAS, Landlord desires to reduce the leased area by 16 acres; and
WHEREAS, Landlord desires to take control of the reduced acreage no laterthan
September 10, 2018.
WHEREAS, in accordance with Lease section 24.6 and 24.7, the total acreage is
being reduced by 16.00 acres and payment to Tenant is due from Landlord in the amount
of$800.00 per acre or a total of$12,800.00.
NOW, THEREFORE, in consideration of the terms of the Lease and this
Amendment, and other good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, Landlord and Tenant agree as follows:
Section 1 of the Lease is deleted and the following substituted in lieu thereof:
1. PREMISES AND TERM: Landlord leases to Tenant the following reai
estate situated in Dubuque County, lowa (the Real Estate):
Farm 6941: Ninety-five (95) acres more or less (Northwest fields 28.69 acres,
Former CRP fields 30.76 acres and Southwest Fields 35.51 acres) of tillable
property as shown on the attached USDA Map for Farm 6941, Tract 12594 (Exhibit
A)
Farm 6995: Twenty-one (21) acres more or less of tillable property as shown on
the attached USDA Map for Farm 6995, Tract 12629 (Exhibit B)
All containing 116 (total)(tillable) acres, more or less, with possession by Tenant
for a term of one (1) years to commence on March 1, 2018, and end at midnight
on February 28, 2019. Tenant has had or been offered an opportuniry to make an

independent investigation as to the acres and boundaries of the premises. In the
event tha4 possession cannot be delivered within fifteen (15) days after
commencement of this Lease, Tenant may terminate this Lease by giving Landlord
notice in writing.
Except as amended herein, all other terms of the Lease remain unchanged and in
full force and effect.
IN WITNESS WHEREOF, Landlord and Tenant have executed this Second
Amendmen4 as of the last signature date below.
